Hi, my wife want to file for her parents to come to the USA. We have a cosponsor but need to wait till next year for the cosponsored tax return because last year income was not enough. Should my wife file for her parents now or wait till next year until the cosponsor have enough for the income tax?
Also if she decide to file now and by the time they need the affidavit of support, does my wife have a time limit to submit that before the case gets canceled?

If you haven't already, consider submitting Wills, medical powers of attorney, and similar documents. These are good evidence but are even more crucial to have in "life."
I have until March 11th to submit the documents. Those seems like a long time obtain. When it comes to these like applying for N400 and the USCIS request the documents they need, I become very impatient and wanting to get it done over with. I just can't wait any longer.

If denied, she can reapply. The reason for the initial denial will be reviewed, but does not mean that she will be denied again.
But you're getting ahead of yourself; submit as much of what they asked for as you can and you should be fine. Include anything that shows that you are living together; health insurance or car insurance with both your names on it, receipts for flights you took together, etc. I assume you already submitted a copy of your child's birth certificate.
Right now, I've gather the health insurance for 3 years, the bank statements, the cancelled checks that I've found, the utilities from coned (too bad I don't have the 2013 statement in my coned account anymore, and they take so long to reply back for it when I requested one.) Even though I don't have the mortgage under her name due to circumstances, hopefully with the bank account will be sufficient enough that proves we live together and share finances together.
It's a hit and miss sometimes! Just like you we sent in taxes, the kids birth certificates, some pictures and just some random copies of various joint memberships and we had no issues. We don't have joint bank accounts because my husband thinks banks are crooks LOL! So he hasn't had one in years! It's never been an issue. But all you can do now is try to gather up whatever they need.
, that's basically what we did since we mail in the package when applying for N400. I'm surprise you guys got it easy.

If worst case scenario, they denied the case, will she be able to apply again without any trouble?
I also ask the officer there before we left the office, that instead of mailing in the documents, I can just bring it into the immigration office. Hopefully the documents that I have will be sufficient.

What documents did they ask for? If you have a valid reason to why you can't submit asked for documents you should be fine....
They needed joint bank statement, credit card statement, mortgage, health insurance, insurance (auto, life, etc.), utility, cancelled checks. Everything from 2013-2015. the utility bill, health insurance, I can get from beginning of 2014. The mortgage doesn't have my wife name because when I applied for mortgage, the bankers said that since my wife does not have credit, it would effect me from applying. If I add her now, I would have to refinance or add her name to it only if she has a job which she doesn't. We also don't have cancelled checks because I manage all the bills and I don't write checks due to the fact I can pay my bills online.
I don't understand why they need some of those bank statements since we mailed them in along with the application. Also we have a child together, file taxes together, pictures, and that should be enough for marriage in good faith.

Hi, my wife just had the interview today and she pass the 3 parts of the test. The officer gave her a paper stating a decision cannot be made now. They need more documentation for the pass 3 years but some documents I am unable to provide or not applicable. Will her case be denied if I provide some of the documents needed? Thanks!

So these are not considered as public charge then, so it won't affect the affidavit of support? Also do you know if NY has a 5 year rule for applying medicaid for LPR?

Hi all, my wife will be filing for ROC this July since her conditional green card will expire on October 2014. If she applies for NY health insurance (Medicaid) and WIC, will that affect her application or immigration status since im the only sponsor for her on the affidavit of support?

I've just check the case status at USCIS website and provide the case number, the case status said card/document production and allow 30 days to receive the card. Is it possible to get a green card without an interview? Also they transfer my case to CSC in may.

Hi everyone!!! I just got my EAD card right on my hands!! never been soooo happy to have a piece of plastic with my picture on it in my life!! hahaha I submitted AOS on April 20th, and got my EAD approved on June 26th and I have the GC interview on August 2nd!! everything seems to be going kinda fast so far and I did it all myself with my wife... no need to spend money on a lawyer!! and the most exciting part is I got my card today, I picked up my phone and started making phone calls and now I have 2 job interviews next week and one tomorrow!!!

did the GC appointment letter came together with the EAD card? because I also apply for the EAD and AOS like the same time as you but my wife only has the EAD card arrived but not interview appointment letter.

on the SSN guide here, it said another form of ID, what if she doesnt have another form of ID but her passport with visa and arrival record? what other forms of ID is available?

Hi, after entering POE, me and my fiancee is going to get marry next friday. when can my fiancee should apply for a social security card and file for the AOS?
Also, what things does she need to apply for a social security card?

two questions regarding POE:
1. we received the visa packet recently from GUZ and one of the corner was cut diagonally but the seal has not been broken. I looked at the cut carefully and notice the envelope is made like this. Is the packet ok?
2. Can my fiancee follow me through the US citizen side during the POE since im a citizen or we have to go through seperate?

Finally this waiting game is over! Interview today and my fiancee passed the interview. Documents that being look at is the photos that me and my fiancee took even though we got other documents like email, messaging, phone logs, western union receipts. I was waiting for 2 1/2 hours outside anxiously. She came out with a big smile and I knew she passed. She got a white paper saying congratulation and welcome to the USA. Hopefully she can get the visa in few days!
By the way, one year tax return is ok for the K1 process.

Hi, i receive an email from the consulate statng that my fiancee is having her interview on the 7th of march which indicated on the letter and we're both really anxious and nervous at the same time. Now i got some questions stuck on my mind:
1. the 7th of march is the first day which is the document intake correct?
2. does she pay for anything during the document intake day or after being approve and then pay for the fees?
3. does the VO recommend the petitioner to be there to support her and the approve rate is higher compare to not being there during the interview?
4. I received an email from the consulate stating that they do not send out packet 4's anymore because everything now is electronic which means downloading the forms online and printing it out. Anyone had this experience before?

I asked my supervisor to provide a letter of employement stating my current employement and current salary to use with Affidavit of support. My supervisor told me to get the employee data report online. So i got the report online, it gave me all information as of 1/22/12. it listed my current salary, employer name and address, employment status active, my benefits, last year total salary, my hire date, time with employer, and total historical pay period summary (everything in data form like in a spreadsheet).
My questions are:
1. can I use this in replace of a employment letter from my supervisor or human resource?
2. can I use this in replace of pay stubs since it has all my historical pay period summary?
3. should i get this notarized?

On the first day of the interview intake, does my fiancee give them our proofs of relationship documents (emails, phone logs, mails, etc.) and also the affidavit of support forms (i-134, tax return, bank statements, employee letters, etc.)? If not, then all she needs to give them are the forms that she required to fill out on packet 4 including the medical?
2. for Affidavit of support, do i need to provide pay stubs since i already have the tax return or transcript for the 3 years?
3.If i meet the minimum salary requirement this year for the AOS, do i need to provide bank statements? If so do i need to provide bank statements how many months or statements should i included?

also on my previous year tax return, it only have the summary of the W2's so would that be fine?

This year on my tax return i made more then enough to petition my fiancee. but the last two year tax return, i didnt make enough because i was still studying in school. so is it ok if i just bring the most current tax return and leave the last 2 years out or bring it to the interview? Also should i get a co-sponsor?
