  1. You married within the 90 days, which is the saving element because, although she's newly out of status, she's eligible for adjustment, and you can relax quite a bit.

    There's no formal time limit by which you need to file for AOS. However, your sidebar says that you're near El Paso, and that means inland CBP checkpoints where the agents may not be tolerant or in a good humor. If they ask for her papers, and you have none, you'll be lectured (at best) on why you haven't filed for AOS yet, or (at worst) you'll be pulled over and she could be detained until she appears before an immigration judge, who will instruct you to file for AOS immediately. Should you encounter CBP, they should be more tolerant because you were married within the month and she's been out of status for only a couple of weeks -- but you must have a copy of your marriage certificate with you in order to mollify them.

    File for AOS now, and until you receive your NOA1 (our shorthand here for the USCIS notice of receipt for your AOS package), have your wife keep a photocopy of your cover letter (& check) for the AOS application on her person at all times, along with a copy of your marriage certificate. When the NOA1 arrives, replace the photocopied cover-letter with a copy of the NOA1 in the papers that she carries at all times, which includes a copy of your marriage certificate. When the green card comes, she needs to carry only that, at all times (regardless of what any other VJ member, one in particular, may claim). It's the law.

    You don't need to prove the bona fide nature of your marriage for AOS except to send a copy of the marriage certificate along with the other minimal requirements -- read the instructions carefully, interpret them literally, and respond accurately. The depth of proof of the bona fide nature of your marriage is required in a couple of years, when you file for ROC (removal of conditions on the 2-year green card). For that, even if you're living with your parents and have no lease agreement, for example, you can provide copies of your wills & medical powers of attorney, mail addressed to the both of you at your parents' address, printouts of joint medical insurance from your employer-to-be, etc. Begin collecting items like this now, and as you get them, and throw them into a box. Come two years, you'll have plenty of proof. :)

    Until the green card is in hand, avoid traveling to Puerto Rico, the U.S. Virgin Islands, or anywhere not within the 50 actual United States. The scrutiny regarding re-entry into the U.S. is higher in the U.S. territories.

    Also, avoid going through the CBP inland checkpoint south of Alpine, Texas for any reason at any time.

    American guys marrying a very young less than educated poor girl, is a lot to deal with specially if you haven't been exposed at least to the culture before.

    If you can find someone with no kids, legally single, no leach relatives, can well feed and support herself on my own and serves your best interest- lucky you.

  3. arrive here in the states a week ago and I need to get an SSN to get married here in Texas (? - do I really ) We read their marriage requirement and they require an SSN. To those who were able to get an SSN, what are the documents needed for me to be ab;e to apply? especially what valid id's?

  4. She's homesick 115% and we've been having hard times and it we end up fighting and she's tired of it all and that's pretty much why she almost wants to give up.

    i'd like to suggest for her to use skype or facebook everyday to communicate with her family,it's a very effective way to relieve being homesick. what about let her start packing a balikbayan box to send to her family. that certainly helped me pass the time.

  5. I just filed the K-1 VISA documents. My fiancée and I have an age difference. I am 60 and she is 21. She is from the Philippines. I have her parents consent and never been happier. All documents are in order. I am very concerned that age will be a factor in the interview. Please comment!

  6. We're worried now because it has been a month and a half since our NOA for our application on removal of conditions that said to wait for a biometrics letter. No letter biometrics letter has arrived. We cannot check case status because we need the case number on a biometrics letter to check our status.

    We tried calling the information center 800 375 5283 and there are three options, only one of which pertains to us and we have to enter the number we have not received yet so it is impossible to reach a person to help.

    An Infopass appointment is almost a 900 mile round-trip. There is no number we can find for a field office. We had someone in the August filers for removal of conditions tell us they called USCIS - but we did that and already and found it impossible to reach a person. Is there some other number to call? Our mail may have been stolen because at about the time other people were getting their biometrics letter appointments there was a rash of mail thefts on our road. The theives threw away what they did not want to keep, so it is possible we were sent a letter and did not receive it.

    If we have to travel nine hundred miles for an INFOPASS appointment to find out we are on a waiting list for appointments it is just too incredible to believe what hardship they are imposing when we ought to be able to call someone fer crying out loud.

  7. Does anyone have any idea how long it takes to change your passport to your married name (Phil. Consulate in NY)? I will have to immediately change my passport name because the greencard will be under my married name and I might have a problem reentering the U.S. even if I bring my marriage certificate right? Is there any form of rush service? I plan to travel on January.

    go on the ny phil consulate web site they have a form to fill out -the best bet is to go to nyc with form and say hello -and hope they will do it for you i will try to do this in l.a. calif next week

THANKS FOR THE SUGGESTION...AFTER READING IT, I DID WENT TO THE HEALTH CENTER THAT MY DAUGHTER HAD THE VACCINES AND THANK GOD THEY STILL HAVE RECORDS W/C THEY WERE SURPRISED THAT AFTER 13 YEARS SOMEONE WOULD REQUEST FOR SUCH INFO. SO I HAD THE RECORDS FOR MY DAUGHTER...TOO BAD FOR ME...MY MOM CAN'T EVEN ANSWER ME WHERE DID I GOT VACCINATED...WHAT SHE SAYS IS SHE CAN'T REMEMBER BECAUSE WE MOVE FROM PROVINCE TO PROVINCE AND CITY TO CITY AND THERE WERE FLOODS THAT CAME AND SOME RECORDS WERE LOST...AND SHE WOULD ANSWER ME WITH A SMIRK TONE OF HER VOICE...ABOUT REPEATING THE VACCINE ANYWAY MY FOREIGN FIANCE WOULD BE THE ONE PAYING...(HAVE A HEART FOR GOD'S SAKE) SO HERE I AM HELPING OUT MY FIANCE TO PULL RECORDS OUT AND SO NOT HAVING ANOTHER LOAD OF EXPENSES FOR HIM.     relax! even if you don't have vaccination records, a simple blood test can be done to check your titer, meaning they can tell if your blood level is therapeutic or not. they will only give you (shots) what you need.

  9. Okay, POE is Las Vegas then. Anyone who had that as POE, where is the CBP counter where visa will be checked and yellow envelope will be turned in? Looking at the map of terminal 2, there isn't one listed.

    yes, las vegas is a good port of entry. PAL has their own terminal and customs..not crowded at all. you're in and out in no time..good luck!
