  1. thanks you guys...they give me exactly day for submit on Jan 2012...And i dont think they will ask me about my husband back ground because there no chance for me on an interview again...

    just worry if they think i dont know about my husband criminal...

  2. They are not asking for a timeline of relationship but a 10 year record of residence. On the 10 year residence they will want to know who also lived at that residence with him. Now you stated that he lived with your sister from 2000 to 2003. make sure you note this. This is a huge red flag and may be what they are going to have questions about big time. Good luck.

    Sorry i wrong at first post...i edited...my husband lived with his mother and sister since 2000....not my sister...big mistake

  3. Thanks Jim...so we just write the true and detail as they want...but seem like i dont have any chance to be interviewed again...wonder if they think i dont know about my husband clearly...

    On interview day..they just looked at our pic a bit...and we have a lot evidence but they didnt look...

    we think we will write timeline about relationship and mention about his criminal that he already told me before we discuss about marriage...Hope they will understand...

    Thank you again to give me advice...!...now we just pray..!!!

  4. Hi everyone..finally i got the interview day last week..but they gave me blue sheet and require both me and my husband write statement of the residence in the past ten year...But we wonder if we should write the criminal record on my husband statement or not?..

    Let me tell u about what they ask me on interview.

    1/who ur husband living with now?

    - His mother and his sister in the current address since 2010

    2/Who ur husband live with before 2010?

    - His mother and his step father since 2007

    3/Who ur husband live with before 2007?

    - before 2007 he lived with his mother and his sister

    So..they dont ask the time..but i told them the time..infact MY HUSBAND LIVED WITH HIS MOTHER AND SISTER since 2000 and go jail 2003-2007 but THEY DIDN'T ASK ABOUT MY HUSBAND CRMINAL...

    So do u think if my husband need write that on his time line?...and if yes...will they think i wrong answered at interview?...im so confused and sad...Plz give me some advice..thanks

  6. Then don't worry about it. It doesn't affect his eligibility to file a petition, but you can expect to be questioned about it at the interview.

    hmm...my husband said that too...his friend who is a lawyer..she said the same...but im still...hihi...i know they will ask me about that at the interview...thanks J&P...

  7. Quick question. Was his conviction before or after he became a US citizen?

    Oh After.....and Before he came back to VN for the first time..til now 3 times go to VN...and sometime go to other countries....he didnt get any trouble with custom

  8. No, "irrelevant" means it won't make any difference, it's not applicable, they won't take it into consideration, they don't care.

    There are a few sections of the immigration law where the criminal history of the petitioner is relevant; meaning that it might affect the approval of the petition. For a US citizen filing a spousal visa petition, the main things they would need to worry about are violations of immigration law (visa fraud, human trafficking, etc.) and crimes covered by the Adam Walsh Act (sexual crimes against a minor). The overwhelming majority of other crimes have no bearing on a US citizen's eligibility to file a spousal visa petition.

  9. If your husband is the petitioner then it won't make any difference. It's irrelevant for an IR1 or CR1 visa petition.

    yes, my husband is the petitioner...but what do you mean about "it's irrelevant"??..does it mean impossible for I-130? :((

  10. So how s about the criminal about " Sell drug" and 4 yrs in jail...?...that wat my husband had to pay for the fault that he didnt do...just because going out with bad friends who "sell drug"...im so worry..COuld this have any trouble ?....thanks all
