  1. A gray area exists when you are going to remarry another Filipino in the Philippines in which case you may need to have your divorce recognized in the Philippines first. Another gray area exists in the case of a dual citizen of the Philippines.

Although we got approved for I-129F,the only thing I was worrying about that they may ask my fiance about my annulment in her interview for K1 Visa. We have all the documents, a certified copy of my divorce certificate except my annulment certificate and her cenomar. We're suppose to get married in Canada (my fiance has a working visa in Canada) and file for I-130 but I don't have any patience because we have a son (a US citizen) and I want to get them here asap. She was suppose to do her interview in Montreal, Canada but we decided to transfer our case in Manila because it takes forever to get her case done in Montreal. I didn't call the Manila embassy for a file transfer yet, because there's so many questions going around my mind. :bonk:

I really appreciate for your reply

  2. Hi Rengi. I posted a similar question a few weeks back, and i got a definite no from the community; you dont need to get a local annulment first to petition your fiancee. Just make sure that you include your divorce papers in your I-129F package. Your fiancee has to get a CENOMAR for her interview proper. Both the divorce papers and CENOMAR stand as proofs that you are both legally free to marry.

    Best of luck!

Thank you for the reply. Do you know how to process for annulment?

  3. Hello guys, I am petitioning my fiance (K1 visa) I was married before in the Philippines back in 2005 and I filed for divorce in 2008 here in Chicago.

Do still need my marriage to get annulled even though I'm divorce here in the US? I'm asking this because I don't want my fiance to get denied if her interview comes. And will my fiance need a cenomar?

  4. Hi, I had (have) the same problem. I am on a work visa in Canada that expires on August 12th... and I am from Argentina. According to NVC I can only interview in Montreal if they find me a date before the expiration of my visa, otherwise I must interview in Argentina. Good luck!

So, I need to call the NVC to send all the documents to US Embassy in Manila?

  5. Hi everyone! We need some advise here. Me and my fiancee we're having some sort of a problem here and we are sleepless for a few days now because her working visa will be expiring on June 15. We filed for I-129f and luckily we got approved on May 6 and we put Montreal as her consulate for interview. Does anyone knows if it's okay if we continue to have her visa interview in Montreal even though the was expired or does she have to go back to the Philippines to do her visa interview there? We will greatly appreciate for your help. Thank you!
