  1. I sent the application for a K1 visa on March 8th. Post office delivery confirmation at noon March 9th in Dallas, Texas. I sent the form to receive an email, but I have not received any confirmation from USCIS yet. Today is March 24th. Does anybody have a solution? I have called them and they told me that "sometimes the system isn't good at emailing" and "there is nothing in our file for you yet".

    Most people seem to receive an email with days. It's been over 2 weeks for me.

    Don't panic yet. I know it's nerve wrecking when you don't hear from them right away. There are some instances where people got NOA1 after 4 weeks. So hang on there and hope for the best. I know its easy for me to say and hard for you to do, but there is nothing you can do really, other than verifying if the payment was processed.

    We got our NOA2 on March 15th too! We are waiting to hear from them, my fiance called them and they said we should contact the related consulate. What do you think? I tried so many posts here, couldn't find the best to get more info. Would you please help me how can I search for the related posts & forums? Hope you get yours very SOON!

    Congrats on your NOA2.

    It typically takes anywhere between 2-4 weeks for the case to reach the beneficiary's consulate. Since it's been ten days since NOA2, I would suggest giving it another 4-5 days and call the consulate that your fiance would be attending the interview at, next Thursday-Friday(March 29-30). I don't know if you already know this, in the meanwhile you can call the NVC (National Visa Center in USA) now on their helpline and find out the visa number. A Visa number(also known to some people as Receipt number that is on the NOA letters) is generated after NOA2 is received and from hereby the visa number would be your case number. This is necessary as the people at the beneficiary's consulate would ask for the visa number (not the one you have been using to track your case so far) when you call them to ask for any kind of help at all.

    I know it is very hard to gain all the knowledge about the visa process at once. I just went through all that process and I don't know what all to share with you right now. So write to me if you need any info and I will share what I know.

  3. I've read all the replies to your post and I have one thing to add.

    All that people typically provide are photos together, POE stamps (Port of Entry) on passports to prove travel, boarding passes, chat logs, emails exchanged, telephone bills etc.

    You have to be very prepared for the interview also. Its not always what you show on paper. You have to be quite confident in your answers. Look up interview questions on the internet and prepare yourself really well(I'm sure you did this already, try harder). 1000 pages of chat logs seems too good to be true. I had around 700 pages of chat/email/text message logs, but I picked a few from every month and reduced them to 40 pages.

    Answering your other question, you can't provide videos as proof because any kind of memory devices (CD's, DVD's, pen drives etc) are not allowed into an american embassy.

    Looking at what happened in your case, it just looks like the CO is not convinced with you rather than the content you provided. So be very prepared.

  4. Quick reply to your situation.

    It typically takes 6 - 12 months to get the NOA2. California Service Center is the fastest in processing. You are still looking at a typical processing time of at least 3-5 months.

    K-3 visas(applicable for any kids you and your wife have or kids your wife already had from previous marriage(s)) are a completely different stream and they don't apply to your case as you are already married. K visas are for fiance and any involving kids.

    Regarding the medical exam, she can't get one until the visa is approved, in other words NOA2 is issued. The reason for this is, in order to get an appointment for medical exam at the authorized doctors, they would ask her to provide her visa number and a confirmation letter from the consulate. The visa number is generated after NOA2 is issued and the case sent to her local consulate. Again every individual consulate has slightly different rules and procedures, so the best course of action would be to call the consulate and clarify it.

  5. hello! just want to ask about your interview in embassy! did they ask you if you have receive the letter from them? cause i already have a scheduled embassy interview his coming April 12. and i still don't have the letter of instructions packet from them. i made my appointments using only my MNL case #! please i need your suggestions

    Hi, If you are talking about not receiving your Package #3 from the embassy, it is fine as long as you received Package #4(which is nothing but a letter asking you to contact the embassy for the interview or providing you with an interview date). They didn't send me Package #3(info package) either, they directly sent package #4 asking me to attend the interview.

  6. Hi there,

    I didn't have the time to read all the responses your post got, so I don't know if someone already mentioned this.

    I wanted to say I went through the same situation and I used a co-sponsor and it all went well.

    You need to make sure that, apart from the documents from your co-sponsor, you have:

    1.) The most recent taxes he filed, in your case, 2010 and 2009.

    2.) Any communication/letter from IRS proving that he asked for the extension.

    3.) Also add a letter from the petitioner(your fiance), mentioning your situation.

    And I have a VERY IMPORTANT ADVICE for you. Although it seems that the visa process is the same for each country, there are slight differences in the requirements for different consulates in different countries. So call the consulate you would be attending the interview at, explain your case and they will tell you what documents you need to provide. If necessary, postpone the interview until you have all the required documents and don't risk your interview that is in ten days without the right documents.

  7. Hi I'm sorry to hear what happened to you. I have nothing much to add to what others said previously.

    Straight forward points:

    1.) File on Monday, the longer you wait, the more time you give her to turn the cards on you and don't be surprised if she cooks up a story to make you look abusive or as a wrong-doer.

    2.) There is NO REASON you should wait the time she asked to file for divorce. ACT NOW!

  8. Hello Everyone! I am so confused and need your quick advice. My friend who's been through the process said that the I-134 needs to be notarized and my fiance who is getting all the documents ready to mail to me today said it doesn't. He showed the form to his co-worker who is a notary and she said there's no space in the form for her to sign and notarize it. I looked at the form again and yes I am confused. Please advise. Thank you very much!

    Hey, I think it really depends on the consulate. we didn't have to get ours notarized and I'm from india. when in doubt I think the right place to get it cleared is to call/write to the consulate you would be attending the interview at. All the best!

  9. My fiancée had her interview today but we didn’t any luck. She didn’t get approved or disapproved. She was asked only a couple of questions, how we met, when we met, etc. Both of us have been married before and she was asked if my ex-wife was US citizen and if she got her green card through me, which she did. My fiancée was completely honest and she told them the truth. These were all the questions she was asked. Then the interviewer told my fiancée that she forgot a form, I think it was the DS-156 form, which she was told earlier by their help line that she didn’t need it. They told her that she needed to send this form by mail and then she was going to be notified of a decision. They kept her passport and some other documentation. Now we are terrified that she will not get approved due to my previous marriage and that my ex-wife got her green card through me. I just would like to know if there is someone who has gone through the same situation and what the outcome was. Also, can they deny her visa based on my previous marriage and that my ex-wife got her green card through me? Please advise. We are really terrified that they wouldn’t approve her visa only because of my past marriage. Just in case someone is wondering, There was no fraud whatsoever in my past marriage, this is life and it just didn’t work out as many others.

    I'm not an expert in the k-1 visa process, but I have had my experiences with American consulates for four times now over 8 years(3 times for f1, now k1-approved!). From your story, it seems like your fiancee was handed a form 221g aka the blue form asking you to send the missing application. From my previous experiences and what i have seen from my friends, if they retained her passport and asked her to send the missing documentation, it's not a sure shot no. So there is still hope that you can make it! Again it depends on a number of factors. The point that your ex-wife got a green card through you previous might ring some bells for them, but its not a outright rejection if certain things about this relationship are strong- like have you guys known each other for at least two years and have you met each other in person at least 2-4 times during that period and then your correspondence. So as along as you guys have all these in order there is no immediate reason to fear. Good luck with you application!
