First, congratulations on finding the love of your life. Next - only you and your fiancee can decide what is right for you, but you are legally entitled to get married here now, and file for AOS. You cannot do this if you intended to come here on your tourist visa and get married, but unless you say this, the government cannot prove otherwise. The one other thing you may consider is have anyone in your family receive a tourist visa BEFORE you file for AOS so they do not have any problems later given they will look at your history and your circumstances may raise a red flag. Hello, I'm currently in the US on a B1/B2 visa, yesterday I proposed to my girlfriend who I've dated for the last year. She is a US Citizen. I was wondering if it is advisable for us to get married and filed por AOS, or should I come back to my country and apply for fiancée visa and then come back and get marry.

First, sorry to hear it's not working out. That said, I do not think you'll find much advocacy for taking oath under an immigration officer, stating you and your estranged wife, who is on dating websites and kicked you out, are in a bona fide marriage since 2011, so she can get her 10 year GC - in exchange for a favorable divorce settlement. I'd consult a divorce attorney, not an immigration attorney. Good luck.

Why would you withhold evidence so you could "send it later"? You are trying to prove the co-mingling of funds and joint liability. Do not give USCIS an excuse to send you an RFE, request for an interview or to deny your case.

Well, the USCIS took a slightly different view. They found the information compelling enough to issue a 10 year greencard - although they did request copies of our driver's licenses, which we sent in, and 2 days after they approved the case!

Attached sheet has boilerplate stating foreign documents must be translated into english by cert translator, failure to respond my result in term of status, then:

IDENTITY DOCUMENT: Submit legible copies of the conditional permanent resident and petitioning spouse's driver's licenses and or identity cards from the appropriate state's motor vehicle department.

Confirmed w/my attorney the right play is to simply give what they are asking for, our US driver's licenses (same address of course) front/back, sent to them via tracked courier. I will not send anything more or less.

I don't know what kind of interview you are talking about but if it is anything other than a biometrics appointment I would be showing up fully prepared, including spouse

We sent in an I-751 package about 3.5" thick weighing 3.7 pounds, just got receipt today. Basically my tactic is send every possible thing they could ever request in an interview and if they ask for interview I'll just increment what I sent.

Question is - where is our evidence soft and what could we incrementally be preparing in case of RFE or interview in the meantime? Note the house was in my name, purchased in 2009, 2 years before we met, I'm the only one on the deed.

Attorney said having the joint Checking statements without transaction activity would be a red flag so just get a letter of good standing showing joint account ownership. The Checking account we have in common has very little usage, e.g. most months no usage. We do ALL our purchases through AMEX. There are over $100k worth of AMEX transactions in past 2 years, $20k of which are through her, most of which are: food, home stuff e.g. Target, gas, etc. The AMEX cards are in her name and they are in the package photocopied. This includes receipts for the trips we took together including the airline bookings we are including. My Income goes into a checking account in my name only which is going to be a red flag for them. I'll include photocopies of the debit Checking cards anyhow as well.

She moved into my house which I purchased in 2009, 2 years before meeting her. The deed/mortgage was in my name. All utility bills were/are in my name. She has no job...therefore no ability to pay for any utility bills.

Three years tax transcripts....we were married 7/2011, we filed 2011 jointly so yes we could include that as well. 2010 filing I was married to someone else so not sure I want to add that.

The only other thing that I would add to what has been said is to get a review of your package by a qualified attorney to ensure everything is setup right the 1st time around. Many will call it optional or a waste of money but for the 300-400 bucks they´ll spend I would give it a shot.

I will make this short & to the point since I´m on vacation here in Vzla

1. Wife has her CONDITIONAL GC (see sig below)
   
2. Her mom (my mother in law or MIL) has 2 siblings in the US with permanent greencards, neither of which meet the 120% poverty guideline for I-864.
   
3. My MIL would like to be able to come and visit the US for visits, aka "tourism", with potential down road to live in the US.
   
4. MIL is NOT legally married to her husband but has joint tennancy of house, finances, etc. for about 27 years
   
5. MIL went to Caracas in Dec 2010 to apply for a tourist visa and was denied on the spot, verbally, and was not given a reason. She was told to reapply in 6 months.
   
6. She had previously been granted a B1 visa that she traveled to/from US on without overstay, which had since expired.
   
7. It appears that she was asked if she had family in the US to which she said ´no´ but in actuality her daughter was there on a valid B1, and her 2 sisters had greencards.
   
8. During the interview the consulate worker appeared to be agitated with her answers.
   
9. They asked how she paid for her trip to the US previously and she said it was a gift from her spouse. She is not legally married and she listed ´single´ the application. So for this she wrote the right thing on the app but her verbal answer did not line up.
   
10. They also asked how she could leave her work for months on end to visit, she said she was an independent worker (she does beautician work from her house), this also troubled the worker it seems.

Questions:

1. Is my assumption that if MIL gave incorrect info at visa interview and it was detected, she is permanently barred from entering the US, visa, greencard, or otherwise, without expection, correct?

2. My thought is that the easiest way for MIL to gain unobstructed access to US would be through a GC since she has the right through her sisters, but since they do not meet the income guideline, it crates a problem.

3. Given she has had the decline in the past, and she is getting (my judgemental words here) shoddy advice from random people, she should get legal advice from a lawyer.

If there is a better way to get her able to come over and visit let us know. Again she does not want to live in the US at this point, but to have that door open in the future would be a good thing. If she did get a GC she would not be coming over for more than a month or so at a time.

So if you have a family of 6 and dad loses work then you have 6 of 6 living in poverty?

Also what is the definition of poverty? Is it the annual income or the quality of life?

I would argue many got a quality of life in the 2000s that came from leveraging credit that shouldn't have been extended.

HELOCs, credit cards, cash advances, flipping houses that were overvalues, buying cars, taking trips, etc.

Not saying that those are all bad things to do but the few that I know that got hit were $15/hr factory workers before, during, and after the bubble.

With all that loose credit they got to live like $35/hr workers for a few years.

My wife was a radio journalist and prides herself on proper pronunciation of words.

In her words I sound like a sharecropper with a 4th grade education, 'papi rancho'. She mocks me when I say y po' eso pa 'ca, ya oiste, and on top of it I've picked up a bunch of Maracucho dialect.

So when we do a double date and the other American speaks flawlessly like he is from Madrid, and then papi veguero (me) cuts in with oye chamo, esconetao, verguero, esvergateao, chimbo, charchapera, cunazos, arrecho, pixina, no me jodes, etc. And on top of it when I don't know the word I just use Italian because they probably will get it. When I talk with Venezuelans they are like where in the hell did this guy come from.

It will be interesting to say the least when I go there next week!

I believe we should be utilizing prisoners for farming/picking type of work, rather than illegals. It serves this country better in numerous ways:

We should bus out these people that are hovering around homeless shelters here in downtown, they sit around doing nothing except looking to get high or find shelter. And they are clustered in packs of fellow addicts, there's crack dealers amongst them walking around, the environment doesn't lend itself well to rehabilitation.

Send them out to the farm, give them a job, put money in an escrow account, provide studies in the evenings and on the weekends, and maybe 3-4 cold beers at the end of Friday. They could eat off the land and grow their own crops.

After a month they would have $1000 in an account, an education, physical fitness, focus, and skills. Promote and develop the leaders and use the charismatic ones to help recruit others.

I'm talking about taking maybe the top 3% of those that are milling around downtown, the other ones would just take the $1000 and smoke it at the end of the month. And 80% of that 3% would probably relapse back into #######. But you would still get to lift up a good 20-50 men & women into a normal life in a year. That's something.
