  1. One of the things I miss the most!!

I have what is considered very generous time off - which is unusual here - 3 weeks paid vacation (15 days) - 5 days personal time and 8 sick days per year.

However, compared with my 42 days (just vacation) when I left the UK it sucks!

My son who works for a global company here in SoCal gets 3 weeks a year (15 days) but that combines vacation, personal and sick leave - they are not broken out separately!

Also, culturally here (at least in Southern California), it is frowned upon to take ANY time off for any reason and it gets very wearing knowing that you have such limited work/life balance. If my husband would consider moving to the UK - that would be one reason I would move back TBH!

  2. I know this sounds really dumb, but maybe the Post Office is treating the PO Box as though it's like an apartment mail box section whereby they won't deliver the mail unless the recipient's name is stuck to th einside of the door of the mail box?

I kid you not - my daughter-in-law has had the same problem with her SSN card three times - even though the post office delivered other regular mail in her name to the same mail box. Official, Government mail they would not deliver until her name was stuck to the inside of the mail box door!!

  3. but requested they write down her SSN so she could at least know what it is (thinking we would be applying to get name change after wedding anyway so not a big deal!)

Confirm if they wrote down a number but you have yet to see it on an actual card. Do you think you could be chasing a number that isn't correct or never got issued?

They wrote down what they told us was her SSN. I believe it was valid but the problem is that e-verify matches that to her maiden name not her married name.

    Green card received Jan 2016

went to SSN office a week after receipt to request SSN in married name - took copies of green card and marriage certificate - they said it would take up to 4 weeks yet still not received and no correspondence at all requesting further information or giving any information about delay.

That might have been too soon for the new status of permanent resident (with married name) to show up in database so they were doing the manual verify which can take weeks/months. SSA told us to allow 2 weeks for a status change (greencard, naturalization) to trickle down to them from USCIS.

It shouldn't be this difficult! She showed them her marriage certificate which proves her maiden and now married name and her green card is already in her married name.

All the times you mention going back to request a new card. Do you mean you started over with a new application? Wonder how many applications you might have floating around in the system mucking things up.

There shouldn't be any duplicate applications: we followed their procedure as requested by SSN office:

applied for original - never received

went to office to request replacement because original never received - this replacement was also never received

went to office to request name change - not received to date

  4. This is about my daughter-in-law

    • arrived May 20, 2015 on K1 visa - Went to SSN office 3 weeks after arrival to apply for SSN in maiden name
    • card never received - went back to SSN again twice to request new card - still never received - gave up on maiden name card being received but requested they write down her SSN so she could at least know what it is (thinking we would be applying to get name change after wedding anyway so not a big deal!)
    • married August 6, 2015
    • went to SSN soon after marriage to request SSN card in married name but I-94 was expired so they wouldn't do it until EAD or Green card received
    • Green card received Jan 2016
    • went to SSN office a week after receipt to request SSN in married name - took copies of green card and marriage certificate - they said it would take up to 4 weeks yet still not received and no correspondence at all requesting further information or giving any information about delay.
    • Very frustrating as got turned away from DMV as green card doesn't match maiden name on existing SSN, unable to work because e-verify doesn't match and unable to file taxes - they got rejected because of SSN not matching married name, also husband's bank won't ad her to his account because she can't provide the actual SSN card in her name!

e-verify still not matching as of today

So....I checked SAVE database using passport number, A-number AND I-94 number and all show no match.

Is this likely the problem? I can't see why it would be since she managed to get a SSN in her maiden name originally - even though she never got the actual card. (If the number they wrote down for her is correct!)

Any help would be much appreciated as her life is completely on hold until she can get this resolved.

    Thanks in advance!!

  5. You may already have done this but make sure your name is on the inside (if not on the outside) of your mail box.

USPS say they have TWICE delivered my daughter-in-law's social security card and yet they haven't!

SS office say it was delivered to the home address and has not been returned to them

I even called the postmaster for their city who said - it says it's been delivered but if it wasn't it was because her name wasn't on the inside of the mail box!

  6. A friend of mine - lady aged 68 been here for 10 years having been petitioner by US citizen son - applied for N400 beginning October 2015.

Had her citizenship test and interview on February 1 in Santa Ana and was approved.

They told her they are adding more oath ceremony dates because they are behind and that she should get her Oath Ceremony date for end of February!

    Just FYI

  7. I don't know which bank you have - may have missed that - what they are telling you is wrong! Period!~

I used to work with the Know Your Customer requirements for a bank!

http://www.keytlaw.com/usrealestatelaw/open-us-bank-account/ - you don't need every single one of these - just whichever you do have - A foreign passport showing your K1 visa is sufficient is sufficient along with SSN. If you have any bills showing your name take those too.

Ask for the manager and explain you know the requirements, or go to a different branch and see if some other dumb dumbs are not so dumb dumb.

  8. So I'm answering this question from the banking perspective.

You do NOT need state ID to open a bank account.

This falls under the rules of the Patiot Act - know your Customer rules.

    This is what you need:

I am not a U.S. Citizen. What can I use to open an account?

For non-U.S. citizens who do not have a SSN, one of the following numbers can be used:

    • Passport number and country of issuance.
    • Alien identification card number.
    • Number and country of issuance of any other government-issued document bearing a photograph.

I applied for a SSN but don’t have it yet. Do I have to wait to open an account?

As long as you have applied, the CIP Rule allows banks and other financial institutions to open an account. You will have to provide proof of your application. Pending applications are acceptable for both individuals and businesses.

    https://www.privacyrights.org/customer-identification-programs-financial-transactions#4

talk to the Bank Manager and explain you know what is required under this Act and that what they are asking for is not it!

Birth date verification and legal presence requirements

The issue of identification reliability, integrity, and confidentiality is of prime concern to all citizens. Eligibility for government services, issuance of various licenses, assessment of taxes, the right to vote, etc., are all determined through evaluations based on identification documents. It is critical that identification documents be authenticated and accurate in identifying each individual. The California driver license and ID card have been declared as primary identification documents in this state by the California legislature.

State law requires every applicant for an original California identification (ID) card and driver license to show verification of birth date and proof of legal presence within the United States to help safeguard the accuracy and integrity of departmental documents.

If your current name no longer matches the name on your birth date/legal presence document, see "True Full Name" and "How to Change Your Name" for more information.

Only the original or a certified copy of one of the following documents is acceptable:

    • Permanent Resident Card
    • Temporary Resident Identification Card
    • Canadian Passport/Birth Certificate
    • Non-resident Alien Canadian Border Crossing Card
    • Valid foreign passport with a valid Record of Arrival/Departure (form I-94)
    • "Processed for I-551" stamped in a valid foreign passport
    • Permanent Resident Re-entry Permit
    • Refugee travel document
    • Employment Authorization Card
    • Valid I-94 stamped "Refugee," "Parole or Parolee," "Asylee," or Section 207, Section 208, Section 209, Section 212d(2), HP or PIP
    • Valid I-94 with attached photo stamped "Processed for I-551 temporary evidence of lawful admission for permanent residence"
    • Notice of Action (I-797 Approved Petition) - must indicate approved extension of stay or change in status that grants temporary or permanent residency, or indicates that an original, duplicate or renewal Resident Alien card is forthcoming.
  10. My daughter-in-law (Brazil) had her AOS interview last Friday.

I prepared their paperwork and sent copies of evidence of join accounts along with her AOS package. (stuff like phone account, AAA membership (no bank account since she doesn't have physical SSN card)

I also prepared 2 huge folders full of "evidence" for them to take.

Their AOS interview lasted approx. 10 minutes and they were not asked to show anything they took with them

The lady saw their folders and laughed that they took so much stuff with them...said it wasn't needed unless it was a complicated case

I would put as much as you have in your AOS application and see what happens.

It makes me nervous that interviewers say that because you can bet your bottom dollar that if they had take just marriage certificate and proof of wedding, they would have been asked for more stuff!

  11. Now I can stop worrying!!

AOS. approved for daughter in law today in Santa Ana.

No questions asked other than the questions on the I485 form.

Didn't want to see any additional evidence at all...in fact she said no need to even bring all that stuff....made me smile, because if they hadn't gone prepared, it could have been a huge issue!

Got in to interview at 12:35pm and back at the car by 12:48pm!

    DIL Verdict: anti-climactic!

    Status already updated to approved!

  12. My DIL's interview is this Friday in Santa Ana, CA.

They are a bit short on evidence because they haven't been married all that long (august 2015)

Here is what they have to take with them (some of which they provided in their original package

usual copies of stuff like birth certs etc, marriage cert, I-94....etc....

Updated bank statements and pay check stubs etc.....

    Joint health insurance

    Joint AAA membership

    Joint cell phone account

    Joint lease

    Joint dog purchase

    Joint vet bills

Advance Health Care Directives each signed by the other person

photo books of engagement and wedding

joint named return label for Macys

a couple of other pieces of joint mail.

her bank account showing husband (USC) as beneficiary)

She has no physical SSN card to provide as proof for stuff like getting on household bills or getting a joint bank account together so they can't provide any of that.

Any concerns or likely this will be sufficient?

  13. EAD is needed if her I-94 is expired.

We had the same problem when we went to SS office.

We applied for SSN in maiden name - no problem (other than that the post office never delivered the card).

Went back to SSN Office for new card in maiden name based on non-delivery - again, PO failed to deliver.

Went back to SSN office when married to get SSN changed to married name but since I-94 had now expired, need EAD to get SSN card!

EAD was placed on hold for request for initial evidence (they requested copy of marriage certificate showing name change which we had already sent with original package!!)

    Bit of a mess really.....

    https://www.ssa.gov/pubs/EN-05-10096.pdf

To prove your identity and work-authorized immigration status, show us your current U.S.immigration documents and your unexpired foreign passport. Acceptable immigration documents include your:

    • Form I-551 (includes machine-readable immigrant visa);

    • Admission stamp showing a class of admission permitting work;

    • Form I-94 (Unexpired Arrival/Departure Record); or

    • Form I-766 (Employment Authorization Document, EAD, work permit).

  14. Seriously ticked off - received the RFIE today for both AP and EAD.

They said name discrepancy. (forms were completed in married name and a copy of marriage certificate was attached to each application, along with copy of passport, I94 and anything else that was requested.

Requesting copy of marriage certificate (which they already had) and/or divorce certificate (though o prior marriages!) along with an affidavit describing name change.

I seriously cannot believe their ineptitude!

Strangely no RFIE or RFE for AOS and yet that same stuff was all in that package too.

Let's hope interview goes smoothly on Jan 8......
