  1. If your relationship wasn't going good why did you file jointly anyway, plus you don;t live with your wife cause of your job, what kind of job is this? do you have to travel all the time?

yes i do travel a lot from state to state sometimes i go to canada and come back to the states again !!!

    Then why are you concerned?

if you re-read my first topic again then you'll know why i am cocerned!!!

  2. How did you find out she talked to immigration? Did she tell you or did someone else? And if she told you, was she angry or were you in an argument when it happened? If angry or in an argument, that gives strong evidence she wants to get out of the marriage and that she possibly has ill-intentions. Are you still co-mingling your finances? If she's hostile toward you, watch the money. It might give you an indication she's socking $$ away for her escape.

Do you have strong proof you entered into this marriage honestly? If so, gather it all together -- even more than you submitted for ROC. Put it in a decent order -- for instance, all financial records -- put them in date order; vacations/photos/personal info, in date order. Gather affidavits from people who know you and your wife and know that the marriage is/was real. Get a letter from your boss stating why you have to live apart.

You want to walk into that interview, if granted, with strong evidence about the marriage up until this moment. And then, like Mehmet in the February group, you'll hopefully be given a hearing at some point in the future.

I'm hoping that there is no abuse in your relationship coming from your end. If that's why she wants to have a separate interview, no telling what will happen.

    Good luck.

hi thx for the reply; i found out that she talked to immigration from a copy of a letter she sent to them after we filled the I-751 !and yes we did have an argument about it and she also told me that she went and talked to them in person ...she told me it was a mistake and she will try to fix it but i don't buy all that !! i know she is trying to find a way to get me deported but what's holding her back is that she co-signed a student loan for me she is afraid if i get deported she will have to pay for the loan so she went and talked to immigration to see if she can find a way out of it !!!also i have evidance that i was married to her in good faith we have been married for 3 years now ...and i never abused her or put my hands on her wich i'll never do to any women ..!!

  3. Be specific with what is going on between you and your wife. If I may ask, why did you prefer a 10 year green card instead of applying for removal of condition - ROC...Do you not want to be a US citizen? Well, your wife can not just make the USCIS deport you easily once you have your greencard...so don't be scared...

Make haste and fix your marriage...living apart is not a good idea...no matter how much you are being paid in your job. Moreover, the marriage is still too young for that...lets hear from you...

10 years CG or removal of condition are the same thing !! that's what u apply for when your 2 years CG is about to expire and i didn't know that my wife will do such a thing to me! we still married and we do see eachother ...sometimes and when i get time off work i go back home and stay with her for couples days or so ...but she wasn't happy with that but theres nothing i can do about it cause i need a job !

  4. Hi fellow brother,

Im sorry to hear that things are not going well between you and your wife.

I thik first thing first: You need to talk to your wife so that both of you understand what is at stake here. The immigration process is related to your wife therefore, whatever she does is going to have an impact. You guys need to talk and find a solution.

The good news is that immigration doesn't care if your marriage is not working right now. All they care about is if the marriage was bona-fide from the beginning. I have seen many people from other country divorcing before their immigration process ended (In this website), it wasn't a problem. So why should yours be automatically considered fraudulent?.. Unless yoru wife tells them that since the beginning, all you were interested about was the immigration and not your relationshp.

So: 1) Talk to your wife. Separation doesn't mean messing up your immigrtion process, unless she thinks (And rightly so) that you were only interested by the paper. That will be hard for you to "Unproove"

    2) Make sure you have good proove that the relationship as bona-fide from the beginning.

Life happens, so make sure you guys don't make follish decisions based on anger and pride.

    Best,

thx bro, i appreciate your answer ! i talked to my wife about it and she said that she's going to talk to them again and try to solve the problem ..but i can't trust her anymore after i found out that she went behinde my back and toled them that we are having problems in our marriage !

  5. hi all;

i need some help plzzzz ! i moved to us on march 2008 on a (k1 visa )...got married and i got my 2 years GC ..i have been in the states for 3 years now ! last january 2011 i filled I-751 for Removing conditions.. to get 10 years GC ..we filled jointly me and my wife i got a letter from uscis to go get biometrics wich i did .and they sent me a notic says that i am allowed to stay and work in usa for another year while i am waiting for my GC ... but last week i found out that my wife wrote a letter to Immigration and went and talked to them about us cause our relationship is not going good and she wanted them to call us for an interview and she wanted it separetly i don't know what she is planning on doing ! but we still married and we just filled taxes together ... but i don't live in the same house with her right now because of my job and we did tell immigration about me not living with her when we filled the i-751 ...i just wanna know if what she did will cause me a problem? and could she get me deported ? and can i get my GC after what she told them about us having problems ? Any answers will be appriciated !thank you !

  6. If you filed a joint petition and are not living together, that is fraud. Sounds like your wife really wants no part of that.

She cannot "get you deporteed" but you can be deported for your own actions...such as filing a fraudulent I-751 petition stating you are living together when you are not.

thx for the answer ! but when we filed I-751 we state that i moved out of my wife's house because of My job ..so i didn't lie about anything when i filed the I-751 so why u think it's a fraud !?

  7. The Title of my car is in my name but the insured person on the State Farm insurance card is my husband for both my car as well as his car (his car is in his name). Would this be a good evidence to submit to USCIS for I-751 (removal of conditions) filing?

My husband and I were thinking that we can submit the copy of the 'Title of the Car' which has my name and the Insurance Card which has his name as the 'Insured'. Will that work? Or will this come under scanner by the USCIS?

that will work just submit them together ...
