  1. This OP is in the USA and filing I-485 with approval notice from I-130. It should have been filed together at the same time. They MUST INCLUDE THE MEDICAL WITH THE PACKET. They are not filing from a spousal or fiance visa there for they need a FULL Medical done inside the USA to send with the I-485. Your advice is incorrect.

    --ok so since I'm in the US. I have to send my medical with the packet, can anyone else confirm this? I really appreciate the info. I just wanted to make sure this is the case to avoid any hassles. I have searched on this website and can't find any info on the civil surgeon step.

  2. What is your status now?

    1. Medical Exam--no you cannot do it now you must wait until you are sent the request to do it. From my understanding when you have no shot records you will be required to get a series of shots..Is it really a I-485 you are doing now, that is to change status or register as a permanent resident.

    2. Affidavit--Sponsorship Requirements

    A sponsor must be at least 18 years old and either an American citizen or a lawful permanent resident (LPR). The sponsor must also have a domicile (residence) in the United States.

    3. I am not sure about this one..google to see what you get back on Advance Parole it is different depending on your status..

    --I have no status, I overstayed for a long time, I was 14 and came here on a child minor of a non-immigrant worker (H1B I believe), fast forward to now married a USC, been married for 4 years and trying to file I-485 with an approved petition. I just wanted to know what the steps and procedures to follow.

  3. 1. Technically you're supposed to get all your shots and medical forms filled out before you file for your i-485. The docter will give you a sealed envelope in which you have to send with the rest of your I-485 documents. Don't worry about not having any vaccination records. I didn't have any. I just took all the shots that were required for the I-693 Medical Form.

    2. Your mother-in-law will have to fill out an I-864a. She will have to file as a co-sponsor which means she will need to meet 125% of the income requirements for 2 household members.

    3. Yes, file the AP with your I-485. It will allow you to travel in and out of the country while your I-485 is in pending status.

    --where can I find a list of approved doctors and whats the lifespan of the exam-(do I have to send the packet in 10 days, 30 days, etc)

  4. What are you adjusting from and do you have overstay in the USA.

    Why didn't you file the I-130 and I-485 together at the same time as the guides state to. You must have the medical done by a CS listed from USCIS and send it in with the whole I-485 packet.

    --did not file 485 concurrently because of financial reasons, in retrospect process would have been a lot faster, I'm married to USC petition, yes I over stayed.

  5. Hi, my petition was approved and I received the letter a week ago. Now I'm starting to file I-485 and have a few questions.

    1. Medical examination:

    --Can I get this done before filing the 485 by a immigration approved doctor or do I have to wait for uscis to tell me to go to their doctor?

    --I do not have vaccination records, how do I go about this issue?

    2. Affidavit of support

    --My USC wife currently is unemployed, can I ask any other family member to file an affidavit of support (i.e. my mother-in-law)?

    3. Advance Parole

    --my father back in my home country is not doing too well health wise. I would like to visit him just in case he goes, is it advisable to file this while 485 is pending? is it safe to do it? should I wait for the 485 to be approved before leaving the country?

  6. It really depends, but as a general concept, anyone claiming US citizenship faces a potential lifetime ban with no waiver available. The details matter a lot and this requires the very best lawyer you can find, but ONLY If they have handled a lot of similar cases. Most things in immigration can be handled by yourself, but not this one. Think hard and check all the records you can find to see if you ever checked a box that you were a US citizen, and then go to Laurel Scott's FREE immigration chat every Wednesday at noon.     Overstaying and working is irrelevant if adjusting status as an immediate relative, which is what you are doing, but the questions asked by Magical are important. Also, did you pay taxes on your income?

    --Yes I paid taxes on my income, and I don't recall at the moment if I ever claimed Us citizenship in any capacity, but what are the consequences? Also I never left the country.

  8. Hi, First time poster here, but I have been lurking the forums when I started my visa journey. Well let me tell you my story first and I'll have some questions I need to ask.

    I came to the US from the Philippines in 1994 on a H-4 visa category(H1 Dependent-my mom worked here I was 14 yrs old.)I went through with inspection at a port of entry. My mom received her GC in the late 90's but she passed away in early 2000's. I recalled she petitioned me somehow but all the paperwork was lost with that petition. Fast forward to now, I married a US citizen in 2007 and she recently filed a petition for me, I-130 just this month(April 2011) and I'm currently residing in the US with her. We have been together at least for 4 years before marrying her. So here are some of my questions and concerns:

    --I overstayed my visa for a good 15 years, what are the consequences that will affect the petition?

    --If the petition is approved, will I be able to Adjust Status?

    --I worked during my overstay without authorization, what are the consequences that will affect the petition?

    Thank you in advance for any help and advise, I pray everything goes well in my journey. (Also I am scared and worried about this whole immigration filing, and it really helps to read everyones stories. )

    I forgot to add, She only sent in the I-130 petition, we did not send the I-485 with it. We are waiting to see if the I-130 will be approved before filing the AOS.
