    Yes, as we did the full year with the K1 then things changed, we can apply for an expedite with a letter from his CO and the local Cenate is backing us too. So fingers crossed we do get it, as he only got back at the tail end of last year from Iraq.

    Thanks for your replies, I couldn't think where else to ask.

    Lets hope my custody case ends soon and we are allowed to leave - I am hoping everything times in together.

    Do you think they will make us do the medical again? We had our done in August and the papers are in the London USA office.

  2. What you have been advised to do is called visa fraud. That is not a good idea & will result in you being banned for at least 10 years.

    You need to find out from the embassy exactly what they require for the children to be allowed to immigrate.

    It would be a good idea for the USC to post these questions for clarity.

    Thanks so much - it did sound too easy - we shall stick to the re application and expedite request via his work. I just thought I would ask. I have heard of people marrying then staying, but I thought that was a bit of a gamble too. :)

  3. Hi,

    I was nearly granted my K visa to move to America with my children when a custody case started over here with my ex partner. So the children and I flew over for a holiday and I married my long term partner.

    He is in the Military and the I130 will hopefully get expedited after the case is finished.

    He still has to send the new paper work application in, but is waiting for our passport pictures to arrive - sent by air sure in November, and again in December :(

    I was advised you can fly over on a tourist visa and apply for a re adjustment over there and just stay????

    This sounds too easy to me..... but is it something that is doable?

  4. Wow. What an unfortunate delay. And how can your fiance reply to an RFE from Iraq? There is a special military helpline within USCIS to assist soldiers who are deployed. I know I've seen a number posted for this before.

    So the USCIS have decided my other half needs to re sign the enclosed I 129F form, and post back from Iraq by the 13th of June. Even though they know the letter goes to his POA in Texas and they didn't enclose the form stated. STRESS!!!!!!!

  6. I have been a long time reader of this stie, and I really enjoyed and learned a lot from this site and fourm. I just wanted to say thanks to all the people that posted, and my made my life easier in this process. I finally got my approval for the K1 visa on April 22, 2011. The time frame was around five months. I was happy just like every one else. Five months is a long time to wait for something like this. It is really hard to wait that long for something has simple has a application also. But, I did get bad news when I called the NVC trying to find out if the paperwork arrived or not. I was told that it was in the building and had not been entered into the system. I called back today, and I was told that it was sent back to the USCIS for futher review. I was told to call the USCIS. USCIS told me that the application will be in "further review" for at least another 120 days(4 months). Both depts. would not tell me anything on why it was sent back or anything that was going on.

    I had read in a post here awhile back that something like this happened to someone before. I was hopping that he/she could expain what happened to them. Did it take at least four months? Why was it sent back? I did contact my US REP. today also. They said that his office will look into it and get back with me. We will have to see what happens. I am hopping that someone here can shed some light on this if this happened to them.

    This is putting a massive strain on me and my fiancee. I see no reason that something was wrong the application. We both have clean records,no prior applications, nothing that could be fraud, tons of evidence. I just dont understand this. They are dealing lives and emotions here. How can they go to approved then sorry your not. I am sitting here looking at approval letter wondering what went wrong. Sorry for the rant lol.

    I am going through the exact same. NOA2 received in April, after 7 months, then review of case. Very stressful. It first said u to 120, then 30 - but i now am waiting for the letter as to what extra evidence they need.

  7. You can call the Dept of State and ask if your petition was returned to USCIS and if so why. I sounds like that happened but I don't remember anybody reporting that before. Don't bother calling the embassy. They won't give you any real information and they charge a fee to talk to you.

    Report back what you find out because it sounds a bit odd and would be good to hear feedback on what happened.

    The USCIS emaile - a letter is out today for more evidence. On hold till then. SIGH.

  8. Our NOA2 was approved the on the 29th of Dec 2009. I didn't hear anything after that. It was like everything and everyone was on a break. Well after all this waiting on Feb 4 2010 according to my status case update the NVC sent our file back to the USCIS for futher review. I contacted USCIS. They told me they did not know that my petition was sent back to them,for me to contact the NVC. I contacted the NVC. They told me that the USCIS requested our petition back because something wasn't filled out right or correctly. The NVC says I have to wait 120 days to find out what is happening with our case. I don't know what to do or think. I'm at my wits end. Please if there is anyone who can shine light on my situation please respond. Has anyoe ever had this happen ? What does it mean when USCIS request a petition back before it even left the NVC?

  9. I called and had to call USCIS - as it is back with them for review. As I am the applicant they can't talk to me at all. She was nice and did say this was not unusual. So I now have to try and get contact with my other half - but he is deployed to Iraq just now, ahhhh. Hopefully he can call soon. Phew - just a worry.

    PS - I run a page on FB and one lady stated this happened to her a few times before the interview - but everything went fine. I am living in hope ;)

    Now we are just waiting to see what happens - we got the NOA2 in, approved, but then an email saying the USCIS were reviewing again. AHHH. Should all be fine though - PMA is the name of the game, otherwise we would go nuts ;)

    He has no parental rights, as she was born before 2006 - but obv he can take it too court - I just hope the courts agree with us. He is a loser - 42, no job, lives with his gran. I work, study and do everything myself - my SO is nearly a WO in the American Army, so fingers crossed.

    We recieved the I - 797 Notice of Action stating approval, forwarded to relevant Consulate. Then we recieved notification that 'a USCIS office received this case from the State Department with a request that we review it'.

    Does anyone know what this means? Will there be a hold up?

    London advised me that within a month they should have my file after we got the approval note through - will this still happen?

    Just stressing out as so much to do.
