  1. it doesnt matter when ur petition expired,as far u vent gotten an interview date

    She has to have a passport to get an interview date. The embassy always asks me for a passport

    number when I call to inquire about the petition.

  2. After several months of begging, we finally got the finality paperwork from the LCR to get Hanilyn's BC corrected. The process started in April 2010. We get all excited and rush to the NSO in Manila hoping to get a quick annotation. Nothing doing, nothing is quick in the PI. I have been told that certain expedition fees can be paid to get the process moving quicker; however, we have yet to find someone who can guarantee quick results. Maybe Hanilyn doesn't know how to negotiate, or we have just been getting roadblock after roadblock.

    Now we are told that we can get the updated BC on January 19th. We are hoping to rush to the DFA in Butuan to get the passport process started there since there is a three month wait for an appointment in Manila. Does anyone have any experience with the DFA in Butuan? How quick can we expect a passport from there if we apply on Jan 20th.

    Also, I will be back in Manila on Valentine's Day and staying at least until the 25th. Is it possible to get the passport in enough time to get a VISA interview while I am there. I really hope to bring Hanily back home with me in February. Am I hoping for too much? If so, does anyone have a suggested date on when we may be able to complete the process.

    Also, Our petition expired on December 12, 2011. I have emailed the embassy asking for an extension but have not had any response. Do I need to follow up with a Fax? That seemed to work the last time. I faxed a change of address and finally got the petition notification to my fiance.

    I hope someone can help provide answers.

  3. So, my only question to OP is now did you try to get passport with correct or incorrect spelling? If worse comes to worse could you try to get the incorrect one and just use 'affidavit of one and the same person' afterwards to prove you are really you. The other questions above are for others.

    I'm sorry to ask this stuff on your thread but we are in a very similar situation. However, I do have some advice from what I have learned. EVEN after you get the corrected Birth Certificate, you need to make sure NBI and possibly Cenomar is processed with both your REAL name and the ALIAS name you had incorrectly all these years. Because, if you don't you could get 'Administrative Review' after interview to delay your visa by weeks to months while they rerun your alias name under NBI. This is very important if you want smooth approval.

    We are trying to get a passport with her correct family name. All of her records are with the correct family name and not what is on the BC. The issue has to be resolved by the time we get to the embassy. I believe in doing things right the first time. I hate we were mis-informed by an attorney to which I would still have paid for the proper advice and help.

    Thanks for the advice on NBI and Cenomar, Hanilyn is trying to get these today.

    Has anyone ever heard of "Court Shopping"? We were told that having the Registrar try to repair the BC now would be "Court Shopping" and that it was illegal.

  4. Personally, I think that a pre-nup is a pre-planned failure of a marriage. Since I don't believe in divorce, I can't see doing the pre-nup. I do have a lot to loose, but if I felt that there was even a chance, I would rather not go through with the marriage in the first place. If you are looking for a business relationship, then form a partnership and become legal partners. If you are marrying someone because you love them and trust them, then love and trust them. However, this is only my opinion. Not sure if you were asking for opinions or just legal advice. It seems you are looking for both.

  5. I am sorry that this happened, but she should have gone directly to the Civil Registrar... last 2001, the congress submit a law for this... authorizing the civil registrar to take care of the correction of name... here is the link: http://www.bcphilippineslawyers.com/republic-act-no-9048/

    Prior to this law filipinos can correct our birth certificate only by going to court, which was a tedious process which approximately takes a year...

    I think the lawyer made a play to get money... SO SORRY....

    Thanks for the information, I have sent a notice to the attorney we hired with the assumption that she was ignorant of the law. I am wondering now if there is any law to prevent us from going to the Civil Registrar even though it is currently in the courts.

  6. When we started the process, my fiancee wasn't able to get a passport because of her last name and her father's last name having been misspelled. Both having Aninojon instead of what is needed and correct "Aninohon". We paid an attorney that said that she could get it corrected and that we should have her do it instead of going to the Civil Registrar.

    The court date was August 4 and we were told at that time that according to Philippine Law, we had to wait one month for the court order. That time has come and gone and now we have heard 40 days by the same attorney and 90 days by another attorney at the Justice Hall. I am not sure how long we should wait.

    The attorney that I paid the money to says that her job is complete, but we still don't have a corrected Birth Certificate or a court order. She even scolded my fiancee for asking about it.

    The Civil Registrar says they can fix it within 2-3 months but not since the matter has gone to court.

    The passport people won't issue the passport without a corrected BC and says it will be 30 days to get one once we have the right papers. Another agent says it can be expedited if we get a letter from the Embassy.

    I am not sure who to believe now. Anyone know how to help?

Sometimes I have connection issues once the call is transferred to the Philippines system. If it says "all circuits busy now....." I just wait and the call goes through within a minute most of the time.

  8. Maybe the easiest solution to the issue what I plan on doing. I will be the for the interview at the Embassy. Once the VISA is approved, I will purchase return tickets for the both of us. One Way ticket to the Philippines cost about $1200 at the moment. One-way from Philippines is about $800-$900. I am not wealthy and really don't have the funds to do this, but I am finding a way.

    Plus, I think the process for my fiancee will be so much easier if I am present with her through the process.

  9. You will only need a copy for the VISA. However, I wouldn't hurt to make sure that she already has a copy and that it is accurate. I would also make sure that she has a valid passport as this may take a while to get.

    My fiancee had problems with her Birth Certificate and we are having to pay an attorney to get this fixed in court before she can even get a passport.
