  1. Hey everyone! So here's the short version of my question. My husband arrived here July 2011 (fiance at the time, and came on a fiance visa). We got married in August 2011 and by the first week of September had filed the AOS,EAD, AP paperwork. We have gotten the EAD and AP approved and are still waiting on the AOS, but he should get the green card any day now (the case transferred to the California Service Center back in November=a good sign, i think). ANYWAYS, I just heard that he needs to register with the Italian Consulate in Detroit; is this true? He doesn't have his green card yet. Second question: We already got our tickets to fly back to Sardegna this coming July, does he need some kind of visa for this trip? Does the AP all he needs? We will only be going for 17 days and i want to do my best to make sure my husband wont be turned back home in customs!

Thanks, in advance to your responses.

  2. Just applied for a SSN and it was a breeze! After reading some horror stories on here, I was very glad to see that we were in and out of the SSA building in less than 30 minutes and should be getting the card in two weeks :)

Anyways, I was wondering if there are any other things that we should do before his I-94 and K-1 visa expires. Of course, getting married and applying for the AOS, EAD, and AP are on my list of things to do, but I just wanted to make sure there weren't any other little things I was missing. We will probably try to get his drivers license in a couple of weeks after we receive his SSN (I went in and talked to the BMV today and it seems pretty easy as long as my father and I sponsor his to prove his residency). But please let me know if there is anything else I need to be doing, like do i need to register our address with the USCIS or anything?

Thanks for your responses in advance :)

  3. I just received ANOTHER bill from my lawyer, so I have decided to continue this journey without legal help. I am hoping there are plenty of couples out there that are willing to give advice for our next step. My man is entering the country (FINALLY) with a K-1 fiance visa this Saturday!!! We are planning to get married in early August, and I was already looking ahead at all of the upcoming paperwork we will need to complete. I want to make sure I have everything clear- the next things we will need to do are:

1)AOS: I-485 (Application to Register Permanent Residence or Adjust Status), I-864 (affidavit of support), do we need 2 G-325A's filled out, one for my 'husband to be' and one for myself (US citizen), I-693, G-1145

    2)EAD: I-765, G-1145

    3)AP: I-131, G-1145

I panic a little when I think about doing this without a lawyer, but you guys seem really helpful, so I'm sure I will be fine. Lots of people do this without lawyers.

Our case is a normal one EXCEPT my fiance was found "inadmissible to the United States under section 212(a)(7)(A)(i)(I) of the INA, as an intended Immigrant without a valid Immigrant visa" back in September 2010. This had no effect on getting approved for our K1 visa, so I don't think we will have problems this time around either. It was a BIG misunderstanding and we have plenty of proof that shows we did not know we were doing anything wrong.

NOW, here's my BIG question. When I was looking through the AOS I-485, one of the questions (specifically part 3, #8) asks "Have you EVER been deported from the United States, or removed from the United States at government expense, excluded within the past year, or are you now in exclusion, deportation, removal, or recession proceedings?" I dont know what to put for this question. Technically, he wasn't deported, and the government did not have to pay anything for his return flight. He was just refused admission to the US. What do you guys think I should put for this, yes or no? If i need to put yes, once again, i have plenty of evidence/signatures saying we were innocent to the situation and it shouldnt be a problem.

    Thanks for the advice friends!

  4. Don't panic :) My case was a little strange as well. I personally never received anything from the NVC. We got our NOA2 on April 5th, then my lawyer got an email on April 14th saying that the NVC received an approved I-129F petition and that within a week it would be forwarded to the appropriate visa-issuing post where the interview will take place. The NVC did not require that anything be sent to them, just that it was basically going to touch at the NVC then sent straight to Naples. I then got an email from Naples on April 20th, saying they received our petition and they included a packet on what to do next.

I think that if I didn't have a lawyer, I probably wouldn't have even heard anything from the NVC at all. I think it just would have been sent straight to Naples.

  5. Hah! I liked your second comment there.

What I did (i'm the US citizen) was include my last 2 years of tax returns. 2010 I earned decently above the poverty line even tho I only have a job where I work 23 hours a week. I included my 2009 where I literally only made like 3,000 because I was still in college. For 2008 I didn't even file taxes because I made absolutely NOTHING lol...i didnt work that year. So, instead I included my parents 2008 taxes that showed proof that they filed with me as a dependent. I think if I were you, I would have your woman include her last three years of taxes even if she only made a little money. Then FOR SURE include her mother taxes (all three years, filed jointly) I dont think you would have to list her father as a co sponsor (but i'm not a lawyer). For a time, i was considering listing my father as a co sponsor before my lawyer assured me that I would be fine having just my 2010 being above poverty line. I wasn't going to fill out more paperwork to have my mother listed also, if that helps.

  6. Hey everyone! My man just had his K1 visa interview today and everything went well :) I was just wanting to make sure I knew of everything he is going to need at his port of entry (detroit) I know he obviously will need the visa and sealed medical envelope and he'll be bringing his huge binder of 'our relationship/all forms from the past'. What else will he need?

ps. do you guys think it will be easy enough to do the AOS without a lawyer? My lawyer just tagged on an additional $700 bogus fee that came out of no where. I've already spent well over $3000 and its getting/has already gotten ridiculous.

    Thanks, ahead of time~!

  7. Hey guys, I was just going over the final things with my fiance before his interview on this coming wednesday. Do we need to fill out anything on the Medical exam paperwork? or is that all for the doctor to fill out? When in doubt i just do one of each, lol...have him fill out the top section on the first page and take a couple extra blank copies. I'm sure someone out there knows the answer to this question.....quick responses are appreciated due to the fact that the interview is on WEDNESDAY!!! AHHHHHHHHHHHHHH! Its finally here!

  8. Hey there.....for my case, I filed K-1 fiance visa, it just touched at the NVC. Nothing was requested from me, when it normally is, and my petition was sent straight over to the Consulate in Naples, Italy. They were the ones that requested all of the documents, not the NVC (in my case). I'm pretty sure that is not how it is for all cases, but if it makes you feel better,it sounds like your situation may be similar to mine. Not to mention, everything went smoothly and our interview is scheduled for June 22nd.

  9. Ooh good to know about the link within the email. My fiance hasn't translated it for me yet lol....but i'll tell him to get on it. I try to help him out as much as I can from America; there's only so much I can do from here, lol.

Thanks everyone!!!! hope all of your journeys are going well!

  10. I was wondering exactly what I should be expecting from the packet four. We have the interview scheduled and received a confirmation email a couple of hours later, but i'm assuming that is not the packet four. When should I expect to get it? I know its different for everyone, but just wondering if there are any italian/american couples out there that did the k1 fiance visa and have a better idea of what i should expect/already have.
