    " On December 28, 2011, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location."

    Does national benefits center means that my case was transfered?

    I received an RFE and after they received my response, a couple of days later the papers were transferred to the National Benefits Center. All documents are sent to that location. By the way, we receive the EAD card today. Still waiting for an update for the GC.

    I re-sent all the RFE again yesterday, all the same documents i sent on tuesday, plus a leter explaning the situation....

    The first package is suppost to arrive there today, the other one with the letter just on tuesday... I'm really hoping to hear something before dec 31... Im not asking too much, just one good new before new years eve, to celebrate!!! 

    You sent you RFE already??? If so, did u hear anything back already???

    Good luck for us... It seems that we are the only one's in this nightmare! 

    I think you are going to hear something from them tomorrow Friday (Dec 23) or Tuesday (Dec 7th) the latest. By next week they should transfer your case. I really think that by the middle of January you should have in your hand your GC and EAD card. Unless, they ask for more evidence. Hopefully they won't ask

    I send the RFE on Dec. 8th and on Dec. 12th received an e-mail saying that they got it. Then on Dec. 16th it was transfer to an office in California Service Center "to speed up the process"...Check my timeline:

  4. I just checked my I-485 status online and there's an RFE. :(

    I think I may know what it is. My I-765(EAD) case number still says case not found.

    Question: If there's an RFE on my I-485 application then it shouldn't also hold up my EAD process, right? I've been waiting almost three months already.

    I think they don't touch the i-765 until they have everything they need, even for the I-485- is all together.

    They didn't touch the I-765 until they received the RFE for the I-485. Now my status says: EAD is in production.

    The october letter they sent me this week was a copy of the original, that they 'supposedly' sent on oct 18...

    Ahhhh....that's sucks! I know that it has been a waste of time not knowing that you had an RFE [i also got an RFE on Dec 1st when I sent the AOS package in Sept. 15th]. But at least you are still inside the 87 days they give you to reply.

    I know you already send what they need it. I would of also send a well-written letter telling them that I never received the first RFE in the mail or e-mail.

    I know what you are going thru about spending Christmas without family. We have the same story.

    Hi, I can't believe this things happen.

    I have a question: Is there a stamp outside the letter with the date that it was received by the Post Office? Check...that will confirm to you when was received by the post office. Hopefully it will say Dec. If it says that, you have prove that they made a mistake on mailing it late.

    HOwever, if it says Oct, you can go to the Post Office and speak to the Postmaster and tell him or her that you just received this in the mail and you were suppose to get it way early because of the stamp and the date on the letter. You can also ask the postmaster to write you a letter for you to send USCIS explaining that the letter was drop late to your address.

  7. Thats not true as mine got delivered without my name being on the mail box.

    Sorry but you are completely wrong. I'm a letter carrier for USPS for 15 years in New Jersey and the RULES are if the name is not on the mailbox we don't deliver the mail. Anyone can ask that to any mailman and they will tell you that they cannot deliver any mail if your name is not posted. Specially when is something very important like a check, immigration papers, court notices, and so on. The mail that doesn't get deliver and we send it back as UNKNOWN so EVERYONE PLEASE MAKE SURE YOUR NAME IS ON YOUR MAILBOX BECAUSE YOUR MAIL WON'T GET DELIVER. As letter carriers we have the power to send it back UNKNOWN...if you still in doubt you can ask any carrier.

    For Sean86 I believe you have a letter carrier who didn't follow the rules and risk delivering a very important piece of mail in a mailbox with no names.

    However, if you live in a one family house, you have 50 percent chance your mail will get deliver to a mailbox with no name. But if you live in a building you'll have ZERO percent chance to get your mail delivered to a mailbox with no name unless you have an irresponsible carrier. If you don't have your name on the mailbox and you are friends with your regular carrier don't think that you will be fine. Because what if on that specific day that you are getting your GC or EAD your carrier calls in sick and someone else is on that route that day...he or she will send it back UNKNOWN because your name is not on your box and he or she doesn't know who you are...I'm letting you know because I've done it. I have send back immigration papers.

    I wish USCIS would mail to PO Box but they really want to make sure you live in the address provided.

  8. Believe it or not.. My K1 visa had been approved since July and I have been here for 2 and half months and I am now in my AOS journey already. But, my K1 visa status still show "initial review". Lolz... :D

    We are in the same boat. My AOS K2 Visa journey started in September, already did Biometrics and on web site still says "initial review" from the date we applied...no updates, nothing. Let's hang in there, I know we will get some news pretty soon.

  9. No news for me either. No text/No emails/No actual mail/No Updates on web site...nothing :-( But I do believe will get the EAD card before the end of the year. But for the people that are waiting for interviews, hopefully you will get interviewed before USCIS goes on vacation for the holidays. We just need patience.

  10. Twenty2--just hang in there . We did our Biometrics 2 days after yours and we were approved and received the Combo Card (EAD /AP )in the mail today . You will hear something soon . Keep us updated .

    Thank you so much!! Hopefully this week or the next I get something in the mail. Right now I'm taking extra care of my mailbox key because if I lose it I'll would go nuts. I'm glad I work during the day because if I would be at home I'll be stalking my letter carrier....hahahahahaha

  11. ahhh ok. Ugh, yeah I really do hope I get it in the mail this week. Bad thing is I don't think they worked Friday, nor Saturday , nor Sunday, so those 3 days are lost. I want to work already. Thank goodness I applied for the EAD though, I was about to not do it.

    Hello everyone and limenaluv91,

    I just want to say thank you for continuing posting your personal updates on you AOS journey. I have been following everyone since I'm also a September filer but haven't logged in to comment. - I know, I should of done it - But I have been feeding everyone's good energy and also hope we finish this waiting game before Christmas and New Year's. I'm posting Two Timelines. The firs was for the K-1 Visa and the second one is for K-2 Visa.

    The K-1 process went smooth 76 Days and we were done. Now we are in the process of the K-2 Visa and the waiting is killing me since there is no Updates on the USCIS website since they received the package. But I know that they are not that good at updating their website. So, I'm keeping my thoughts positive. However, the only thing that bothers me is that maybe because of the redesign of the EAD card that started on October 30th is going to make the wait longer since this is going to be a new process for them. I just hope it doesn't affect the waiting time.

  12. Hello!

    I am new to this site and am looking forward to starting this journey with the help of all you! :)

    I had a couple of questions I was hoping to get some help on.

    My situation: I am currently a senior at college and will graduate this May and my fiancee lives in El Salvador. I have been offered a job position starting in September and will be making somewhere between $35-45,000. My plan was to get married this summer before I started my job and then start the CR1 filing process for my soon-to-be husband in October/November( it seems this one is the least expensive and will allow him to work when he gets here). I am hoping this will mean he will be here by next September.

    The problems that I'm seeing now is that because I am in college right now, I have only been working part-time so my past tax returns do not meet the required income level. By the time that I file and my husband by then will have his interview I will only have been working a couple of months. Even if I do have a chance to file, it will not include a whole year of my pay stubs, so I will probably still be below the requirement. I know that the El Salvador embassy seems to be a real stickler about this and I am worried that I will be denied because of this. Will the fact that all 3 years of my income taxes do not prove that I am above the poverty line weigh more than my current income?

    SECOND (I know I have a lot of problems) but one of the questions on the form asks if my "foreign relative" has ever been in the United States. My man came to the US undocumented a couple years ago and then returned for family reasons. He got a Salvadoran passport while in the US and then flew back to El Salvador. Will this hurt our chances?? Do I have to report it? I'm assuming I do and if so how would I exactly word this???

    THANK YOU SO MUCH FOR YOUR HELP! I havent even started the process and its completely overwhelming.

    First, is your fiancee is in El Salvador? If he is, then I suggest that you should file a I-129F/K1 Visa (Fiancee petition). So, he will be able to travel to the US and marry you here.

    But if he is in the US, you should file I-130 after you marry him in El Salvador or here if he is living here illegally.

    For the Affidavit of Support, if your tax return and your current income its below the poverty line. Then you can get somebody to sponsor him. This is legal. But you need the other person to offer his or her information: tax return, pay stubs and prove of employment. I know this is very sensitive and hard to find someone who is willing to do this. Maybe a family member can do it.

    Since he got his Salvadorean passport in the US (while he didn't have papers)- they definitely know he was here at some point then you should mention it.

    "See Attachment (Address #1)" with time period listed

    "See Attachment (Address #2)" with time period listed

    and for the addresses outside the United States for more than 1 year

    "Same as Address #1 (attached)" with everything else blank

    You cannot just attach a piece a paper saying "See Attachement". You MUST follow their FORMTA INSTRUCTIONS.

    IF EXTRA SPACE IS NEEDED TO COMPLETE ANY ITEM ATTACH A CONTINUATION SHEET, INDICATE THE ITEM NUMBER, AND DATE AND SIGN EACH SHEET

    for example: you would write on the top right hand side:

I have a question with regards to my I-94 so in this small piece of paper that was left with me that they attached to my passport on my port of entry here in Seattle, it has my fiancee's information on it like Name, Last name, birth of date, and his citizenship. Is this really what it should looks like? I put all my information on the other half of this paper that the police officers in the airport took when I got here. They checked this piece of I-94 x3 and never said anything about this like if there I didn't do it right. Now I'm worried cause my friend is saying that it should be my name that should be in this piece of paper. If she is right, is there anyone that I can talk with to make this thing right? it's causing me anxiety right now, cause I'm confident that I did the right thing cause no one at the airport asked me to repeat the form. Pls...I need help!!!!!!!!!!!!!!!!

    When I petition for my fiancee and I don't remember seeing my information on his I94. However, if you do have a mistake it can easily be corrected. At no Fee. No money. Nothing. You only need to go to USCIS.gov and fill out the Form I-102 and make a photocopy of your I-94. Send everything together at no cost. And they will corrected. But it might take a couple of weeks.

    In the same web site on the Form I-102 you can read the instructions too on how to fill it out. And you can also confirm that you don't need to pay because it was their mistake. You would only need to pay if you damage or lose your I-94 which is what happened to my fiancee.
