  1. Could be many reasons. Maybe they are having technical issues at the office, short on staff etc. There were a lot of cancelations like this in winter due to snow. I wouldn't worry about it, I'm sure they will send you a new appointment letter soon but most likely scheduled later than original appointment date.

    Ok, but it's one month away. I understand if they canceled 1 week before the interview. Maybe they found something they didn't like

  2. Our interview, was scheduled in a month, but we just received a letter from USCIS saying;

    "This is to advise you that due to unforeseen circumstances we have canceled the previously scheduled interview on ... We regret any inconvenience this may cause. You will be notified of any further action taken on this case, including rescheduled interview information, under separate notice."

    Any idea, why they canceled our interview?

  4. I am still here with you guys who have not received a response. My wife's was receive in Chicago on April 4, so far no reply. no emails, no texts , no check cashing. Please continue to pray with me. I hope I have an answer soon. Anyone who has experienced this, what number did you call. Or can I email chicago directly. Does anyone know?

    Wow that's been more then a months. Way too long.

    Call (800)375-5283 and press 112111 (short cut to speak to the operator). Tell operator it's been over a month since you send it and they will transfer you to immigration officer.

  5. It's been more than 30days since I filed my AOS!!

    I called USCIS and they said "Your case is just put into the system TODAY"

    Seriously? After 30days? They just opened my packet? lol

    And they also told me I will hear something by May 11th. I don't know why but 11th hahaha.

    So April filers who has been wating for longer than everyone else, don't worry too much! You will have your turn soon.

    Did they cash your check today?

    It will come.. I think its probably because your situation is a little more complicated given your lawyer's error, but I don't see why they wouldn't be able to sort it out. Maybe you can try calling and sorting it out with a USCIS officer on the phone? Goodluck and keep us updated :)

    Call USCIS at (800)375-5283 then press 112111. This shortcut will let you speak to the operator.

    Operator will read you some templated script, but tell them you need to speak to immigration officer. Tell them it's been over a month since you sent your package ((they have no way of known since you have no receipt). Keep asking to speak to the officer until they transfer you. They will not transfer to immigration officer unless you tell them it's been over one months . Once officer picks up the phone and start punching your name into their main system, they have all the information you need.

    Thank you. She did compensate me for that with a release letter she asked me sign (I guess she does want to protect herself from being sued). At this point I just want to get things moving. It's a simple process, which I should have done it myself from the start.

  9. Hello everyone. We submitted AOS back in March, but our attorney screwed up our paperwork royally. Instead of I-130, she sent I-129F (no sure what she was smoking when she decided to send this form). Our whole package returned, along with un-cashed checks, except medicals, passport photos and prove of ongoing relationship. We fired our attorney, resent correct forms on April 14th, USCIS received and signed for it on April 15. A few days letter we received a notice from USCIS that our I-129F was accepted (strange, we didn't pay for it) and it's in process. We sent them a letter asking them to withdraw I-129F. Hopefully they will transfer our medicals and the rest of the stuff from I-129F to I-130 and I-485.

    So far our checks were not cashed and no NOA1. What a mess!!!

  10. I haven't yet been able to figure out the logic that drives USCIS to sometimes return a petition package and other times send an RFE. The Adjudicators Field Manual strongly coerces them to issue an RFE rather than reject a petition if a question of eligibility can be answered with further evidence or documentation. They're really not supposed to reject a petition package unless there is an obvious ineligibility, and additional documentation or evidence wouldn't change that. Even so, they still sometimes return petition packages for lack of a single document, and other times accept a petition that is obviously missing multiple required documents. Maybe we can chalk that up to the fact that there are humans processing these petitions.

    There is at least one VJ member who had sent only an I-129F, and subsequently sent the rest of the required documents without first receiving an RFE, and their I-129F was approved, which would strongly suggest their additional documents were joined up with the original petition. While that member may recommend you go ahead and send your additional documents, there are a lot of other VJ members who have seen the additional documents they sent apparently vanish, and they got an RFE anyway.

    You can try to send the additional documents, if you wish. Just be prepared for the possibility (probability??) that your documents will never join up with your petition, and you may end up getting an RFE anyway. If you do decide to go ahead and send your documents then be sure to include a copy of the NOA1 receipt notice for the petition.

    You could also just wait for the RFE. If you send your documents with the RFE notice then you know that your documents will be joined up with your petition. If you respond to an RFE quickly it usually won't add more than a couple of weeks to your processing time.

  11. You can get more passport photos. You should have sent copies of your relationship evidence and not originals. You can produce new copies.

    The medical is a problem. That's a sealed envelope from the civil surgeon, so only the original could have been sent. I suggest you talk to the civil surgeon and see if they'll produce a new signed I-693 for you. They should have copies in their files to refer to.

    This is not the problem. What do we do now? Wait for the REF or send all those documents with explanation letter? Immigration officer told us to wait, but if we wait they will either return the package again or it will take them a long time to respond with REF.

  12. Withdraw the I-129F. They should have assigned a case number on the acceptance notice. Write a letter, include the case number, and explain that the I-129F was submitted in error and you've since submitted an I-130, and tell them you are withdrawing the I-129F.

    Yes, I am about to do that.What is really messed up is that when they sent everything back they didn't return my medical exams, proof of ongoing relationship and passport photos. I thought I don't need to resent all this stuff again, just send them correct paperwork, but once I received notice of I-129F (after I sent them correct documents) I realized that they took that for this I-129F. So what now? I already sent my I-130, I-485 and etc without medical exams, proof of ongoing relationship and passport photos. They probably going to reject my case again or ask for additional information. This is so frustrating.
