    Everyone can help me to help one friend of my?...Please. She get here with B2 visa on Julho 2009 and is expired all ready. She got married with a green card holder on junho 2010. Now she wants to apply for her green card or visa whatever...what she should do to do this ? Which forms she has to fill out to send to immigration? Also she does have a Tax ID but not a social security.

  2. Since you didn't have the intention to get married and stay when you came to the U.S. you are fine to stay now and file.

    You don't need to prove that you didn't have the intention and you even if they thought you did they wouldn't deny you if there are no other adverse factors in your case.

    And you cannot leave the county until the AOS is completed or you have advance parole approved.

  3. Their age might indeed be an advantage. I do believe most IOs think that a person in his/her 60s in not going to start over again in another country where he has never been, doesn't speak the language etc. Therefore it's easier for older people to get tourist visas.

    My wifes family from Colombia applied to come to our wedding. Her grandma, she is in her late 60s, got the visa with absolutely no questions asked! She didn't even have a bank account. Her aunt which is a doctor, owns numerous properties, etc got the visa too but was given a really hard time. Sadly, my wifes mother who is unmarried, middle class job, owns a small condo was denied and couldn't attend our wedding.

    You just never know.

  4. Went to the biometrics appt today finally,the people at the New Orleans office were very helpful.Then I got home and my case was updated to

    card production ordered,I've never heard anybody saying that you could get the card ordered in the same day as the bio appt,I guess they try to make it up

    for the super slow start.

    happy that I'll drive again soon.

    Same here, we finally had the bio appointment last Monday, same day Card production ordered.

    We already received the card yesterday (7 days after appointment!) :) Now waiting for the interview letter.

    My Colombian wife and I just got married here in the States and will be filing for AOS soon.

    In the meantime my wife also wants to change her last name to mine. We have been trying to get an answer from the Colombian Embassy in Miami if we could go there with our Florida marriage license and change the name in her passport but it seems impossible to get an answer by email or phone.

    I was wondering if anyone here is from Colombia and has done that?

  6. I'm USC and just got married. My wife is from Colombia and came here on a J-1 visa (not subject to 2year rule).

    We are gathering the docs to file for AOS.

    Right now we are unsure how to handle the name change. My wife will take my last name, so I assume we need to file all immigration documents with the new name. However she has no photo ID showing this last name. The DMV in Florida will not issue a new drivers license with the new name without seing immigration docs with that name. So I guess we need to wait until we have some docs from USCIS before she can get a new DL.

    I assume we could go to the embassy of her country to update her passport so she would at least have one ID showing that name? Also for the purpose that we already changed her name on bank accounts and credit card and of course this might cause problems without matching photo ID. Any advise on this?

    correct, no home requirement. And of course she had the best intentions (to be an au-pair and return to her home country) when she got the J-1.

    On a different note, her aunt and grandmother also applied for the visitor visa a week earlier. They both got it.

    They also told the embassy that they were going for the wedding, however I believe they didn't go into any detail on my fiances status in the States. That might have made the difference. Also the grandmom was given "special treatment" due to her age.

  8. I'm a USC, my fiance is from Colombia and currently in the U.S. on a J-1 aupair visa.

    The original visa was issued Jan 2010 and expired Jan 2011. In Jan she received a one 1 year extension so she is good until 2012.

    We are getting married in less than 3 weeks here in Florida. Of course it is very important for my fiance for her family especially her mother to be here for the wedding.

    We had her mother apply at the embassy in Bogota for the tourist visa. She was very well prepared with wedding invitation, proof of ties to Colombia, even a letter from our lawyer here in the States for her support.

    She did not get a chance to show any of her papers because as soon as the consular officer heard that she was in the U.S. as an au pair he denied the application.

    It breaks our heart not having her here on our big wedding day. Does anyone have any idea if we could appeal this or if it makes any sense to apply again? The wedding is in less than 3 weeks.
