  1. Hello my fellow frustrated Americans and soon to be Americans,

    I'm filling out my I-130 petition for my husband and have a question. See, he is from Scotland, so do I put Scotland or United Kingdom on the I-130 for his country of residence? Typically, I would put United Kingdom (even though he cringes at the thought of that) but when we got married the county clerk made us put Scotland and not United Kingdom on his application for our marriage license. I'm not sure if this makes that much of a difference, but I'd rather be safe than sorry. Also, I contacted USCIS and they refused to give me any advice. Jeeze Louise, it's not like I was asking some complicated question. Any advice is much appreciated! Thanks!

    I'm looking for advice and I know that there is somebody out there who has been in my situation before. I guess I should start with a brief history. I'm from the United States and moved to Scotland last year to study for my Master's degree. While I was there I met my husband, who is a British citizen. After a year and a half of dating, I graduated and had to move back to the United States. We did the whole long distance thing and then he came out to visit me. While he was here he proposed and us being us, decided to go and elope. After we eloped, he had to go back to the UK and we are now starting our visa process. We have decided to forego the K3 visa and apply for the CR1 visa because we would rather get all of the legal stuff taken care of at once. The only thing that I am worried about is the I-864 Affidavit of Support. After moving back to the states I was hired for a position making $28,000 per year. Therefore, according to immigration laws, I am financially able to support my husband. The problem here is that I haven't been making this amount of money for longer than three months, so any tax returns that I submit will show my measly student wages, which were drastically lower than what I am making now. Because of this, should I find a cosponsor to ensure that my husband's visa is approved or should I just use my current income and request a letter from my employer to help explain my current position and income? I'm really at a loss right now and any assistance will be much appreciated!
