  1. I am applying US citizenship. filing N400.

    here is my background info:

     

    I came to US in 1992 with family. After i finished college and worked for a while, I left US and went back to Hong Kong in 2002.

     

    I kept coming back to US every 5~6 months to keep my green card.

    I came to US to settle down in 2019. I am still holding a green card. I have been working as software engineer till now.

    I bought a house in California in 2021.

     

    I married in Hong kong in 2012. have 2 kids. 10 and 7 years old. 

    Then i came to US in 5/2019, and my sister has been supporting my wife and kids financially since I left Hong Kong

    I always go back to see them 3 times a year.

     

    I am eligible to apply for citizenship.

     

    but I divorced in Hong Kong and got a court order in 3/2024.

     

    When I filed N400, it requires me to show court order and show that i am financially supporting my ex-wife and kids. I haven't sent them any money. So i will start wire-transferring $5000 every 2 months, starting form June 1, 2024.

     

    I will file N400 again in Feb 2025. this way i will have some transaction record to show USCIS.

     

    my court order only announced we are divorced, but it doesn't the detail of alimony. We didn't include this when we filed divorce because we trust each other. And my sister is willing to help.

     

    my question is:

     

    1) do you think the transactions record from 6/1/2024 till 2/2/2025 enough to show that i am supporting my family. There will be 6 transactions (6/1, 8/1, 10/1, 12/1, 2/1/2025)

    2) my court order only announced that we are divorced, but didn't include detail of alimony. so is it ok if I show this transactions record?

  2. I can't submit inquiry. It said it is still under normal processing time.

     

    Yes I plan to naturalize. I had green card in 1992, but i left US in 2002. Then i came back to US in 05/2019. So I can apply for naturalization in 5/2025, which is a few months away...

     

    I have NOT moved since i filed I-90.

     

     

  3. My green card expired in 3/2023, I filed I-90 to renew in 10/2022 in USCIS's website

     

    until now I still haven't received my new green card. Instead they gave me a letter I-797, it said it extends my green card for 24 months...

     

    But still.... I has been over 450 days since I filed I-90.

     

    USCIS website shows that process time of green card 10 year renewal is about 9 months... and replacing green card is 28.5 months

     

    I called USCIS, the automated message just read out the status on USCIS's webpage... It is impossible to talk to agent thru the USCIS contact center. 

     

    If i say "talk to agent", the robot will say "if you insist to talk agent, I will have to release the call"

     

    So what can I do? is anyone waiting that long?

     

     

  4. I filed I-130 for my children a while ago. but no decision yet. USCIS website said "6 months until case decision"

     

    In the petition i uploaded the marriage certificate. I filed the petition in July 2022.

     

    I married my wife in Hong Kong in 2012.

     

    But i divorced with her today. The divorce is still in process, and the marriage certificate became invalid. HK government took back the marriage certificate.

     

    So does my divorce affect my I-130 petitions for my children? because i provided marriage certificate, but it became invalid.

     

    What should i do? Do i need to call USCIS? or provide other document?

     

     

  5. Hi, I am filling up I130 for my wife, She is in Hong Kong, I am a permanent resident living in US.

     

    In the last section of the online form, it said:

     

    If a required document is unavailable, you must provide a typed or printed explanation of the reasons that document is unavailable and submit secondary evidence to establish eligibility. Secondary evidence must overcome the unavailability of the required documents. USCIS may request an original typed or printed statement from the appropriate government or other legal authority to support your claim that the documents are unavailable.

    The following types of secondary evidence may be submitted to establish eligibility:

    • Religious record
    • School records
    • Census records
    • Written statements

     

    But my wife doesn't have any of these records. She is not into any religion, she is a house wife and not going to any school. She has no census records. And written statement is Affidavits which can be written by someone.

     

    My question is.. Is it ok if I skip all these secondary evidence? 

     

    I have provided the important documents such as marriage certificate, children's birth certificate, bank statements with both of our names, images of my green card and her passport, I130A etc...

     

     

  6. My kids are 6 and 9 years old. They got the birth certificate sone after they were born. So we have the birth certificates for several years

     

    I just moved to my new house for over a year. Census data is collected every 10 years. and I have never received any census forms in mail. so I have no census record.

     

    for DNA test results. USCIS said:

     

    If other forms of evidence have proven inconclusive, the petitioner may submit on a voluntary basis other evidence of a birth parent and birth child relationship to include deoxyribonucleic acid (DNA) testing. DNA test results will only be accepted by USCIS from parentage-testing laboratories accredited by the American Association of Blood Banks (AABB). A list of laboratories can be viewed at www.aabb.org/sa/facilities/Pages/RTestAccrFac.aspx.

     

    so it sounds like my kid's birth certificate is good enough...

     

    So do you think i can skip the census record and DNA test?

     

     

  7. My kid is currently 5 years old. she is in Hong Kong. I am holding a green card, and I am working in the US. 

    I am wondering how long it takes to bring her to the US. Let's say I file it I-130 today, and wait till she can come to US with a F2A visa, how many years do I need to wait? 

    Some say 3~4 years, some say 1~2 years...
     
    Also, after the interview, how long does it take to get the F2A visa? assuming the interview is successful
  8. Hi. I am a US resident (holding green card). my wife and my first kid is in Hong Kong. Wife and 1st kid are Hong Kong citizens.
    I am planning to have a 2nd kid. this is my plan: my wife comes to US to deliver the baby and the baby becomes a US citizen. My wife will apply tour visa to come to US.
    my question is:
    after my wife and baby goes back to Hong Kong. I will file the petition I-130 to apply my family to come to US, it will take 3~4 years. my 2nd kid will be a US citizen, but my wife and 1st kid are HK citizens. is there anyway my wife and first kid come to US? we don't want to be separate for 3~4 years.
    please don’t suggest me to become US citizen. I left US for over 1 year, and now it takes me 4 or 5 years to become US citizen. I am working in US now, and I go back to HK to visit them several times a year.

  9. I am living in HK. i am holding green card. I am wondering... if I file I-130 to apply for my wife and two kids, is it difficult?

    I know that when I go back to US, i will need to get a job first and show that I can financially support my family.

    Do they require me the make certain amount of money for supporting 3 family members?

    let's say i make 85K a year, what is the chance to getting my petition approved?

    Any advice is appreciated.

  10. I am holding a green card (not conditional green card)... I am staying in Hong Kong with my wife...

    she is pregnant now. My kid will be bornt in Sept 2013...

    I need to spend time with them in Hong kong for about 2 years.. meanwhile, i will fly back to US every 5 months to keep my green card...

    I plan to file I-130 to apply residence for my wife and kid. i know it takes 3~5 years, i will come back to US by myself 2 years later and start working in the US....

    my question is .... can i start filing I-130 in HK now? should I do it while I am in HK, or do it in US 2 years later?

    I can't apply for citizenship now because i haven't been in US for 5 years... so this is not an option.

    any advice will be appreciated.

    the expiration date of my green card is mid-june, 2012...

    In June 2012, I filed I-90 to renew my green card... due to family matters in my home country, i was thinking of abandoning my green card, so I wrote a letter to withdraw the application....

    but my family matters was solved, and i changed my mind, so I paid another $450 to file I-90 to renew green card again in Dec 2012...

    I received the form I-797, the notice of action from USCIS a few days later, then USCIS should send me the appointment notice for taking biometric within 30 days... but till now (Feb 7th 2013), it has been one month and 3 weeks… i haven't received the appointment notice... I called USCIS many times, but they just told me to keep waiting...

    right now I am in HK... i left US at the end of August 2012, I need to come back to US by the end of Feb 2013...

    my question is

    1) what happened to my application? USCIS never sends me the appointment notice for taking biometric...

    2) USCIS and US embassy told me i can come back to US with the expired green card and the form I-797. but is there any chance the customs don't let me in and send me back?

    3) is there any chance my application will be denied because i withdrew my previous application?

  12. hi, I am planning to come to US to study graduate school...

    I have these questions:

    1) I have wife and one kid. Lets say i got accepted by some school in US and got my I-20, when i apply for F-1 visa, can I also apply F-2 visa for my wife and kid?

    2) when i apply both F-1 and F-2 visa, would US embassy thinks that I am an intention to immigrate and deny my application?

    3) if i apply F-1 for myself, and my family stays in Hong Kong... after i graduate and luckily I get a job, I will get a H1-B visa, can they apply for a H2 visa? if it hard to apply?

  13. Hi, I have a problem in renewing my green card...

    It expires in June 2012... i am currently living in Hong Kong.

    i filed I-90 to renew it on Dec 16th, 2012... i am expecting to get the letter from USCIS about the appointment of taking biometric...

    but till now, i haven't received it from them... i am using my Aunt's address in US... She received a letter from USCIS that confirms they started the renewal process...

    I am waiting to fly back to US to renew the card, and stay in US for good... i left US at the end of August 2012... i need to get back to US by Feb 27th 2013 because i can't be away from US for more than 6 months...

    I called USCIS a few days ago and told them the situation... and they gave me a referral number...

    she said i should receive the letter with 15 days...

    So my question is .... would there be any problem in my renewal? i know that they should send out the appointment letter in 2 weeks... in my case, nothing...

    and she gave me a referral number... what do they do after they generate this number?

    also, should i fly back to US anyway even I haven't received the appointment letter? i know i can enter US with my expired green card and first letter i received(Notice of Action I-797)

    any help or advice is appreciated.

  14. Hi all, this is my situation...

    i have been holding my green card(not conditional green card) for 20 years... I left US in 2002 and flew back to HK, then i keep flying back to US every 6 months, stay in US a few days, and then fly back to HK...

    i have been doing this in order to keep my green card from 2002 till now...

    in 2006, i got re-entry permit and left US for 1.5 years...

    I am planning to come back to US for good and naturalize now...

    I know that in order for me to naturalize, i need to stay in US for 2.5 years in the 5 years before I file I-400...

    i guess i am not eligible to naturalize now... after i move back to US this time, how long should I stay in US to naturalize? 2.5 years? 5 years?

    Just wanna confirm. Your help is appreciated.

  15. i am holding green card(not conditional green card) for over 10 years. I would like to file I-130 for my wife in china.

    does anyone know how long it takes for my wife and kid to come to US?

    i checked www.uscis.gov. it said it would take 6 months to 24 months... depends on which center (TX, CA, Nebraska etc...)

    i have talked to some people, they told me it could take 4~5 years...

    if anyone has done this before, please tell me how long it really takes.

    while we are waiting for I-130 to be approved, is there any way she can come visit me? can she apply B-2 visa? i am afraid US embassy won't approve B-2 visa because her husband is an US resident...
