  1. No. You don't need anything from the father even if his name is listed on the BC and even if the child is using his surname. Illegitimate children in the Philippines are under full and sole custody of the mothers.

    If the fathers name is on the birth certificate, then the child is not illegitimate...right? Unless you mean illegitimate becuase the parents were never married.

    Not saying you will have a hard time SirMike, I would continue to research and be prepared though, cause I know people have had problems in the past.

  2. I am preparing to file a k1 & k2 visa at the same time. My fiance was never married to the father of her son and the father has abandon them , although he lives close by but never sees or supports the child for over 2 years. Do I need to have the father sign any form to allow the child to travel to usa?

    Depends. If he is listed as the father on the child's birth certificate, then you may have to get his permission for the child to leave the country. If he is not listed as the father, and therefore the child is carrying his mother's maden name, then should not be a problem getting K2 and him travelling out of the country with his mother.

    If I may ask, did u change your daughter's lastname too later on?

    You would need some type of court order to change your son's name to your husband's surname. Typically this would be done through adoption.

    If your husband adopts your son, then he would be eligable for citizenship, so the issue with the last name on the greencard would not exist.

    I have not adopted my stepdaughter yet, but we are trying to do this in 2015. They just recieved their 10 year cards a couple of months ago.

    No need to do that. File your son's AOS in his legal name, that matches his birth certicate (your maiden name in this case).

    Also, just to clarify if we will be filing AOS,ead and ap for me and k2 there wont be any fee for ead and ap am i right?

    That's correct. No fee for EAD or AP when filed with AOS.

    My husband called.uscis and the personnel states that there is a separate fee, that's why im confused.

    Seperate fee for EAD and AP, if not filed with/while your AOS is processing.

    We had no problems processing my daughters's (stepdaughter) AOS/EAD/AP using her given surmane which was also my wife's maiden name.

  5. If her passport has the data chip in the cover, the embassy cannot amend it. They have no means to amend the data on the chip. I beleive it's the brown passport that has the chip.

    If you want to change her name on the PP, she will have to do a report of marriage to the Philippines, then renew her passport. She can do this at the embassy in Washington or through a consulate outreach program (may be able to do the ROM online).

    You may as well keep the PP as long as possible. No need spending the money. But it's better to do the report of marriage first anyway.

    This is what my wife and I did for her. In 2012 we travelled to washington and did the ROM and renewed my stepdaughters PP. Then, just this year, we registerred and attended the outreach to get her a new PP with married name.

    Edit: Oh, and they did not change her passport number.

  7. We had the same situation with my stepdaughter. You will need to use his birth name (his mothers maiden name) throughout the process, including SS Card until you legally adopt him, or get some other court order changing his name. We had no problems doing this for AOS or ROC.

    I would suggest you get your wife's SS Card changed to her married name before you send in the AOS. Your stepson's SS Card will keep his same birth name.

  8. I would like to thank everyone that took their time to respond to my post. I am truly grateful for all the help that you all could give me. My story ended in a bad ending but I hope everyone that their story ends up good. And the other that already have that great life with that special someone I hope you the best in life.

    Do you want to elaborate on the bad ending? Do you mean you're having to redo some things or is there more to the "I lost my Passport and Visa" story? Even if something terrible has happened, sharing your story might help someone else.

  9. That's a good thing, that she still has the packet the embassy sent with her visa/passport. Have her start getting a new passport, pay the cost to get it expidited, and in the meantime contact the embassy for instructions. They will (at least for the two others I know of where this happened) reissue the visa, with the original exp. date. But I think you will have to pay the fee again. Good Luck!

  10. You stated above "Also she lost the entire packet that I sent to her which included her medical records". Any packet you sent her is not needed. If you meant she lost the packet that was sent from the embassy with her passport, then that's a big deal!! You, She actually, need to contact the embassy immediately. She can get a new passport and get the visa re-issued (attached to her pp), but there will be a new visa fee and it's going to take some time.

  11. We also recieved my wife's ROC NOA1 which extended her stay for 1 year etc., etc. No mention of my stepdaughter which was listed on the I-751. They both recieved their BIO appointment letters a couple of days ago.

    Appearently some receive a seperate letter for the child, some do not. I'm gonna call soon and see if I can get any answers.

    Since we're not planning on travelling out of the country I don't think it's a big deal though.

  13. My wife and I filed for her ROC which included her daughter (my stepdaughter). Recieved NOA1 Saturday which explains she has one year extension blah, blah, blah. It does not mention her daughter.

    While we have no plans to travel out of the country, I'm a little uncomfortable with us not having a document that extends her conditional residency.

    Is this normal? Will she recieve a seperate NOA1? Or will she just recieve BIO appointment.

  14. Our lawyer sent us a picture by email of what the RFE says, but not all of it. It requested one specific kind of passport photo from each of us and the photos must be taken within the past 30 days. We're not sure if the deadline is 30 days, though, as that part isn't shown.

    OK, so they are asking for passport photos. These have to be actual passport type photos. If you send the photo file to your fiance, he would need to print the photo on photo paper of course. And it has to meet the dimensions and image requirements stated in the instructions.

    No, the deadline is not 30 days. That's how recent the photo must be. The deadline will be on the RFE.
