  1. Even with that you daughter must enter the US with a K-2 Visa before her 21st birthday. See the part where it says K-2 Visa Holder's age is fixed at the time they enter the US?

    You will not be able to get through Petition Adjudication, NVC pass through, in country Medical & Consulate Interview in less 4 weeks. If she enters on a tourist Visa then she can't adjust status based on a K-2 Visa as she'd need to return to your country for the Visa interview and even if the Tourist Visa entry froze her age (which it doesn't) then once she leaves for the interview (K visas must be processed at the consulate) she would lose that.

    So you're right the very recent decision does changes things a little bit but not enough to help you.

    We understand all of this that is why we are petitioning.

    We are looking for ANSWERS to the questions posted not reiteration of rules and regs that we already know.

    there were two questions neither of which most people are answering.

    1. has anyone heard of denial w/o notification or reason given. (someone was helpful with an answer to that )

    2. Why would the officer suggest the action he did. So if no one knows then don't answer with opinion about our possibilities.

    Just the answers to the questions WE ASKED are all we are looking for.

  2. We petitioned thru Texas and was forwarded to Vermont in March for my fiance' in NZ and her

    After sending the request we discovered we had left the supporting docs out of the package.

    I sent a second envelope direct to Vermont and never received a receipt.

    July 10th I called to see if the docs had met up with the petition and the officer siad he would have to expedite it to see.

    The next day they denied the expedite and sent a letter.

    On the 18th the letter arrived and online they posted denial of the I-129F entirely.

    Today I called and escalated to a tier two officer who said we would have to wait till the denial letter arrived but that it was probably due to the docs not being located.

    He suggested that we should have called as soon as we discovered them missing and he would have sent out an RFE...(We did not know that we could call them at the time.)

    He suggested I petition to re open as soon as the letter arrives and send duplicate info.

    When I told him that my step daughter was turning 1 Aug 18th and needed to be in USA to qualify for perm status he suggested possibly sending her on a tourist visa.

    That seems risky as she could end up here and her mom might have problems with the I-129F.

    Has anyone had any experience with a denial without a DOE NOA2 or RFE being sent?

  3. Thank President Obama for this mess and remember 4/18 taxes are due, so he can start another war.

    He's NOT responsible for shutting it down.

    He offered concessions to the GOP and they said All or Nothing.

    The GOP is doing a power play to try and get Obama out in 2012 and they are proposing cutting budgets to

    social services including Medicare childrens health services and many more.

    Speaker John Boehner and a majority of his GOP counterparts have said their priority is to avert a shutdown,

    but more than a few in his caucus have told him that he needs to project a tougher line to win as many concessions as possible.

    The $33 billion agreement that seemed inevitable last week may now have fizzled under pressure from the GOP's right flank,

    including Michele Bachmann, to push for more cuts.

    Boehner is demanding more in cuts now, and even his one-week CR has $12 billion in additional cuts.

    Democrats, say Boehner agreed in private to the $33 billion figure, and so they need to hold firm on this

    issue so they don't get rolled on bigger votes down the road.

    Like the debt ceiling showdown (May or early June) or the Fiscal 2012 budget (a must-pass bill by September 30).

    GOP btw is anti immigration which was one reason why I left the party.

  4. I had a delivery confirmation with my I-129f package that I sent to Dallas, and I got the following message below:

    Notice Left (No Authorized Recipient Available), April 04, 2011, 8:48 am, DALLAS, TX 75266

    Did I screw up, should I have sent it to Lewisville? What to do?

    Are you referring to the USPS delivery confirmation notice for the receipt of the package?

    If so then don't worry it is a lock box location that receives the I-129F so it is like a mail drop.

    Once they clear it out and assign your petition to a service center you will get an email (if you included the G-1145 with your petition) usually within a week of receiving it.

    Otherwise they will mail you a hard copy of your receipt in a week to 10 days.

    Then they forward the petition to a Service center and send you an NOA1. (I THINK)

    The point is that the post office wouldn't be able to get a signed delivery confirmation.

    They told me that when I mailed mine and said "save the money".

  5. So you're saying that conversations (e-mail/chats logs) are not 'required' for the Petition... only during the interview in NZ? But pictures, travel info, boarding passes... etc are necessary? Is sending a few (1 chat every month and a half), to show extra proof, a good idea?

    Fom reading what everyone else has said, I think that you just need to prove that you met with your fiance within the last 2 years.

    So anything that puts you in the same place (country) at the same time is good.

    Photos identifying location for example and/or any ticketing information with the destination being near where you are is good.

    Actually 1 good item should be good enough because if you were together then you qualify.

    The proof of meeting will be based on facts so it doesn't require much evidence to prove.It either is or isn't.

    Probably a good idea to save the chats etc for the interview. That case will be harder to prove.

    The proof of relationship is more of a judgment call by them.

    They will need to put together a picture of your ongoing relationship showing your true intentions and motives.

    That can be difficult and so the more detail the better for that part.

  6. Or do as KiwiBird did, and send in all the missing documents (copies, of course) along with your NOA1 and hope it gets matched up to your petition. It did for her, but there are no guarantees but I see no harm in trying. If it doesn't work, all you're out is the postal fee.

    Especially since the I-129F will probably only just be arriving in Vermont in the next day or two.

    They tend to issue the NOA1 on arrival so it would be emailed and available to use as a reference number.

    If the missing Documents are ready and mailed overnight things might not miss a beat.

    It's been my experience in dealings with the old INS and the current USCIS as well as others that unless it is a law there are no absolutes.

    If I don't know for certain either by my own experience or by the letter of the law I don't comment.

    We did just that same thing. We sent a COPY of our entire packet with our NoA1 on top to the service center with the hopes it would be matched up. They approved us, and I know there is NO way they would have without ANY documentation. So... it's worth a shot.

    If your stuff doesn't get matched up, then at least you tried and you're only out the $5 postage to mail the packet copy to them.

    Where did you send your missing Documents with your NOA!?

    The Texas Lock box or the Vermont Service Center?

    This is our situation so maybe I can clarify everything if possible.

    My fiance has posted a question here but it has been added to in bits and pieces.

    Here it goes;

    • We have known each other since primary school.
    • In late 2009 we met again online
    • She and later her 20yr old daughter have been traveling to Florida since Oct 2010.
    • We have essentially been living together with her returning to NZ every 90days.
    • On their last return via San Francisco they were detained for 5 hrs and threatened with denial of entry.
    • On Valentines day (Feb 14th 2011)I finally proposed to her.... She accepted. :)
    • We sent the I-129F Petition off early March and it returned due to a post office error.
    • The same day (March 24th 2011) I re posted it along with the G-1158 and payment to Texas.
    • Friday April 1st (LOL) I received email notification that it was received and forwarding to Vermont for processing. (Receipt #issued)

    The issues are do we send the supporting docs, i.e.

    1. G-325a,
    2. I-130,
    3. copies of my birth cert & divorce decree,
    4. passport photos,
    5. letter of intent and
    6. proof of relationship etc.
    7. Or do we wait for Vermont Center to send me an I-797?

    Any help?
