  1. We are currently submitting our forms to the NVC but when I go in the site it says these are the forms requried for the IV.

    But then we see this IMPORTANT NOTICE - ABOUT POLICE CERTIFICATES Some countries require a specific Police Certificate Request form to properly request and obtain Police Certificate(s).The Reciprocity by Country page indicates those countries.

    So when I go into the Reciprocity by Country for Italy they have another list

    Birth Certificate

    Marriage Certificate

    Certificate of Single Status

    Record of Family Status

    Death Certificate

    Certificate of Widow or Widower Status

    Penal Certificate

    General Penal Certificate

    Record of Changes pending before the Procura

    Record of Charges pending before the Pretura

    Military Record.

    Do I need the Record of family status?

  2. Our I-130 was approved on 5/20 and was not forwarded to the NVC because of an error that was made on there part so we had to wait for the approval of the K3 and and as of 7/26 it sits at the NBC. At this point we dont care which file gets sent to the NVC we are just hoping it gets there ASAP.

    We got the notice today that they are forwarding our file so maybe the K3 is not dead after all.

  3. Yes, a case file being sent to the NBC after an approval notice is either a mistake or something serious is being reconsidered. Citizenship status is one possibility but there are others including potential questions about previous marriages or marriage terminations. Really it could be any of the primary eligibility issues. Hopefully, it's an error.

    According to the USCIS 2nd tier it was an error...He said the I-130 should have sent out to the NVC but sometimes they make errors.. :bonk:

  4. It would be a first in several years if that's actually what is happening. USCIS seems to be changing some procedures.

    Our attorney isn't sure what is going on either and said he would send an inquiry to the AILA (liason committee)to see if this is a new policy. (policy changed periodically). he informed us this would not help our case but that hopefully this would help other filers.

  5. Yes I-129F is not useful as it has similar timelines like I-130 and also will cost more. Most of us didn't pursue the I-129F route based on the advises from previous filers experiences shared at VJ. If I am correct the I-129F gets dropped automatically once I-130 is approved. But it is strange that I-130 is being delayed for I-129F from 5/20 - strange and doesn't make sense.

    Of course I don't understand why your attorney advisesd you to go for I-129F, when the times lines for both is not significant.

    Hi! I know it doesnt make sense and it is driving me crazy that they are forwarding our I-130 everywhere...it has gone from the CSC to the NBC then to the local office and then to the NBC and now it is being sent the VSC.

    I had no idea about visajourney and I had seen something about filing the K3 so I asked the attorney about it and he said it was our choice if we wanted to do it. He said he has never had a case where they hold the I-130 for the K3.

  6. If your I-130 is approved, then the I-129F cannot be approved later. Approval of an I-129F is contingent on having a pending I-130. Approved is no longer pending. Follow the IR1/CR1 guide. K3 is out of the picture for you now.

    Hi! Yes, I know that the K3 is out of the picture since the I-130 was approved first. What I don't understand is why they didn't forward our file to the NVC when it was approved instead they are holding it until they adjudicate the K3. At this point the K3 doesn't even matter so I dont see why they are still holding our I-130.

    Our attorney said that USCIS will approve the K3 and then they sent the I130 to the NVC.

  7. We got approved on 5/20 and after 16 days I notified the NVC to see if they had recieved our file and they informed me that they would investigate the matter. Turns out that our I129f has not yet been approved so that is why the NVC had not recieved it. My understanding was once the I130 was approved they disregard the I129f and move forward with the I130.

    I got a letter yesterday from Vermont center saying that they had requested my file and once they successfully adjudicate the I129f they will forward the case to the NVC...please wait a minimum of 30 days for a response. Really?1?!?! Another month! :help:

    Available. The Certificato Generale del Casellario Giudiziale is a certified national record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).The Certificato dei Carichi Pendenti is a certified record of pending criminal charges, or a statement that no such charges exist, from the office of the Procura della Repubblica in the applicant's place of residence. Both certificates are required from immigrant visa applicants residing in Italy.

    Persons within Italy can obtain the Casellario Giudiziale by applying in person or by mail at any office of the Procura della Repubblica. The Carichi Pendenti must be obtained at the Procura della Repubblica in the area that the applicant resides. Such offices are located in all major cities and in many small cities and large towns. Those who apply in person must submit a written request, a photocopy of a photo ID and all fees; the certificates are usually provided the day of the request.

    Persons outside of Italy can obtain the Casellario Giudiziale by writing to:

    Those requesting the certificate by mail, whether from within or outside Italy, must submit a written request, a photocopy of a photo i.d., and all fees, along with a stamped, self-addressed envelope. Mail requests are normally processed within three working days. Information concerning fees and application procedures is available from any office of the Procura della Repubblica or online at http://www.giustizia.it.

    Thanks for your reply...my husband's father will be getting this for us and then mailing it to the country where my husband is working but like i said this will take 2 weeks so I would like to have his father get it now but the problem will be that the date will probably before the NVC assigns us a visa number.

    I basically wanted to know if the NVC will ask for a police report that is dated after the assigned number?

  9. Every geography is different when it comes to the police report. In some you can just go get it, and in others you need a letter from the consulate--no one's opinion matters except for those who have done it in Italy or those who know the exact rules in Italy.

    For example, in Costa Rica, you just walk up to a window and ask--no muss, no fuss, and no reason to wait, but it doesn't matter because CR isn't Italy. In our case, we got it before we had any info from NVC, but again--it doesn't matter to you !!!

  10. We got approved for the I-130 but are currently waiting for the NVC to send us the visa number. We have been waiting for over a month so I assume that they should be recieving our case any day now. My husband's police report takes about a week to 2 weeks. Has anyone asked for a report before they recieved the their visa number? I just don't want to waste anymore time.

  11. Interesting. Any of the ones that got this NOA2, has your spouse (your applying for) ever been to the United States before?

    The portion on where they ask if your relative has ever been to the U.S. I have clearly marked No.

    My husband had a B1-B2 visa. I don't think being in the US has anything to do with it. When I called USCIS and I spoke to the 2nd tier person he said this was an error and sometimes this happens. Yes its an error but how long does it take to correct this.

  12. I was so excited to get approval in less than 4 months, but now USCIS has gone and made a mistake to set us back!

    On the NOA2 it seems to think that my husband (the beneficiary) is in the US and will adjust status (and no we didn't submit a I-129F or petitions for children). Otherwise they say we have to file form I-824 (and pay $400 and wait another few months!!!) to have the petition sent to NVC. We clearly listed his foreign address and in Question 22 put N/A for the local office and indicated the London Embassy. Obviously they made a mistake and should have just sent the petition on automatically.

    So we’ve put in a service request for them to correct this and will just have to wait some more I guess. Ugh! Has anybody else had to deal with this? How long should we expect to wait for NVC to get it now?

    This happened to us as well except the attorney failed to see that it said adjustment of status and I didn't even bother taking a look at it :bonk: After our approval I waited 15 business days like they recommend and I called the NVC they told me they would investigate and then notified me that my case was at the field office. I made an appt at the field office and that is when they told me that the reason they had my petition was because it said AOS. Its been 4 business day since this happened and when the attorney called USCIS they say that my case is at the NBC and that it was never at the field office. So bottom line they don't even know where my file is. I hope you have better luck then us.

  13. So sorry for your unnecessary troubles :unsure: but due to your diligence it was caught :thumbs: This is why we need to stay on top of the situation during each step of the process. Your attorney should reimburse your money for his error :bonk: What was he getting paid for? :no:

    We are not footing the bill for the attorney so I'm not sure what he was paid for but from my understanding he was to follow up on our I-130 till the end but it doesn't seem that way. I know for the last packets he said the cost was $1500 for the 2 forms that we need. we tried filling my husbands form out ourselves but since my husbands case is complicated we had to ask for his assistance.

  14. I will try to make this as short as possible...We were approved on MAY 20TH and we had not heard anything from the NVC so I finally called on the 16th business day. The told me that they had not yet received my case but that they would investigate. To my horror I received an email on Thursday from the NVC saying that the field office was holding my petition. I was in complete shock, so I went on line and thanks to God there was an appt available that same day. When I arrived to the local office I spoke to the women and she kept saying that my case was not there and I said yes look at the email from the NVC and then she looked at it and said oh yes it is here. Then she proceeded to ask me questions about my husband and I said he was not living in the US then she points out that the approval letter said

    The above petition has been approved. The person this petition is for will be notified separately when a decision has been reached on his or her pending status of adjustment application.

    Because it says this they were holding our petition thinking that my husband was adjusting his status and living in the US which he wasn't.

    I called USCIS and they told me this was an error on their part and that my case would immediately be sent the NVC. I really want to believe that, that is true but I seriously doubt that. Our case is probably still sitting on the case workers desk gathering some more dust.

    The worst part about losing a month is that our attorney didn't even bother to read the fine print. If he would have seen this he could have called USCIS and have corrected the error ASAP!

  15. I got NOA on May 20th and called the NVC last night. They told me to email them and attach my approval letter so I did and I got a response today saying they:

    Dear Sir/Madam:

    Please be advised that the National Visa Center (NVC) has received your

    inquiry and the attached I-797 Notice of Action - Approval Notice.

    Unfortunately, we do not have record of receiving your approved petition

    from U.S. Citizenship and Immigration Services. The NVC will contact

    USCIS on your behalf for information on the location of this petition.
