You could certainly file a request to re-open the closed I-130 but, in all honesty, it would cost money, take a long time to be processed and would probably end up in a denial with immigration stating that they appreciate that there were extenuating circumstances but that is your problem and not theirs. It would be much easier and faster for you to re-file rather than to try and get the old file re-opened. Be sure to include a statement explaining why the previous I-130 expired due to inactivity.     the i30 got approved. the case had been sent to dominican republic already. they sent the appointment there because my spouse lives there and i had to fly out but didnt get permission cause of my pending case and encarceration.

  2. i petitioned for my wife on june 2010. i got arrested november 2010 and had an appointment on may 2011 but i could not attend (this is in dominican republic) because i was in pretrial services and my passport had been confiscated. i did 14 months in prison. they gave me one year from the date of the appointment to show up but it was impossible because i had to go to prison. so im out now and am dying to have my wife here with me. she has been supportive of the whole thing since day one. what can i do to re open my case.

  3. i plead guilty to bribery, accepting bribe which is a felony in my case. since i took the plea i would not be charged with conspiracy bulk money transferring lying to a federal ajent and drug trafficking. with drug trafficking my wife would not be able to immigrate here ever on my behalf

    i was supposed to be sentenced this month but since the prosecutor needed more time to investigate they kept asking me for a 30 day extention and i kept givinf it to them knowing it was beneficial for me since i had this pending petition. so now im being senctenced in july. when they decided they were done i got me a paid lawyer wich gave me an extra 30 days, which was worth the 20 k fee. so now she is set up for may and 2 months later i go to sentencing. so im hapy in a way.

  4. i know the ds 230 ask about arrest but thats for the intending immigrant not for the petitioner in this case the petitioner which is me and live in usa have an open case awaiting sentencing. i know it is like visa suicide if i dont go but is there anything else i can do like go to the dominican embassy here in the us and notify them maybe they can do something over the phone?

  5. my wife is scheduled for a consular interview in sdo on may 31 2011 and because of an arrest and pending court date and possible jail time, the govermnemt wont let me out the coutnry to be with her for the intervies. in this case she has to go by herself. will my court case, and me not being able to go to the consular interview be an automatic decline for her visa.she has me as a sponsor and my cousin who with both our income is well over 130k a year. im working now and saving money, what can she do to make her interview a success without me there, thank you.

    i did everything myself and i did it by following the instructions. why pay a lawyer to do the same thing that you can do yourself and get the same results.

    i strongly recommend that when you send in the affidavit of suppor send in the ds 230 with it to save you 20 days, i didnt know this but i tell you so that you can benefit from it.
