  1. has anyone ever heard of this? i've been trying to do some research on this! my fiance was previously married to a us citizen. the ex-wife never petitioned for him to join her but instead filed for divorce. now a few years later, here we are and i want to petition my fiance. my problem is there is no divorce in the philippines. i've heard 2 things -

    1. my fiance has to file something called a petition for recognition of foreign divorce decree with the regional trial court in the philippines

    2. on the manila us embassy website it stated: a common basis for refusal is a prior marriage for the beneficiary or the petitioner that has not been legally terminated. there is no divorce in the philippines. a consular officer will only accept a death certificate or a court ruling of annulment or presumptive death as evidence that a filipino marriage has been terminated. an american may terminate a filipino marriage through a us divorce.

    so i'm so confused! i don't want to submit the petition without knowing what to do...but no agency can give me a straight up answer....how frustrating!

    I am a US citizen getting ready to file a I-129F petition to bring my fiance here to the states to marry but have one last question. Hopefully, you can help to clarify something for me.

    My fiance was previously married to a US citizen. She is here in the states now and has filed for divorce so that she can remarry someone else. I have the original copy of the divorce decree and am submitting a copy along with the petition. However, my question is - since the Philippines does not recognize divorce, will this be a basis for refusal? If so, what should I do to avoid this?

    Please help as it would be greatly appreciated.

  3. hey there...sorry to hear about the long wait...i haven't even submitted my petition yet...just trying to clarify one last thing...maybe you can help! my fiance was previously married to a us citizen...she filed for divorce so that she could remarry here in the states...however, philippines does not recognize divorce so what should i do?

  4. You need to make him unmarried in the eyes of the Philippine goverment. that requires the petition for recognition of foreign divorce decree.

    I think there might be a rule that the US citizen filed the divorce.

    thanks so much for replying...yes i was trying to do some research on that recognition of foreign divorce decree! do u think i need that first before i even submit the i129f petition? or do u think i can get away with doing it at the same time?

    i'm kinda new to the site but i need some of your opinions on something...hope you can help...so here goes:

    i want to petition my fiance who is in the philippines...i'm here in the states...he was previously married to a us citizen...his ex-wife is now here...they are divorced and she has even re-married! so my question is...since the philippines doesn't recognize divorce...what does he have to do in order for us to get married?

    -file an anullment?

    -file a petition for recognition of foreign divorce decree?

    -or nothing?

    i'm finally ready to mail the petition in thinking that i would not have a problem since she's re-married and i have their divorce papers but he's stressing that there maybe something we're missing...any help would be great!
