  1. Hi everyone....

    I'm reading this forum since the very beginning of my visa journey. This forum helped ALOT...

    Now, i'm already a Permenent Resident, [granted me 10 yrs] as i recalled, the Officer that interviewed me n my hubby told us that i CAN imediately apply for a citizenship. However, as i began to research all the facts and infos, i've read that some infos said that i can apply after 3 yrs, some said 5 yrs. Now, this confused me. :wacko::unsure:

    What is really true? Did the US immigrati9on changed their rules or what? I'm thinking of filing it next june 07. Pls any advice here. God bless

  2. To all the people who journeyed with us and gave us ALOT of infos regarding how to file our petition, from first to last, FOLKS!!!! we never missed a heartbeat of it! THANK YOU ALL!!!!

    Although i'll say this.... INFOPASS is STILL the best when you have a question regarding your petition.Thats how we got to kill 2 birds in one stone.

    My wife's EAD card A# was typed in wrong, so she was issued a temporarycard here in charlotte.But..its goin to be a yr now,no EAD card correction was mailed.We got our interiviewed date last Dec 06,2006. The officer made us submit more evidences. we got 2 RFE's but she told us if we submit it before the due date, my wife could get a 10 yr greencard coz were on our 4th yr of anniversary already.

    My wife's employer told her that her that her EAD card was expired already n wifey got scared that she will be walkin out of the office with NO job just because of her A# was typed wronged by the USCIS.

    We had an infopass set up then,the officer at immigration here in charlotte was so kind that when he knew that we've dome everything already and just waitin for the result, he then reviewed our case and told us to wait so that he could squeezed us between the interviews on that day. We waited for 4 hours and finally, ushered us to the office, he then asked my wife about the EAD card and passport,he then told both of us that were approved already and dont need the EAD.

    He then stamped my wife's passport for 1 yr and told us to wait for the GC and she will be havin a 10 yr LPR status.

    If not for infopass, we would have been waiting until now.We got an email and at the same time, a welcome notice fr them.

    Boy! nightmare sure for now is over for my wife. Another hurdle in the future if she wants to file for citizenship. :whistle:

    Once again.... if not for this site, we cant able to make it. THUMBS UP for Captain Ewok,to all everyone out here. Thank you for all your inputs.

    Just sharin with u all what took placed in my AOS journey here.

    1.i applied the EAD first n USCIS messed up w/my alien #.

    2.Had went there to let them correct it.

    3.They told me that i can get my NEW EAD card w/ my correct # but it DIDNT.

    4.We applied for SS number n they denied me for im usin the wrong number.I had to go to USCIS center twice for that in one day.

    Security guards there thought im losin my mind.For the 3rd time, they straightened it up.But until now, havent received the original fr Missourri.Only got temporary EAD card.

    5.Finally.got money for applying the AOS.We sent everything n we got a letter fr them they havent received our money order for AOS.Infact, we got the copy of the money order we sent.

    6.We sent another money order in ORDER NOT to delay my application.

    7.We spent ....whew!!! another form for medical form that i had a shots.

    8.We got a RFE coz my hubby's income didnt met the 125% poverty guideline.

    9.We explained to them in letter that my hubby came back here in US last April 2005 n began to worked fulltime until Oct 31st,2005.So, he only filed for 1099.Infact, his income is more that what guideline was asking.Due to the fact that he went back to Phil.nov 05 to be with me n waited for my interview in manila n

    we came back here in US last Feb.'06.So, income is only 7 months n not whole yr.

    10.They received our RFE last July 27 n touched my case last Oct 11.

    11.We got a letter fr them stating we will have our interview on Dec 06.

    12.AdviseTo Newbies here......Pls put the GROSS INCOME in your employment letter when ur submitting

    employment letter.

    b.Put everything in order n photocopied it.

    c.If your case is similar to us, Dont forget to add your LATEST paystub.It will help.

    d.If spouse is already working.. put his/her paystubs or proof of income too n employment letter.PLUS...

    the EAD card, photocopy.

    We applied for the AOS already and we got this RFE...

    My hubby went to USA last February 2005 and went back to his job.ByApril 2005,he was a regular employee and earning above the 125% of the poverty line.

    HE came back to the Phils.last Nov 2005 to be with me and waited there for my interview date and medical so that the 2 of us will come back to USA together.

    Now, he only filed for 1099 [tax] because he only worked for 7 months on that yr.We settled already for the fine and everything.We came back here on February and he is still working fulltime to that same company and he meet the USCIS poverty guidelines.

    Now,we already submitted to them the latest tax returns which is the 1099 plus the letter of his employment and his wages and how much he is earning per hour.

    Do we need to sumbit it again?the 1099 form,the payslips and the letter of employment and the how much he is earning every bi-weekly?

    We dont know what to do....pls help....

    I would like to add this opportunity here to thank CAPTAIN EWOK for mostly and to all the people that helped us durin the process of my visa. Now, another problem come up again and im asking for the input here.

    What is the RFE asking you for?

    The USCIS is asking us for further evidences about his earnings or income. The 1099 has the amount of only 10,746$,they think its below the poverty guidelines which is true.. but the logic here is that my hubby only worked for 8 mnoths here n went baCK to Phils. as what i stated.

    They told me that we need to send them proof that we are not below the 125% poverty guidelines which they stated.

    But as i said earlier, bi weekly rate of my hubby is 800$ n monthly income is sufficient for both of us only.'

    GOT MY VISA TODAY AT 2;45PM.MANILA TIME..... DELBROS DELIVERED IT TO MY PROVINCE.
