  1. After A letter is sent to the NVC & Embassy to withdrawal a k1 petition, how long does it take to actually be deleted from there databases?

    We withdrew because we are too young to marry, but still would like to date. If in the future, my GF decides to come to America with her 10 Year B2 visa, will the POE give her problems about the k1 withdrawal? Will it even be in there database?

  2. The fact that she came and went back once already is probably more important than anything. It shows she has a history of following the rules.

    what if she came with a friend, with the exact same itinerary as her? Would that ease POE suspicions?

  3. This may be similar to other threads so I apologize.

    My girlfriend has a B2 ten year multiple entry visa. She has used it once last March 2010- September 2010. To visit me. Right after she left, I filed a k1 petition to get marry. Recently we decided that now is not the time to marry, and we should date longer to get a true feel about things. So I withdrew my petition. She wants to come visit me from July-November 2011 this year. She has never seen snow and would love to spend more time with me. Do you guys think the POE Officer at Dulles will give her problems? Her proof of her country will be, her bank statement, bank book. Return ticket, and letter from me urging and sponsoring her to get a 6 month visa. I am getting so paranoid about this lately. And will the k1 withdrawal come up in the computer?

  4. You file the I-864 with NVC, so they are the ones that decide about a co-sponsor, not the embassy.

    I agree too, but Bangkok denies k1 visas if they have a cosponsor, I just wasn't sure if they can deny CR1 Visas with a cosponsor

  5. Any visa application can be denied. You & your co sponsor will have to meet the 125% of the 2011 U S govt poverty level criteria. If that is done & you meet all the other criteria required along with the proper submitted documents & pay the fees it should result in a C R 1 visa.

    Google the U S G poverty levels. Do the math to arrive at 125% of the family size you intend to submit.

    So even though Bangkok is notorious for denying cosponsors, you think a CR1 co sponsor who meets all criteria will be approved? Oh im sooo nervous!

  6. It isnt easier but it is more certian. They petition effort is about the same. Its unfortunate that Thailand is a high fraud country which makes the K 1 almost impossible to use a co sponsor. Of course being denied at the interview would be terrible to deal with. The loss of time & money as well.

    In the end you will be better off with the C R 1. It comes with the green card so no need to AOS ( adjust status ) later. She can go to work very soon after entry if she wants. Getting ID, drivers license & may other things are much easier.

    With the correct understanding & effort you have an excellent chance of getting what you want. The timeline isnt much longer.

    But I thought a CR1 joint co sponsor could not be denied at a Consular level?

  7. This will depend on the co sponsors ability to show proper support assistance. As long as the support amount is provided there should be no problem. Find the 2011 poverty levels used by the U S govt. You need to provide proof that you or a co sponsor can provide 125% of that amount based on family size. To do this both parties turn in 864 forms with supporting documents.

    You should not have any problems obtaining a C R 1 visa if the criteria is met. See the guides above to get more info.

    So A CR-1 with joint sponsor Is Much Easier Than k1 with joint sponsor.
