  1. So my question is how is your fiance here legally or not? NO you can't transfer an interview just cancel it but then you applied for 129f and you have been approved so why not the interview? If she does not have interview then how is she going to stay her legally?

she's here legally under wet-foot/dry-foot. no longer a need for an interview, as under those terms, she cannot leave the US until her status is adjusted and she get's her green card (usually takes 1 year) OR we get married (which may still happen but we aren't rushing it, just enjoying finally being together without any additional stress).

  2. You can call and cancel the appointment. Then someone else who is waiting can get the open appointment.

You cant tell them you want a specific person to have the appointment it doesn't work that way.

so i'd have to coordinate the timing with the person who gets the appointment? in other words, call to cancel, and moments later my "friend" calls and picks it up? is there a delay of any kind? i know a lot of Cubans use the fiance visa as a way to bring over family members etc, and i'd really like to reward two people who are actually in love, rather than leave it to chance so some guy can bring over his 3rd cousin. thx for the reply.

  3. Hi,

I have been on here briefly in the past and received some great help and friendly encouragement. Thanks for that.

However, my fiance arrived in the US by other means. We have been living in NYC together now for 2 months, and things are great and we are happy. However, we still have our Nov 16th interview appointment for her fiance visa. I was wondering if it's possible for me to transfer this appointment to someone else? Obviously, the recipient must be to a particular point in the process to be able to take advantage, but assuming they are only waiting for the interview, how can I transfer it to them?

I ask for two reasons: 1) for informational purposes, and if it IS possible 2) to transfer the appointment to someone in this online community. I don't know yet how I would choose the recipient, but let's first address whether or not this is possible and take it from there.

    Thanks all.

Adding: this is for a Cuban K-1 visa. Thanks again.

  4. USCIS falls under the state department. The trade embargo with Cuba is just that: a trade embargo. In other words, you can travel there, but it is illegal for you to SPEND MONEY there. Any trouble you encounter will be with the Treasury dept, not with the State Dept. They don't care.

Confirmed this with the Director of Constituent Affairs at my local congresman's office. He was a big help, so maybe try your local office.

As for lawyers, mine was a complete waste of money, and actually wound up costing me even MORE time. Don't use them unless you feel overwhelmed by the process. I'm sure some are better than most, but make sure you get one with Cuban experience. Mine has been practicing immigration law for 28 years and even taught at Florida Int'l University in Miami of all places), and the guy was an uninformed jackass. Using him was the worst decision I made in the whole process.

Also make frequent visits to Cuba if you can. I just got back and seeing my chica again made it worth it all over again. You'll get there.

  5. Update. I went to the Interests Section and presented our case for an interview expedite, after getting a Nov 16 date. My fiance has a very sick stepfather and her sister is getting married in August, so I presented proof of each and am now crossing my fingers. They say we should know in 10 days.

Seems that phone calls to those on the Cuban side of the equation are more theoretical than real. Each time I follow up myself I get results. When told they'll contact my fiance, nothing happens.... which is quite representative of Cuba, isn't it? :)

thanks all. more updates as i get them.

  6. Hi all,

I was approved by USCIS 10 days ago and have not yet received an interview appointment. I called the number and they said they are not scheduling any more interviews until further notice. Is this a fact?

If not, I was wondering with all the talk of 8+ month wait times, I will be in Havana next week, and plan to stop by the US Interests Section to inquire about timing, etc. I have two questions:

    - Since we have not yet received a new file # for Havana, will my fiance even be identifiable yet?

    - I was told by USCIS that me arriving in person can only help the process. Does anyone have experience getting a more favorable interview date by asking in person?

    Thanks all!
