Actually my husband had the same thing happen. Got the RFE right before biometrics appointment. EAD was still approved even though his case is still pending. Took about 73 days or so from the date the USCIS received the original application. You should get your EAD soonish.

Is it?There is no fee for the EAD with a pending I-485, so having to pay a fee for a replacement is a non-issue.
I've read threads here that say replacement cards require a new application which in turn require a fee, as they are no longer in conjunction with the AOS app. Albeit, our case is different as it is clearly lost in the USPS. I am interested in hearing from anyone who has actually had this experience as it would not surprise me in the slightest for our government to not care who's at fault for the lost card & require a fee with any new application. Just trying to get a handle on what to expect.

My husband's EAD card was sent out June 6th, successfully made it's way across the country until June 9th where it's last scan was departing a USPS sorting facility and hasn't been scanned since. I have dutifully harassed the USPS to no avail, called USCIS to report that he has not received it within 7 days (as the instructions say to do on the USCIS case status page) & was told we have to wait 30 days from the date they mailed it to proceed (why the contradiction in instruction?). Anyway, made an e-request today which informed me that someone will get to me by July 15th (grrrrrrrrr).
My questions are: Has anyone had this experience & can tell me what to expect? The USPS tracking site does NOT show delivered. It is legitimately lost. How difficult of a process will it be to get them to send a new one? I'm not paying for another one, so if that's the case, I guess he'll be waiting a long while for that precious greencard. Sorry for the mini rant but I can't believe of all the pieces of mail to get lost, it's the traceable one.

Do it yourself. You have to gather all the documentation for the lawyer anyway, don't pay someone $1500 to fill out forms. Read the AOS guide step by step. You can do it! Time consuming, yes but save yourself some money!

I doubt it was denied because you were in engaged before your divorce was final. I was engaged before my divorce was final & didn't apply until after the divorce was final. We were approved. There is something else that makes them think you don't have a bonafide relationship. I agree with other posters, you need to address any red flags because getting married may not be enough to overcome whatever the real issue is.

I agree with TBone, front loading ESPECIALLY for difficult embassies is a necessity. Better to be safe than sorry..

So did we. Just because they give the biometrics appt doesn't mean you won't receive an RFE later. I know you were hoping to be "safe" (so was I).

Apply for her SSN ASAP or you will have to wait until her AOS is approved for her to get one. If you apply too close to her I-94 expiring, they may make her wait. Her I-94 may be stapled in her passport, unless she has an electronic one. She would have received it at POE.

You don't need to send the I-130 & there is no extra fee. My husband came on a k-1, we got married in 90 days but didn't file AOS for 8 months. The application was accepted and he has an appointment for his biometrics next week. He was out of status for a good long while but we complied with the conditions of the k-1 visa (got married in 90 days). I don't necessarily advise you wait but sometimes there are circumstances that are out of your control. Good luck in the rest of your visa journey!

My friend is going through this same process except from Paris to Tunis. I highly suggest you confirm with Paris that they sent your packet via the appropriate TRACKED courier (DHL, I believe). They did not do this in my friends case and although the embassy in Tunis has the electronic file, they will not proceed without the hard copy. I don't mean to alarm you but it seems the Paris consulate does not always do their due diligence. Better to get on it now than wait. Good luck!

The household size includes the sponsor, you and anyone else the sponsor supports. So, if your sponsor doesn't have any other people they support then the household size would be two (you and your sponsor).

Yes, he'll get it as he clears customs there in the airport. Be prepared to pay, I forget how much. I'll ask my husband when he wakes but it wasn't very much...60dt I think, something around there.

The fees for the fiancé visa actually went down. We didn't have to pay the added fee like CR1 because fiancé visas are classed as non-immigrant and no green card is issued until after AOS is done in the U.S. We paid JUST the $240 at the Embassy & that was it. The additional cost comes later with AOS which CR1's don't have to do.

yes my friend the fees have gone up. even for me ir1/cr1 there are new fees that have to be paid once the visa is issued.
NO! The information they send you from the Embassy in Tunisia is wrong. The fee is $240, we verified that with them. That's what my fiancé paid and he just arrived 2 weeks ago. Perhaps the fee is different for CR1 but for K1 it's $240.

Mehdali-my fiance's visa was approved yesterday with no questions asked about my income so, I suppose the employer letter with the pay stubs and my 1040 from 2012 were enough to prove I am away over to guidelines.

Congrats ladies... We are all blessed. My baby is 11 days old as well. Grateful my husband was here in the U.S. when I gave birth. Both you ladies are amazing.. Enjoying spending time with my son at home. Interview questions will be very simple & good luck..

Ugh zoo, it took 3 emails for them to finally answer me. They send an auto reply saying they will respond in 3 days so after they didn't I finally sent a more stern email stating it was my third request & I need the info. They had my petition for a month before they sent us packet three by email. Then after returning the ds230 by email, I had to send another two emails requesting an interview date. The guy who finally responded basically said wait & we'll get to you when we get to you (but nicer), then I received another email that afternoon with the interview date & letter. Fiancé just finished the medical today (just a heads up; he had a 7:30am appointment & it took all day-he had to go 3 places) & said it was easy. Feel free to private message me if you have any more questions or just want to commiserate on this awful process!

Katt, I'm in the same boat. My hourly does not reflect my actual income. I sent the employer letter along with my 1040 & six months worth of pay stubs. His interview is next week, I'll let you know how it goes.
