    It states below about the 60 day limit on the I-94.

    Examples of other acceptable birth date/legal presence documents are: U.S. Birth Certificate, Proof of Indian Blood Degree, U.S. Passport, U.S. Armed Forces ID Cards, Certificate of Naturalization, Permanent Resident Card, or a foreign passport or Mexican Border Crossing Card with a valid I-94. The I-94 expiration date must be more than 2 months from the DL/ID card application date. A complete list of birth date/ legal presence documents is available online at www.dmv.ca.gov or in the Fast Fact brochure Birth Date and Legal Presence Requirements (FFDL 05).

  2. So, My husband and I went to go get his license in November to which we were informed that he cannot get one until he receives his SSN. We had already requested the SSN we were just waiting to actually get it. So we went yesterday with the SSN and were informed that he cannot get one because it is not more than 60 days until his visa expires!! What the heck! He entered in 10/15 and we went the next week to get his SSN to which we were informed that he will not get it until he is here for 30 days. So even if we got the SSN within 30 days (which we didn't by the way, we had to go in again to request it) we would have to immediately go to the DMV to get his license.

    We just purchased another vehicle for him to drive around as our public transportation system is atrocious where I live. Now I have to be his chauffeur until he gets his AOS which can take months to years!! Makes no sense!

    Has anybody else experienced this? What can be done? The DMV guy kept saying something about having an extension on the visa but I am pretty sure that is not a possibility for the k-1 visa. I thought about waiting for our NOA1 from our AOS and taking that to our UCSIS office and asking them to give us something so that he can get his license.

  3. I took the day off to take my fiance to the SSN office to receive his SSN card. We had all the forms ready including all the evidence saying they are allowed to get a SSN but the man informed us that there is already one on its way. Apparently, when he entered the US the DOHS started the process and he should apparently get one in 21 days from entry. This was a surprise as the DOHS did not give us anything informing us of this when he entered the US. We are confused and want to make sure that we have done the correct process. Also, if this is the case this website might want to update the process. :)

  4. Ok. So I am totally confused. According to this http://photos.state.gov/libraries/unitedkingdom/164203/cons-visa/iv_019.pdf we are to pay for our interview on the day of the interview at the embassy. HOWEVER, I keep reading in multiple posts that we are to prepay for it or we will not even be let in the embassy. Can someone please help us in this?? I don't want to get screwed over again like I have a few times already in this journey.

  5. Be warned about the cover letter you send with your Packet 3 to the London Embassy. We sent ours and as per instructions to state when medical is as well as intended WEDDING date for November. They sent us back saying that the forms were fine but they will not schedule his interview until closer to his intended arrival date. WE NEVER SAID NOVEMBER WAS THE DAY HE WAS COMING. They assumed it was and now we can't get our interview. We have 90 days to get married when he arrives so they should not assume this and if so they should say for us to tell them when he plans on coming over. Also, We never did receive the packet 3 either!

    They took over a week to respond to our email too to find out this information. He is planning on coming in August and now we might not get his interview in time. GRGH! They also stated that we need to make his medical appointment in October. He has it scheduled for next week and this was stated in the cover letter. It makes no sense for them to assume that. We send in the DS-2001 to say we are ready for the interview and that means we want it now otherwise we would have sent it later.

    Just wanted to share with you this experience. I was hoping to be there for his interview when I visit in July but now that probably won't happen.

  6. They have to have received the medical results and all the forms before they will schedule an interview. It doesn't really matter which is done first, because they're not going to issue you an interview date until they have both. So, it would make sense to book your medical as soon as possible, as it might be a couple of weeks away.

    You will need your case number (LND number) to book the medical. This number is in packet 3, but if you don't have it and don't want to wait for the letter to arrive, just call DOS and they'll tell you. I believe the second part of DS-230 is taken with you to the interview.

    on the DS-156k Form: Do I attach all that it is asking or just submit the forms and bring that to interview?

  7. Can anyone tell me what forms will need to be sent in for packet 3 for the London embassy? They mailed it to him over 3 wks ago and I phoned the DOS and they said that I can just submit the forms without having to actually have received the packet 3 so I want to go ahead and get that together. I am hoping he can have his interview while I am there in July(I know I don't have to be but I would like to be there). Thanks in advance. :)

A few things to consider: His family (or others) may be putting some pressure on him or voicing their concern - telling him probably the same thing you are being told from the other side "If she loves you and thinks this is forever then why would she object to a pre-nup?". My family broached the subject with me (two lawyers in the family). My situation is different that yours - she has no assets - I don't think it is fair to rip someone from their entire support system (family) and plop them in a country/culture where they do not speak the language and are totally dependent on you and then have them sign something that in essence is saying "if it works awesome! if not - well you are on your own".

    Your case is different - you have money, own a home, and you speak the language well and will probably adapt and prosper here more quickly than most.. He has a pre-nup - how are your assets being handled in the pre-nup? Are you planning on working when you are living in the US? Does he expect your money to become part of the community property? ... My mother recently married a wealthy man.. the pre-nup is set up so that all of her money/assets are not touched while they are alive (he is 74, she is 65) and whoever dies first the other gets the house (the only asset that is considered shared) and the assets of the dying partner go to that persons children.. For their situation that is fair.. No doubt he has a reason he is pursuing a pre-nup - Find out....

    I AGREE. It could be hi family and even though he is a teacher doesn't mean he doesn't come from a wealthy family.

  9. Has anybody entered with an NOA2 already? My fiance entered in after our NOA1 but I heard somewhere that it is not good to enter in with an NOA2. Correct???? Not sure but we should hopefully be getting our NOA2 in a few weeks as it is 5mo (no promises as I am finding out) but he is going to come in June so we will most likely have it by then. When he came a few months ago, POE was LAX and he had no problems at all, they didn't even ask for evidence, even though he still had it. Thanks for the help.

  10. I just got off the phone with my congressman (house of reps) and they have been phoning state department and such to get some information. The information I just received is that USCIS will not be affected by the shutdown however the US embassies will be affected (shutdown). She also said that the NVC may be affected but hard to say at this point. They should know of a shutdown by tomorrow and it will most likely go into affect friday or saturday for a few days. Hopefully, the few days do not put too much of a back log. Fingers crossed.

  11. I attempted an expedite with a congressman's help and they were very helpful and continue to be. I went online to look up the congressmen in our area (zip code). I am in California so I contacted our two senators (with no help from them) and my house of representative for my district. The house of rep guy(girl in office) were incredibly helpful and responded within a few days of my email. They have also phoned me and given me updates very frequently. I also had originally hired a lawyer for all of this fiance visa ####### but that was a mistake. I regret not finding this site before that. The lawyer has been useless. The congressman has been much better. I would suggest contacting the house of rep over a senator as they are more local to your area and usually not as busy as the senators. I would contact them now so that they can at least look into it for you and see where it is at. Also, you will need to sign a privacy consent form which just allows them to look into your case for you. Good luck.

  12. Get a letter from the bank on the severe financial loos of the business as well as a statement from the company of potential loss on the job offer here. I know it stinks to lose money, no matter how little or how much.

    the USCIS does offer businesses to pay expedite fees of $1,000 for company transfers. Why do you think the H visas get approved so fast. Easier to come by job offer.

    Severe financial loss to company or individual

    Extreme emergent situation

    Humanitarian situation

    Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

    USCIS error

    Compelling interest of USCIS

    If your case is at a local office at the time you need to make your emergency request, please go to the local office in person to make your request. Please be sure to take all supporting documentation with you.

    If your case is at one of our Service Centers or the National Benefits Center, please call customer service at 1-800-375-5283 to receive further instructions on where and how to send your request

    For financial hardship they would consider if you had a company which was going bankrupt .. individual (personal) bankruptcy would not count (chapter 7) and they would not process it

    Or emergency would be serious surgery (life/death) things like that

    such as Japan or Haiti....

    We had all that from the bank, business, job offer and buyer for the business. They still denied it.

  13. Just to clarify. The wedding stuff was in addition to the business expedite and job offer here. We originally submitted the expedite with both as evidence and it was denied. So my congressman resubmitted one based on the business alone. The thing that is the issue is that if he sells it now and waits he will need to get another job as supplemental income until the time he can come here. It is better for him financially to hold onto the business now but will probably have to dump the price to get it sold quickly. Also, his job offer needs him here in the summer to get trained and such but now we have to let it go too.

    I understand about my lawyer and I am incredibly disappointed with him. I wish I would have found this site too. Fortunately, it was a base price and I am not getting charged more for the expedite. This whole situation sucks and I wish CSC would just get the things done. The thing that bothers me is that they don't give us a reason. If they did we could possible come up with more evidence to support it if needed.
