    just want to go over the notions of the primary sponsor and the co-sponsor. Can some one who is unemployed and has literally zero income like in her case be a primary sponsor and get someone else to shoulder all the financial obligations on her behalf as a co-sponsor.

    I was just wondering if there exist any organization or entity that offers a free legal consultation services that she can resort to.

    Would be a great help if refereed to any.

    Here are some worries that she has in mind that they may encounter on the petition process:
    1. Whether or not she could petition the guy since she is not working and doesn't meet the income requirement.

    - She can petition, but they will need a co-sponsor to meet income requirements.

    2. For the Affidavit of Support, can she use her children's income as they are working? and Can a friend submit an affidavit of support on her behalf in order to meet the requirement?

    - Not on her behalf. She has to be the primary sponsor, but if she does not meet income requirements, then yes, a US citizen or resident can co-sponsor. This person should know that they will be financially obligated to the US government and may be sued to pay back any means tested benefit that her husband might receive. They will be financially responsible for 40 working quarters (at least 10 years), or until he becomes a citizen - whichever comes first. It's a fairly big financial responsibility.

    3. would there be any risk that the relationship will be deemed fraud by the USCIS although the relationship is really genuine?

    - There is always that risk. Depends if they have any major red flags or not.

    is there any reason she needs to involve a lawyer in her case or do you guys think that this case is a straight forward application and can be self prepared and filed.

    - If she can get someone to co-sponsor, and her husband does not have any criminal background or negative immigration history, this is a fairly straightforward DIY case.

    a friend of mine who is a us citizen is interested to marry a person who is currently visiting usa on a b1/b2 visa. She is a widowed mom to 4 children and unemployed and receiving a financial supports from the government in the forms of housing assistance and food stamps. They met through online dating 6 months earlier and now the guy is here in the states to meet up with the girl.

  3. Hi, We received RFE for our I-751 application requesting more evidence for our marriage.

    So far I have a copy of our rental agreement, title of our car that we acquire few months ago, auto insurance for this year, and photos for our recent trip together with my husband's family in the Philippines. no credit card payment due to the fact that we both have our own separate card. Do you guys think this is enough to show proof for our RFE? I can't show proof for any utility bills and payments in the house we are renting because we are sharing the rent with my parents and sister. The utilities are name under my parents.

  4. don't the forms usually have a section asking for the current residency address and then "mailing address if different from above"?

    form I-129F and G-325A doesn't have that option to put in mailing address

    how would you include the residence address and mailing address in Fiance Intent to Marry letter and I-129F Cover letter?

  5. when filing for K1 or any kind of visa, can the petioner mailing address be different from the street address being filed in all the forms to file for K1 visa? if so, how can this be done? my plan is to get all my NOA from my mailing address not from my resident address. any help will greatly appreciated. thanks

Since my first K1 visa was approved and my fiance went here in USA and left before the 90 days (we didn't get married), would you guys think I could apply again for K1 visa with the same fiance and get approve? I know for the new I-129F application "FILLING LIMITATION ON K NONIMMIGRANT" you need to make a waiver if you had a previous K1 approved for the past two years, explain why the marriage didnt happen with all the proper/valid documents. My fiance left the USA because we both felt we werent ready yet to get married. since it has been two years now, we both mature and feel we need to be in each others arm that's why I want to file for K1 visa again. would you guys think the INS would considered that explanation why we didnt get marry in the first place? I'm so confuse right now. I'm thinking of hiring a lawyer to file for my visa but then again the lawyer's fees are way too much (ridiculous).i need your help fellow visa journey members.

    Hello, I need help on filling for K1. My first K1 visa was granted two years ago and my fiance came here Jan 2006 and left before the 90 days period allowed. Unfortunately, we didnt get married. Now I'm trying to file again a K1 visa with the same fiance as the first one but I'm confuse whether if I should put.....

    1. the Social Security # for my fiance/beneficiary in the I-129F

    (8. US Social Security #).

    2. G-325A Biographic Info, under FILE NUMBER

    (should i put my fiance/beneficiary alien# from the first K1 visa?)

    3. G-325A Biographic Info, under US Social Security #

    (should i put my fiance/beneficiary ss#?)

    4. G-325A Biographic Info, under APPLICANT'S RESIDENT LAST 5 YRS

    (should i put the address where my fiance/beneficiary stayed while in the US?)

    5. G-325A Biographic Info, under APPLICANT'S EMPLOYMENT LAST 5 YRS

    (should i put my fiance/beneficiary employment since he worked here while staying for 90 days?)

    I need help(guidance) from the K1 visa experts/guru out here. im in a situation right now of re-filing a K1 visa with the same fiance (from the previous k1 visa that was approved). i know it will be too complicated for the second time I will file it. so for those who filed their K1 Visa the second time around successfully, i need your help on how you guys did it.

    here's my complicated situation....i filed my approved K1 visa last Jan.2005 and my fiance went through all those process just to get the visa approved, which it was approved and got the visa last aug.2005. my fiance came to US early this year (january) through K1 visa. he applied and got his Social Security number and was able to work using the k1 visa. unfortunately the wedding didn't happen, he left the country due to family emergency. as I look at the new I-129F form and reading the instruction, they implemented the IMBRA. my only concern right now is #4. FILING LIMITATION ON "K" NONIMMIGRANT PETITIONERS in compliance to IMBRA (requesting a waver for limitation impose). i'm afraid that they will deny my petition. so whoever had gone through with all these process, I NEED YOUR HELP. :crying::crying:

  9. i have seen other couple not in this site that have applied K3 because they got married in foreign country. after the USC petitioner received the NOA2 for K3, he decided (or i would say it was the immigrant attorney suggestion) to apply for K1 to expedite the process. they were successful on this. i was thinking of doing this route minus the attorney because i couldnt afford it, i was wondering if its possible then.

  10. :help: I need some samples to take a look to give me an idea on how to write my letter of intent and the declaration of the relationship. If I am writing two letters of intent for both of us (applicant and the fiance(e))should they be exactly the same thing or they must be in different version in order to be credible and believable in the eyes of the INS. I am applying for the K1 visa again for the same fiance, would you guys think that will hinder or there's a possibility that our application will get deny? i dont want to hire a lawyer again because they are way expensive.i need some help....your help will be gladly appreciated....thanks :help:
