  1. Posting for a friend - A friend of mine came here in the US as a K1 Visa. Her and the petitioner got married but eventually divorced. Apparently the petitioner did not processed my friends paper before they got divorced. My friend is now almost two years here and will now get married to her bf. My question are the following:

    1. Does she need to go back to the Philippines to have her new husband petition her again? Why? for a waiver of what?

    2. Would it be possible to have her new husband file for an Adjustment of Status and Spousal Petition?

We would gladly appreciate your honest answer .

    Thanks!

  2. My mom is 74 yrs old and was able to get her tourist visa, she understands English but cannot speak fluently, so it will not be a problem. If you're a US Citizen, then petitioned her, the probability of declining her visa will be small or have her get her tourist visa and while still in the US you can petition her but make sure you're a US citizen.

  3. If you think that the cause of your 221g is your theft case and you know that it was immediately dismissed then get the documents that showing it is dismissed from where the case was filed. Tell them that you need it for your Visa Application in the US. When you got the documents, bring/send (mae sure you have your personal copy as well) it to the NBI during your interview with them and they will send the information and letter to the USEM Manila clearing out your name and from there the USEM will process the visa.

  4. My Mom just got her interview today 8AM Mla time. She was almost 2 hours inside the US Embassy. They got her passport, no paper that was given to her if needed more documents.

    Questions were:

Q: Ano ang work mo before para mapatapos mo ang anak mo sa kolehiyo? (What was you work for before so you can send your daughter to college?)

My Mom: Meron akong business (I have a business)

Q: Ano ang trabaho mo ngayon? (What do you do now?)

My Mother: : Wala, ang anak ko ang nagpapadala ng pera sa akin. (None, my daughter sends me money)

    An interpreter came:

Interpreter Question: Kelan mo balak bumalik ng Pilipinas? (When do you intend to go back to the Philippines?)

My Mother: End of March 2015

Interpereter: Oh, siguraduhin mo na babalik ka sa Marso 2015, at makakaalis ka kasi sayang ang visa mo. (Make sure that you will comeback by March 2015, don't waist your visa.

When I checked the Non Immigrant Status: It's on Administrative Processing "Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved after administrative processing, your passport will be delivered by our contracted courier to the address you specified when you booked your interview.

Hopefully, my mom can get her tourist visa :)

  5. Hi Rob,

    You have to check:

    1. Does the document (showing that your "wife" is still single) authenticated from NSO?

    2. Does the one who does the ceremony is allowed to do so? Registering the wedding in PI will took like 2-3 months, but mine only took a week :)

You have to double check carefully because if the Mla embassy saw that she is married definitely it has an impact to you K1 visa - when I got married in PI, I was petitioned. My husband filed a CR1 petition since we are already married

If in the case that your "wife" document shows that she is single better get an authenticated CENOMAR from NSO.

    Just my 5 cents.

  6. I will be three years here in the US. I want my Mom be here apparently, i will still need to have my US citizenship before I can petition her here. She is 74 yrs old. I am her only daughter, the only person who's taking care of here is her second cousin but sad to say her cousin will be going back to Bacolod to take care of her spouse. Please advise on what to do and what are the requirements to have my Mom get her tourist visa.

She might not be approve with the Tourist Visa because of the ffg.:

    1. I am the only daughter and now here in the US, The USEM might think that she will not be back in the Philippine if the will approve her of the tourist visa

    2. My mom doesn't have bank accounts or any assets. We will just be inviting her to come with us but will shoulder everything. I don' think that USEM will allow her to come with us. We don't have any intention to have her be one of the illegal staying here in the US.

I really want here to be with us, but the dilemma of declining the tourist visa keeps on bugging me.

Any suggestions / advise wil be gladly appreciated.

    Thank you

  7. Hi,

Visit this site for the requirements. It is helpful as me and my husband married in PI before he petitioned. Wedding Requirements

But in our case, my husband did not wait for 10 days for the application. When he arrived in PI, the next day we went to Manila US Embassy for the Legal Capacity (just don't remember if we got it the same day), after getting the the Legal Capacity, 2 days after we got married :).

  8. Having a debt in the the Philippines no matter how big it is will not hinder your petition with your spouse, fiancee etc as long as:

    1. You communicate with the loaner to pay your debt even though you will no longer live in PI

    2. There should be no criminal case filed against the debtor. If there's any, check with RTC or MTC of your location. Get all the documents needed, and have arrangement with the loaner

    3. There is no check involve, if there's any it should always be a good check and never overdraft or bounced (this is BP22, can be a criminal case)

Please take note that if there are case's filed against anyone, it will reflect on your NBI (which is a requirement for the petition)and will result to 221g( correct me if I am wrong) during visa interview.

I suggest, just ask him if there's a problem with his debt, does it settle, if there's issue and cases filed etc, if none there will be no problem. If he wants to pay for it, then before he leaves PI he should have a PN for his debtor so there will be no problem.

    Hope it helps.

  9. Go for BDO, PNB, Metrobank or BPI. They're very credible in terms of remittance and online banking. If you're from Catbalogan here's the BDO address.

    Samar - Catbalogan

Del Rosario St. cor. Allen Ave., 6700 Catbalogan, Samar

    (055)251-5477251-5541356-1706(02)702-6000loc. 52246

    Fax: (055)543-9110

    8:30 - 5:30 PM Mon - Fri

I had a checking and savings account before with China Bank, it's really hard to deal with them esp if you're into online banking. If there's a problem with your bank account, you have to go to you're branch of account. With the banks I mentioned, they have remittance center in the US.

  10. meron bang ganito mga kabayan? meron ba kayong alam, baka naman pwede nyo share. Dito pala kami sa cali

    salamat

meron po. sigh-up ka sa odesk.com. i was once working from home. san kayo sa cali?

  11. Who among you here have tried using their BPI savings account which was opened in the Philippines, and have transferred money from BPI or have withdrawn money from BPI , while you are in the US?

My parents are transferring money through my BPI account and was wondering if I can withdraw them from the US?

    Thanks

At the back of your BPI Card look for the PLUS, Mastercard, STAR or Cirrus logo, if you have that, look for any bank with the same logo and you can withdraw your money here in the US, apparently there are charges for like 3-5$ for every transactions. I was able to use my BDO and BPI ATM Savings accounts cards here to withdraw and shopping. Hope it helps.

  12. Hello VJ Members,

Please anyone help me with my situation. Iam a K1 beneficiary and planning to bring my son with me to US under K2 visa. I just got annulled early this year, and his biological father is currently based in Taiwan. He has his own family and doesnt want to do anything with our son. We agreed mutually for him to signed his Voluntary Termination of Parental Rights last year, to permanently free himself from his responsibility/obligation to our son who he never give child support since 11 yrs. ago now , and never been in his life after he abandoned us same yr.

Do I still need to ask for his signature allowing my child to permanently immigrate with me to the US oneday, even if he is presently out of the country? Will the notarized Voluntary Termination of Parental Rights will be enough plus the court's decision stating his being psychologically incapacitated for abandoning us both in the past making me my child's sole parent since then up to the present time, for the CO to consider not to require travel consent letter from his bio dad anymore?

And also, I know here in the Philippines that I dont need to secure clearance from the DSWD since Iam his mother accompanying him to travel abroad, will our immigration ask for the father's travel consent letter even if I have with me the court decision and the notarized Voluntary Termination of Parental Rights from him?

Anyone who can relate to me, pls. I will appreciate your reply. Thanks in advance!

You don't need to secure a travel clearance as she/he is your biological child.

Oh, better to get a travel consent from your ex, as he is still the father of your kid, just to be safe though you have all the documents.

Visit this link http://www.dswd.gov.ph/index.php/faq/1886-travel-clearance-for-minors-, this will help you

  13. Would it be an issue for denial of visa if in the past was served arrest warrant? but not convicted, not even reach to court hearing and settled right away. There is a question in ds230 form question #41that made us confused because 3 intances were there in 1 question and only one instance apply to me. I guess i have to answer yes and explain my concern. But im worried if having that issue would be a hindrance to applying an immigrant visa.... Pls give some insights fellow vj'rs. Thanks.

Just tell the truth and explain. Also, if you are not convicted ensure that you have all the documents stating that the case was dismissed. You will need those documents (send the original copy to NVC/USCIS , then have an authenticated photocopy for your self). Also, double check if it is on your NBI (they call it hit) because upon interview if they see your NBI status as "NO CRIMINAL RECORD" USEM Manila will ask an explanation. Just ensure you have all the copy of the case.

  14. the quickest way would be for you to file now using your step parent relationship. your wife cannot file until she is here as an LPR. Even if you wife was already here, it would still be quicker for you to file using step parent relationship.

there is no permission needed for the children to leave the Philippines since illegitimate children are under the sole custody of their mother.

I agree with sunandmoon, my daughter was petitioned by my husband as her step daughter. your wife cannot petition them unless she is already a US citizen / LPR status.

  15. I came to the Philippines to fly back with my fiancee. She is taking her medical interview today. They are telling some of the girls for some reason they have to wait until after their NEXT period to be able to get their vaccinations.. I can't afford to take off an extra two week waiting on this. When many of the other girls are told they can get their vaccinations tomorrow. They are giving her no reason why the need to wait.

Can anyone tell me why there would be a reason to wait until after next period to get a vaccination?

Please be specific with the issues you have in the medical. When I had my medical exam, they had me go back after my NEXT period (if this is the monthly female visitor)for my Physical Examination not for the vaccination. Are your girls finished with the Physical Examination? Since the last thing to be completed for the Medical Exam is vaccination so I wonder why.
