I'm having exactly the same issue. I filed for ROC in September 2015 at VSC. I got an RFE in August 2016 to ask for further evidence of joint financials. When I hadn't heard anything back by December I rang and asked for an update. Got a letter in the mail 2 weeks ago to say my case is on hold pending security checks. It's very frustrating. I hope you get this sorted soon

Hello all, I'm sorry if this sounds like a stupid question. My conditional green card expired in September last year and I filed my ROC paperwork. I still haven't received my 10 year green card as they've asked for RFE due to lack of joint account statements in my pack (I sent them but they haven't acknowledged that I have!) . I am in the middle of putting together further evidence for my application.
My question is, As I was eligible (by marriage to a US citizen) in June this year to apply for Naturalization, should I do this now or wait until my 10 year green card application is accepted?

I'm sorry if this hasn't been posted to the correct topic so please accept my apologies if this is the case.
I moved to the USA from the UK on a K1 visa in September 2012 to be with my fiance. We were married in December 2012 and I filed for AOS. I got my conditional green card in September 2013 so it will expire in September 2015.
I have tried my hardest for the marriage to work but we have gone through so many problems that I want to end the relationship. My husband doesn't want any kind of physical relationship with me, he is distant, drinks a lot and I have been told many times from many different women (mainly my friends) that he makes advances on them when I'm not there. We got into an argument around 3 months ago and he hit me. It was only once and I never think he would do this again but I've just fallen out of love with him and no longer respect him.
I am due to file for removal of conditions from my conditional green card this week and I feel like I can't lie and say I'm happy when I'm not. I just don't want to be with him anymore.
Does anybody have any experience of filing I-751 Removal of conditions without their spouse? I really don't want to move back home but I can't ask my friends and family to sign affidavits and lie for me when I'm not happy.
As ever, any help would be greatly appreciated

I'm hoping that somebody can offer me some advice. I have received my AP/Employment Authorization card in the post and i would really like to travel home to England in the next few weeks but i haven't changed my name to my married name on my passport yet. Will this cause a problem when re-entering the USA? For further information i would be flying to Manchester UK then back to Newark USA
Any help greatly appreciated

Los Angeles - (USCIS Fairfax on W. Pico). Successful with no questions asked.

Santa Ana -Walked in 2 times in June 2012. No questions asked. The friendly security guards even told me I could go inside to fill out the form for my wife but will have to wait outside afterwards.

Miami - June 2012 - Gave no reason. Showed up 2 weeks before - was in and out in 5 minutes.
GEORGIA
Atlanta - No reason Officer had us wait outside until the earliest appts went in (about 15 minutes). Yes.
Atlanta - Our appt was for 6/13 went in 5/25 and we were successful with no questions. The office just wrote on our form Walk-in.
INDIANA
Michigan City - January 2012 - No reason needed - Yes to successful walk-in(asked about it, I was there the same day as appointment)
IOWA
Des Moines - April 2010 - Husbands erratic work schedule meant rescheduling wouldn't help because there was still no guarantee the new date would work - Successful
Des Moines - March 2011 - To get it over with - Successful (advised they were being more strict but letting them proceed due to no-one else being there)
LOUISIANA
Metairie - Unsuccessful. You must arrive on the correct day at the exact time of your appointment, or they will not see you. Tried for AOS, ROC and N-400. Two friends have also tried it and been refused.
MARYLAND
Wheaton - told Security guard I was not going to be in State on the day. Yes
Wheaton - July 2012, asked why could not make appointment, said attending wedding. Successful(out in 10 minutes).
MINNESOTA
St Paul - No reason asked or given. Successful
Minneapolis-May 2012- NO because one of the computers was down

Hackensack - The guard asked me what I was doing there on 8/20/12 when my schedule was 8/30/12. I told him my sister will be having her baby and I will fly to Rochester on 8/25/12 to be with her. The guard let me talk with the manager and the manager checked my roundtrip ticket. The walk-in attempt was SUCCESSFUL.

I have been sent an appointment to attend biometrics at Philadelphia ASC for my AOS application. I can't legally drive in PA for another 8 months and it is proving difficult and expensive to attend this appointment. One of my friends lives in Manhattan so i was thinking of trying a walk-in to get my biometrics here. Does anybody have any experience of this ASC and walk-ins?

I haven't used him myself because I do our taxes. You don't actually have to do any US tax return for 2012 since you dont have a greencard yet. Your husband can file "married filing separately" and you file nothing. You can also file a joint tax return with your husband for 2012 by writing a statement stating that you both wish for you to be considered a resident alien for tax purposes. When you do that, the worldwide income of both spouses is reported. Your UK earned income will be eligible for exclusion---so kinda like reported but then subtracted for tax calculating. (nothing in taxes is that simple, but that's the shortest way I can explain it.). The UK and the US have a tax treaty so you won't be expected to pay income tax on the same money to both countries. For 2013, you will be a resident alien with a greencard and will file a US return. There's ways to deduct foreign taxes paid if you still have to pay in the UK. I don't really know enough about how you determine which country gets your taxes if it is ongoing. IRS publication 519 will address some of your questions. Or Pete Newton.

You're fine from an immigration perspective. I did that when I came over. The only thing that gets tricky is your taxes, as you're a resident in the US, and a non-resident in the UK, you'll need a good accountant for when you file both returns, and you may end up paying extra tax depending on the law.

I came to the US on a K1 visa in September. I was married within the 90 days and I have now filed for AOS. I have been continuing to work for a UK company from home even thought i don't have EAD. Will this be a problem? I didn't think so as it wasn't a US firm but i'm starting to have doubts. I have just filed for my EAD today just in case but don't want to get into trouble for work i have already completed. I have tried to contact the USCIS but you can never get through to a human being and it is really frustrating!
As always any help would be greatly appreciated

As stated, you only need to marry within the 90 days to fulfill the requirements of the K-1, but you will be out of status from the time your I-94 expires to when your AoS package is accepted for processing by USCIS.
What state are you in? Usually either spouse is capable of getting a copy of their marriage certificate from the county clerk that issued it.
Thanks for your response, i'm in Pennsylvania. I spent an hour trying to get through to somebody at the USCIS today only to be told i need to make an appointment with somebody in their Philly office. Won't i get into trouble if i am out of status?

you had 90 days to get married, which you did. You can file for AOS anytime after, but I wouldn't delay if I were you. Make sure you obtain your official marriage certificate for the AOS application, not the license okay?

I came to the USA on 18th September on a K1 Visa. My boyfriend and I got married last month and my I-94 expires on Sunday (16th December) When do i need to file my AOS, is it before the I-94 expires or do i have longer? The reason I am asking is because i have all of the AOS ready to file but have misplaced my marriage licence. I need to go down to the courthouse to get a certified copy but my husband is working away and he needs to be with me in order to get one.
I'm starting to really panic
Any help wpuld be greatly appreciated

Thanks, Is this form similar to the ESTA where you have to apply beforehand or is this something that we are given on the plane to complete before we land?

On 26th March i was accepted at the embassy and was given a K1 visa which expires after 6 months. The expiry date will be 26th September 2012. My flight is booked for 18th September but i have just had a horrible thought that when they say that you have to get married and file for adjustment of status it has to be done before the 6 months are up. Is this the case or do you have a further 90 days from the point you enter the USA? If so do i have until the 18th December to get married and file for AOS?
Any help greatly appreciated

My Fiance has requested 3 years Tax transcripts/returns for me to take with me to my interview but the IRS have only sent him 2008,2009 & 2010. If my interview is in April will i need his tax return from 2011? He just tried to request this on the IRS website but they said 2011 isn't available.
Sorry i'm not sure how the whole tax thing works in the states so please forgive my ignorance!

I am reading through the step by step K1 visa guide (i received my NOA2 mid December) and i have got to the section:
- What to send to your fiance(e) once the I-129F is approved (Receive NOA2)
One of the things on this list is an I-134 form. The USCIS website doesn't tell you where to file this form as it depends on where the non US citizen resides and which form has been filed. The form we have filed so far is the I-129F and I live in the UK
Does my fiance need to complete this and collect all of the evidence and send it to me to take to the interview or does he need to file this himself in the states?

Just a quick update to let you know that my ROC has now been approved. The date on the letter is 21st February so there is a little bit of hope for everybody else going through the same nightmare. Good luck with your petitions
