  1. Hello to all VJ members,

I filed two I-130 petitions on behalf of my wife and my wife's daughter in early March of this year, my problem is that an incident happened at the home of my wife, which in the end involved the police and the court in her homeland, due to this incident my wife was very fearful and I tried to expedite the two petitions under an extreme emergency case as specified by the uscis as reason for expediting a case.

I was not sucessful in expediting the petitions, however can anyone say whether this will affect the normal processing of the petitions interms of time (5 months), or if this will affect the at all.

Thank you all for your responses and good luck to all of us.

  2. show your divorce papers, a court other that gives you permission to take your daugther out of the country, from your ex,how old is she did you marry before she is 18 then if so she comes on your 1-130 cr-1 togather and gets permanent resident card. and social security card.if she is over 18 then thats another file and wait,

The child is 6yrs old and the child's father and my wife were never married, which makes it even easier i believe. Thanks alot for your response.

  3. Hello To All

I find this site to be very interesting and informative.

I just got married in december last year after a a long distance relationship of 3 years. I am about to file I-130 petitions for my wife and her daughter. My step daughter has her father's last name and my wife has to prove that there is no custodial battle between her and the child's father, which there is none.

The father has consented to give full custody of the child to the mother and allow the child to migrate with the mother as long as all goes well.

What i want to find out is if a document from the father notarized by the registar of the court in her homeland barbados would be enough proof and accepted by the USCIS and the interviewing office when she is interviewed. If not can someone please direct us as to what will be accepted.

    Thank you

  4. Hello VJ Members

I am new to this site and so far i have found it to be very informative. Thanks to the persons who created this site.

My wife and i have been dating for 3 yrs before getting married last december in the US, my wife is from Barbados and is currently there. I am a US citizen and i am about to file for immigrant status for my wife and her daughter.

My situation is that my wife's daughter who is 6 yrs old from a previous relationship has her father's last name, i have been asking many questions of the USCIS and they have informed me that my wife has to prove to the consulate dealing with our case that there is no custodial battle between the child's father and her. What i would like answered is what exactly do my wife produce for them which proves this, is it a particular document that they are looking for and if so, what is it called.

If there is anyone out there ever had a particular case like this one please let me know what you have done and what was the outcome of your case, as my wife is very adamant that she is not leaving her one and only child in one country and she resides in another.

Thank you all in advance for all your responses.
