  1. For a K petition the I-134 is used. There have been a few instances where a I-864 has been requested along with a K petition. More to have a binding obligation from the sponsor. It's up to the interviewing officer.

    Including the letter about the family business, etc. has no weight. It's not something that the CO can (or would take the time to) verify. If the business was operating last year then it showed up on someone's tax return. Unless it showed a healthy profit I would stick with mom's salary. The income number used for a self employed person often trips up sponsors.

    ok everything is starting to make sense..im just going to make a letter saying im a junior in college and send in the tax i pay every year though its not much. and go ahead let my parents <mom> fill out the form..My sister and i are the only dependents since we both are in school and in the household i guess possibly my dad not to sure i'll double check. i'll leave out the business part. i'll just make it simple i guess. thank you again.

  2. It's ok not to have an income. And it's understandable when you are a student. That means you need to have a joint sponsor.

    That joint sponsor must meet the income requirement for their household number plus the intending immigrant. The I-134 does not allow for the combining of incomes.

    so does my mom have to fill out a i864 or i134 or should i go ahead and do both? and i know for sure i'll be writing a letter stating my situation.thanks for your help much appreciated..

  3. Don't despair and follow the advise that's been given. You must secure a co-sponsor that meets the poverty guidelines.

    thanks for the advice and support... well regarding me making any story about my business my parents make well above the poverty line and my mom works at a hospital, herself alone can pass the poverty line. i was just wondering about how i should fill out the forms and such and needed any insight how to go through the predicament of having no income to show.

  4. Hi Guys i couldn't sleep last night i been thinking about the Affidavit of Support. Im a Full time Student but im almost done im a Junior so im almost there. i was stressing about the income i have to fill out which i have none but i do pay for my university which i attend so i have no loans or grants also parents support me.i read countless of post here on VJ about students and k1 i know my chances are slimmer than the rest especially its Manila which i assume doesnt except co/joint sponsor.My family owns a business which we are a corporation so Im Co/Owner and Manager which my sisters and i and parents are sole proprietors. we just opened August of last year so we have no income tax or anything to show. We pay sales tax and etc and i help my parents which i don't really get any income and expect any pay check. Being raised as a Filipino i just want to meet the needs of the business and don't expect anything in return from my parents which they help me out already actually to much sometimes haha and Im fortunate to have them.My parents have assets paid off house, duplex and land etc. so Im not worried about being under the poverty line and my fiance wouldn't be a problem. Im just curious how i would go through this process should i fill out a i134 for my mom and i? or include a i863 which i read is only for k3 visas? i was wondering if its ok to write a letter included with i134 stating my situation..your help and advise is much needed thank you..

  5. Called the USCIS yesterday and discovered that the VSC is only now working on I-129F cases that were filed on January 16. Julia and I filed ours on February 14. I am wondering, "How is it that so many others, who filed around the same time as us, are already having interviews and visa approvals?"

    I was told by the USCIS representative that I might as well not even attempt to call them again for another 4 weeks. That will put me and Julia in mid-August before even potentially receiving our NOA2.

    I am just ranting....

    Please pray for us to have patience and unwavering trust in our God.

    i feel your pain..good luck! im trying to wait patiently 30 days is like a eternity...to add they wont give a service request.

  6. We filed our K-1 petition on February 14, (VSC) and I called the national USCIS service center 3 weeks ago to inquire. They told me that there was nothing they could do until the 5 month date. So now called today and they said there was nothing they could do for at least another 30 days. No status nothing. Then told me that the Petition was "in process" and that since I hadn't received any RFE's that all was probably ok. Called Elena and obviously frustrated. We're watching March VSC filers getting their NOA2 and see February and March filers in CSS actually having their interviews. Frustrating. Any words of wisdom or is it just sit and wait?

    yeah they told me the exact same thing..im just waiting patiently they wouldn't give me a service request 30 day wait. Hope you hear something soon.

I to just hit my 5 month mark, just called for a service request the lady told me I had to wait 30 days because they are not officially late yet. they said the vcs are currently working on January 16th k1 visas, I did not ask to talk to a tier 2 representative, this may have been a mistake. I guess i will give them tell next week. anybody have any ideas on what i should do from here or just wait, or call back and try to get a tier 2 rep. there seems to be a lot of visa's around the February 14th that got skipped. any info or ideas would be appreciated.

    They told me the same thing today...i guess we are in the same box.its heartbreaking everytime i tell my fiance but she understands so we just gotta keep praying..waiting another 4 weeks

  8. thanks guys.. i guess i'll wait till 6 months or more likely to call later haha its just depressing to know you have to wait even longer. i mean im an american i have to speak up i know my rights haha i'll try to call tomorrow and speak to a tier 2 but if you said wait it out i guess i should. i guess it depends on how i feel. thanks for your inputs though much appreciated..

  9. So i just called the Customer Service Center. I was polite and didnt go off on the Tier 1. I called a week prior to my 5 months because i was curious that March k1 were being approved and i was left behind. The Tier 1 i spoke to prior told me to call back on the 14th when it hit my 5 month mark so i patiently waited 2 weeks. ok now i just called Customer Service today, the Women seemed like she didnt want to work but i wasent ####### or mean i told her my info she told me to hold so i did.she came back and said well the service center that your papers are located is backlogged and Vermont is doing January 16 petitioners and wont do the service request.i was in disbelief because im always on VJ looking at approvals.anyway she told me to please wait 30 days and call back. Im a patient person but its starting to get irritating knowing you cant do anything. im thinking of calling again to speak to a tier 2 because i totally forgot, i was just anxious at the time.Well im thinking of contacting my senator today or calling back again.i dont know im losing patience. Sorry guys im just venting haha i know everyone gone through this and even had a longer wait.your inputs are much needed..

  10. yeah we must...I really hope the best for you..this not knowing is so hard....i have been checking my email every five minutes...dont forget if you want...they can send you service request update by email,you just have to ask...

    thanks..i'll for sure ask them for an email..i agree and plus its even harder looking at the VJ knowing people in March,April and May surpassed you and been approved NOA2. we just got to hang on..patience is a virtue but its running thin..hahaha i guess it taught me to be patient and it test my relationship if you look at the positive aspect of the wait..

  11. yes i asked to speak diectly to a tier 2...she was helpful and said we would hear somehng soon...its een hree days d nohing, but maybe just ove anxious...please let me know how it goes fo you..

    thanks for the info..im nervous for some reason to call tomorrow they told me to call back on the 14th so im going on what they told me because i called a week early.i dont know its horrible i dont even know if i got a RFE or anything its like walking in the dark without my glasses haha..well in the older post some people say its real quick to hear something on a service request 2-4 days and sometimes its 2-3 weeks to hear something..so good luck to you..we must be in the same pile.hehe

  12. Well it has been three days now since our service request has been put in to VSC....Still no news...Has anyone ever had this done that can share with me their experience? Monday the 11th was our fifth month...

    I can understand the stress i too have to wait till tomorrow to call because its my 5 month mark and no word..we were the unlucky ones in the bottom of the box..by any chance did you talk to a tier 2 rep for your service request?

  13. so frustrating...call uscis the day it hits 5 months...ask for a tier two rep, you will be transferred and then ask for a service request because you are out of your five month time frame...they will send an email to VSC, and then give you a reference number for that....she told me I should hear something in the next week..good luck to you!

    yea its very frustrating i should say its pain and suffering for us that waited 5 months to hear if its an approval or an RFE hahah i just noticed too that online my date is feb 14 but on the letter they sent in the mail it says 16th im confused o well 2 more days until i have to call..

Same here im a Feb 14 filer and i called a week early to check whats going on they told me to call back on the 14th so in 3 days this thursday its stressing me out hehe..and im hearing CSC people complaining about getting there NOA2 approval and still waiting to be sent to NVC.. sheesh they got approved way earlier than us in 3 months i believe.They should be grateful..o well trying to be patient..GOOD LUCK TO ALL FEB FILERS that was left behind! love you VERMONT! hahah

  15. I'm wondering whats going on with the Feb 14 2011 k1 filers? I seen two that has been approved but did they skip over the rest of us? im not complaining just curious the wait is stressing me out! hehe.. We'll find out any day now just trying to keep positive and sane. like everyone says on the site PATIENCE IS A VIRTUE..GOOD LUCK TO EVERYONE!! i might have to give a call to mr/mrs senator haha
