  1. Just got an RFE on my I-485,

    Apparently when i entered on my K1 visa my original medical forms (DS-2053, DS-3024, DS-3025, D-3026)WERE NOT FORWARDED BY THE DEPARTMENT OF STATE. They have my immunization record ( I sent a copy with my I-485) but original medical and vaccination records are required. I am now requested to complete a form I-693 and have my medical completed by an approved civil surgeon.

    so basically does this mean i have to have another medical done here? obviously I am quite annoyed as I paid a lot of money to have my first medical done.

    Does anyone have any experience with this and can advise on what i might expect next?

  2. HI everyone,

    I'm currently waiting on AOS from a K1 visa. I filed in September 2011 and it has now been over 4 months. I called uscis today to put in a service request because i was working on the assumption that 4 months was the normal processing time. This is what i was told..

    1. my case is being processing in Jacksonville Florida

    2. This field office is now processing applications filed in June 2011

    This seems strange to me because I received a notice in October saying that my application was transferred to the California Service Center and have not heard anything about my application since then. So was it transferred back to Florida?? or did it never leave??

    Also if the Jacksonville office is processing application from June 2011 this is over 7 months wait time!!! that seems really bad.

    Anyone have any advice/suggestions???

  3. Hi everyone,

    Latest battle with AOS... I am driving with my Australian drivers license because I can't get a U.S. (Florida) license until I receive EAD. This is fine except I have realized that I'm not covered by my husband's auto insurance. We tried to have me listed on the insurance but the company we use wont list drivers without a U.S. license. I drive the car everyday because my Husband is deployed overseas and we live in an area with zero public transport. I'm really stressed about the possibility of an accident and no insurance.

    Has anyone dealt with this before and can possibly recommend an insurance company that will cover foreign drivers???

  4. Thanks so much everyone for your advice. It seems that I probably won't be able to get my Florida license till after EAD, I don't think that will be anytime soon as I don't even have a biometrics appointment yet. I had thought about renewing my license when i was last in Australia but due to various complications I wasn't able to. I am able to renew my Australian license from overseas though so i will just do that (i was hoping to avoid the additional expense when I will need to change to a US license in a couple months anyway). As far as driving in Florida with a foreign license I think this should be fine. I understand that when you become a Florida resident you are required to change your license within 30 days but i don't think I am considered a resident while AOS is pending.

  5. Hi everyone,

    I have come across another problem. I have applied for AOS from a K1 visa. I have the NOA1 but that is all. I am currently driving by using my Australian drivers license but this will expire in about 3 weeks. I want to apply for a Florida drivers license and have some questions for any other Florida residents:

    1. Am I eligible for a Drivers License as I do not have EAD or greencard (my K1 will expire in about 3 weeks) ?

    2. do I need to take a driving test or can I exchange my foreign license?

    I cannot go without a license for any period of time as my husband is currently deployed to Afghanistan and I have no other transport options.

    Any help will be greatly appreciated.

  6. sorry i don't have any experience with VIC. I had mine done in NSW, which involved no wait. I just turned up at the local police station. before that though i had tried to do it in the ACT and that would have required waiting a month for an appointment. Luckily my parents lived in NSW so i was able to arrange it that way.

  7. Thanks so much everyone for the advice In answer to your questions....

    1. We asked for the K1 expedite after we had already been waiting about three months. The NOA2 came about a week after the expedite request. I knew we were due soon but didn't want to risk waiting in case we were one of those unlucky folk who don't get approved in the normal time.

    2. We don't want to wait any longer than we have too for AOS, for peace of mind i'd like to have it sorted.. i also will need the work authorization and the advance parole asap and its easier to apply for everything at once.

    3. My fiance's family live far away and we have both only just moved to where we will live (he was previously stationed overseas for the last 3 years)so i wont really have anyone else i could ask to drive me.

    4. We will live in northwest florida... the closest office for biometrics is in Louisiana though... that's just the closest big city... about 5 hours driving.

    It sounds like the interview might not even happen so i'll stop worrying about that until i have too. And it looks like we should be able to have the biometrics taken by mid September so i'll just have to be organized and get my AOS documents ready to post as soon as we are married.

  8. Hi Everyone,

    I'm getting ready to enter the US on a K1 visa. After my fiance and i marry we will only have about a month before he leaves for a six month deployment to Afghanistan. I will be applying for AOS as soon as we marry. I have been reading the guides and i think i have a good idea about the forms etc. what i am concerned about is the biometrics and the interview. I have looked up on the USCIS website to find out where my closest office is for biometrics and this is Metairie LA (about 5 hour from where we will live) and the closest local office for the interview is Jacksonville FL (about 6 hours from where we live). I am from Australia and only just getting used to driving in the US and not at all comfortable driving this far on my own. So i really want my fiance to be able to take me.

    So i am wondering can we expedite because of the deployment (we already expedited the K1 so i am a bit experienced with expedite requests already) and if so would be able to have everything done in this tight timeframe??

    also am i likely to need an interview? and if this is waived would I still need to go to Jacksonville to get the stamp (i have read something about still needing a stamp).

  9. Hi, i had my medical a couple of months ago and the doc said he was sending the paperwork direct to the consulate. This was before i received my NOA2 so i didn't have a case number yet. I am a little concerned as to whether the embassy will match up the medical with my file when they receive it, or is there a chance it will be lost somewhere. Does anyone have any experience with this issue... or advice??

    just wondering how much evidence is required by the sydney consulate for the I-134. specifically what have people been including for proof of income/employment? also if the petitioner meets the income requirements is it necessary to include further evidence of assets such as letter from bank etc?

    I am expecting my NOA2 very soon and so I am having my US citizen fiance prepare the I-134 affidavit of support. I am confused about how much evidence needs to be included with this form. my fiance is employed with the military and meets the income requirements. Is it enough to just include pay slips/letter from employer/tax return???... or do we also need to include info on assets and if so what exactly is required? he has limited savings and no significant assets other than a car. I have noticed that the sample form on visajourney only includes details on income and home ownership.

  12. Hi everyone,

    My fiance is in the US air force and is expecting to be deployed around July 2011 for 6 months. He doesn't have orders for deployment yet and based on what he is hearing it is unlikely he will receive the actual orders until about a week before he departs. We are considering requesting an expedite so we could have the option of marrying before he deploys (we filed for the K1 in February). It seems very unlikely we will have time to do this if we have to wait for him to receive orders.

    Does anyone have any experience with requesting an expedite prior to receiving orders?
