  1. Hello all, my husband (UK Citizen) and I are visiting family here in London. We married through the K1 process and our I485 is still pending. He lost his wallet containing his AP card. Speaking to the embassy, they said we must refile the I-131 for advance parole and hope it gets to him in time for his flight back on 4/11, I'm flying home tomorrow. My question is: Has this happened to anyone before? If so, how long was it before you received your AP card in the mail? Is there any other course of action? Any advice would be greatly appreciated!

  2. BTW, I asked my hubby and he said we actually called USCIS about the deadline for AOS before my I-94 expired and they said that I wouldn't be out of status because we got married within 90 days of my arrival but that we should file for AOS as soon as possible. Come to think of it, I do remember that call because I was very distraught and thought we would get in trouble if we filed after my I-94 expired.

Thank you so much for your responses! This whole process is so overwhelming and it's hard to know if you're doing it right. I really appreciate all of your responses! We just take things one day at a time, and feel so blessed to be together!

    Thanks again :star:

  3. Hello all! My now husband has been in the US since January. We got married March 28th, 2012 under the K1 visa, within the 90 days of his I94. We've had a few setbacks so we have not been able to file his AOS. We are going to file at the end of August. I am curious to know if I waited too long to send this information out to the USCIS. Is he considered illegal at this point? Do you think we will have any issues once the information is sent to the USCIS? I've been supporting both of us on my salary alone, he hasn't applied for a SSN nor has he been working.

    Thank you in advance!

    Jenny

  4. Oh I would be so mad! He should have foregone the fun in Amsterdam until after the medical. Having issues with drug use at your visa medical is a big deal.

Anyway. As previous poster said, they do ask. It's up to him what he tells them. It is a big risk if he lies when it might still be in his system.

If this were me...I would hold off on the medical. It doesn't have to be done prior to the interview but the Visa cannot be issued without it so it would hold things up. I guess it depends on how much of a rush you guys are in?

    Good luck!!

PS: It doesn't make a difference that the Laws are different in Amsterdam.

Thank you Helen, I do understand the implications of his actions! I feel like I'm being lectured by my parents right now :bonk:

We are waiting for the copies of my paperwork to arrive in the UK and then he will schedule the medical. I don't think we will have to worry he was there several weeks ago & from what I am reading it goes out of your system in just over a month. Cheers! :star:

  5. Hi VJ'ers I was wondering what exactly gets done during the medical exam that has to be done before the interview. I know my fiance will need to bring his vaccination records, but is there anything else he needs to be worried about? Also does anyone know if they do drug testing? He recently returned from Amsterdam (enough said there)

    Thanks for your reponses!

  6. Hi all, we got our NOA2 today for the K1 fiance visa! I was wondering if anyone else has already gone through this procedure at the London Embassy. If so, can you please tell me how long it took from the time you received the NOA2 to the time you were granted your visa. I am going to London in July it would be great if I could either attend the interview, or even better if I can take him back with me. Thanks in advance! :star:

  7. @Lari and Johana.

Interesting, I called USCIS today, I just hit the 5 month mark, she put in a service request and told me to call back in 30 days if I haven't heard anything..Yet she told you 60. Not surprising that we get conflicting info..I wonder if the lady I talked to was just patronizing me..Yes it definitely feels like this is the hardest part of the process, being past processing time and seeing people before you getting theirs. :Sigh!:

It could also be that the processing time @ CSC is shorter, so it was in the time guidelines to put in a service request. When I hit the 5 month mark, I called the USCIS & they told me 60 days as well. :bonk:

  8. BTW.......

Being the true psycho that I am.... I constantly check the oct pg just to see how far along they are. They seem to be going through the same level of frustration us VSC filers are going through. Below if a post I C&P from someone who wrote their senator... So lets def wait till after six months, just my opinion.

    Dear fellow October Filers,

I have, after 5.5 month mark, decided to get the whole Senator shenanigans started to see if it would help at all. Though I think there is not much we can do to get it done faster than the VSC capacity, i thought maybe a lucky touch via this request may turn into a NOA2, but no! I got the standard answer.

    " Dear Ms. Ak....,

Thank you for contacting me with your questions regarding the I 129F petition that you filed with the United States Citizenship and Immigration Services (USCIS).

USCIS shows that your petition was received on October 26, 2010, and is pending adjudication. Processing time for this form type is 5 months. Processing times for specific applications and petitions at the Vermont Service Center (VSC) are provided on the www.uscis.gov website and are updated weekly. Based on fluctuations and variables that impact the processing times and for the purpose of interim or final adjudicative processing, the VSC allows 30 days beyond the posted date before the case is considered "Outside of Normal Processing Time" (ONPT).

An additional 30 days must be allowed for adjudicative review and processing before USCIS can request expeditious processing based on an ONPT request. If the application or petition is still pending after 30 days, in this case after April 26, 2011, and you request expedited processing at that time, the case will be forwarded to the applicable adjudicative unit for their review.

Again, thank you for contacting me. For further information or to sign up for my newsletter please visit my website at...... "

So, I guess this means after the 26th, I will have a right to expedite, or is it just a comforting thought they are trying to implant me, to make me feel better and shut up. We'll see...

Thanks so much for that info. What's another month when we've all been waiting 5 months already! :bonk:

  9. It has been 5 months and 1 day today and I finally got someone on the phone from USCIS. They told me since my case was still in the "normal processing time" that I can't even get an inquiry sent to VSC for another 60 days! Gosh this is driving me up the wall.... is this the time when I can contact my representative or do I need to wait 60 days to do that too? I hate how my whole life has to be on hold just because my fiance isn't American!!!

  10. hi all novembers filers, i recieved my NOA1 on nov 3. hope we can all get someowhere, its been already 4 months and to be honest i've been going crazy, its not easy to want to be with someone and wait so long for it to happen, but im just hoeping for the best, we are next alright! every let keep posting, and good luck to all of us! John and Geannette forever <3

I know the feeling, it's terrible! Best of luck! :star:

  11. i went directly to my congressmans website and there they had a section "constituent services" and underneath a section "help with federal agencies" and on that page it told you what u needed to do. it involved mailing or faxing a privacy release for with your details about your case and concern.

call your senators office directly if there is no form on their website, they should have a protocol and you dont want your email getting lost in a sea of general concerns

Ok great thank you so much~! :star:

  12. You just gotta keep telling yourself you are only waiting a short while to be together for the rest of your life!

I do know what you mean though, it's been 4 long months TODAY. I have also found there is no fairness when it comes to this process. One member *MET* his fiance online in December 2010, met in person and mailed the I129F in January, and got approved in February. There's absolutely no fairness in that.... I had already filed my application before these jokers even knew the other exisited!!!! I know the blame isn't on those people, but on the service center. If these applications only take 15 minutes, why is there such a back up??!?!

  13. Guys I got my NOA2 today! I went through a tough twin pregnancy and my babies were born on Valentine's Day and now this? I'm beside myself with happiness. I snatched up my babies and told them daddy was coming. It brings tears to my eyes just to think about him holding them for the first time. I wish everyone a speedy approval so they can be reunited with their loved ones and thank you!

    YAY Congrats!!!!

  14. I am so glad I found this website! I was wondering how long this whole K1 thing would take, but I'm glad to see it's not just me that's been waiting what seems like forever just to hear a peep from the USCIS. Best of luck to you all, I'm glad there is a community out there that's in the same position as me. Patiently waiting on my NOA2 :star:
