they waived 360 for me but i have to pay 485 which is more than 1000 but i do have a friend she has a kid and she didn't pay anything for the vawa she has already got her green card

Sissy, u have never applied for i485/i765???

If I'm not mistaken u need to apply for both together the 765 is gonna be based on the pending 485. (not totally sure)

U don't need a lawyer, I did my 765 renew by myself... I just posted the directions 2 pages ago...

When filing 485 be sure not to contradict yourself with the I 360. Good luck!

I had a report from the emergency room, chest pain .. letter from the doctor I have been on antidepressant since 2008 .. Letter from the women in distress therapy I have been 31 individual section ... do I need psychological evaluation?

yes that will help alot you need a counseller after visting a couple times he will write one for you

The approval letter was dated October 26th. I had already filed the i485 and i130 so i guess i'm waiting for a interview date.

hey we are about the same time, my was approved on october too, i filed 485 together with 360,have u had fingerprint yet? i didn't hear anything yet,my lawyer think it will be in januray,by the way do you have a485 receipt number,i called uscis they asked me for 485 receipt number, did any one how i will get that? will they mail to me after 360 was approved.

hey everyone, im new in here and i have really big problem. hope someone can help my VAWA case.

i filed my VAWA on February 2011. After 2 months i got a Prima facie determination and they also gave me the EAD card around August. But on Sep 22, they sent me addition request of evidence. They need me provide my husband citizenship information (like passport copy, birthday of cert etc....) but unfortunately my husband disappeared a year after i got the order of protection for criminal court. nobody can find him (even police,lawyer and private investigator).

i dont have much information about him. i just only have his SSC, driver's license no., but they all cant help me to prove his citizenship.

Anyone know how can i get what citizenship he is?

well,don't worry, i had experienced almost the same thing as you do. the day i left my ex i called the police and they came over. my fiend picked me up and took me to the shelter. i never thought i can apply for my citzenship i thought i went just go back to my country.but the shelter heard my story and help me to get charity immigration lawyer and started vawa, i don't have his bithcertificate or passport copy. my lawyer asked me to prove his citzenship i can't . i went to court to get a policereport and later i got a protective order. my lawyer said that is enocugh.because on the police report says he was born in us and he is white and the immgration never ask me to prove his citzenship.praize lord my case was approved now. best wishes

Sorry but I dont think so. But u can still apply for t or u visa. Ask your laywer or google it. Good luck...

hey qizq, i think yon can apply for u visa as long as your marriage had abuse evidence. you can find some charity and their lawyer are free and nice .they can help you

well i got requesting addtional evidence. it was about criminal background check since i have 2 names both chinese and english. so i went to court and get that. in addtion, my abuse story has liitle diffence with my frirend letter that she worte. we clarified on that and i got approved after 2 month and a week. best wishes for you

they never asked me either, but now is diferent situation in my case with the work permit

is good to wait, at least you got the I360 approved that is the most important, i either know what is mean to wait and wait, we need to have passion, you almost got the papers, 4 months plus or minus after all this i guess is nothing

Lucy, are you trying to link your old I 485 or did you apply for a new one?

You do not need to wait for vawa approval to apply for 485, they can be filed Concurrently...

if you haven't filed yet you will have to wait 4/5 months for the i485 interview...

i dont want to bother them, that's why i did not call, i prefer to wait, i applied for work permit , it was approved on 31 august, send it on september 2nd and i never got it, reason.....usps lost my envelope...i call uscis national center and they put me to apply for replacement...that's mean to pay 380 dollars, i applied and i will go for fingers prints next week, but it is the first time after 2 years asking me for fingers print, they always aproved my work permit without fingers prints

regarding the fingers print for I485 we will do it after we will get the I360 aproval , never before

thank you juilia for your time. my employment card they never asked for a fingerprint. my laywer asked me to wait for a while. i think i just should wait. i have a friend and she got her fingerprint after i 360approve 4 month .that is like really long

Lucy you should definitely call uscis, fingerprints are the first step after applying for i485...

I-765 FINGERS PRINT IS SMOTHING DIFERENT THEN I-485, BECAUSE I765 IS AUTHORIZATION WORK PERMIT AND I485 IS GREEN CARD , YOU NEED TO TAKE BOTH OF THEM UNLESS YOU DID NOT APPLIED FOR AUTHORIZATION WORK PERMIT

I APPLIED FOR VAWA IN AUGUST 2010, I GOT RFE IN JUNE 2011, I RESPONDED TO THE RFE IN AUGUST 31ST AND I AM STILL WAITING FOR DECISION ON MY CASE

i applied the employment work permit, my card is still valid until august 2012. anyway i never get any appointment for fingerprint,have you done fingerprint already,thank you for sharing with me.

I applied in August last year (2010) and also got an RFE in May (2011). I responded to the RFE in August, 2011 and I am still waiting for an update on my case. I guess my question is when did you respond to respond to your RFE and how long did it take before u got a decision?

one week, which is pretty fast.i think you will hear something by next one or two weeks. it will be good news

yes i applied AUG,2010 they need more evidence inMAY, now i just got approved. i applied 485 together with my i360. so it should be soon for the fingerprint.

Hello giveusfree, vawa processing time can be tricky.Some get thier approval in 3 months,some 5 months ,some like me was after 7 months,some been waiting for a long time.Its not bad news or good news either .One need to have patience and not to worry becuase it can cause more stress and anxiety than what you have already gone through.

Lusymiss did you file i-485 and i-360 @ the same time.I had filed for vawa and i-485 at the same time and within 30 days I received a letter to go for fingerprints. Fingerprints appointment letter and interview letter are 2 different things.Wish you all the best and everyone.

Hey Lucy, I think you only have to do fingerprints if you apply for i485/i765. Interview is after your vawa has been approved...

Hello everyone, I hope everybody is doing ok. Congras to those who got approved lately. It has been a long time. I was going back and forth with uscis about my case. Those of you who don't kno me, my vawa case got approved back in June and removal terminated back in august. For some reason I never got any interview notice since the judge terminate my case so I took an info to find out what was going on that was back in the middle of sept. . At the infopass,i was told that my case is seating at the record room. The lady told me that normal when the judge terminate ur case thy send it to record room, i said what? But long story short thy told me not to worry about it that I'm going to receive an interview in 2 wks, that was like around the begin of sept.. 2 wks passed nothing, took another infopass.guess what I was told thy sent my case back to lee summit supposedly cuz the case was adjucated already, I told Them i never received no interview no green card nothing. I was told to wait for another 2 weeks. for them to order my case bck, they finally got it back sept.26. Weird thing thy sent me fingerprint notice that had my old i-485 receipt number, not the one file with the vawa, and also my lawyer told me yesterday about the interview notice for oct.27 @ 8AM. My question is why did thy send me fingerprint for my old case that was already denied? Any response will b welcome. Good luck to everyone

hey Lucymiss, i think ur divorce attorney can only represent u only in court & not both of u.All u need do is have them file the divorce and a copy/waiver will be sent to ur husband to sign & notarize in case of uncontested divorce.He doesn't have to be present in court unless he wants to & wants to contest.If he signs the waiver & agree to divorce u, them the judge will grant u a divorce with u & ur attorney in court & a certified copy should be requested & kept for future use.If u want to change ur name, u must also request it in that divorce letter unless u want to keep answering ur husband's name after the divorce.Make sure the attorney u r using is a divorce lawyer cause ur story looks like the attorney u r using have no divorce experience.Goodluck

when they request for more evidence, it was changed into reqesting more evidence. they asked me ref for more abuse evidence

I'm new here but have been lurking around 4 a while & in the same boat as everyone.I filed I-360 in April,2011 & received RFE in May for Good Faith Marriage & Police clearance,Submitted both in July.Up til now, i haven't heard nothing.My attorney said she's waiting for an approval notice when i 1st spoke to her, then she called and said she inquired from them and that i should be expecting a biometrics appointment letter soon instead-she said it will take a week to a few weeks.Is this normal,do u get biometrics appointment before I-360 approval or is my attorney holding the letter b/c i still owe her some money?I'm tired of the wait.I never knew about vawa,i would have filed a long time ago before my divorce.I only found out after i was divorced but happy it was b4 the 2yr divorce limit.

well i have a friend and she got approved first and then got the appintment she told to me it was very easy take 10 minutes

Yup, i waited that long. While I'm waiting for my approval all i did is to focus on taking care of my health, imo that saves me from going insane:wacko:

I went through the same, do not be afraid, they asked me twice for RFE, once right after i send the i 360, 2nd time after 5 month, as soon as I send my papers back whatever they were asking after 54 days i got aprooval.

Just be patient, it is the hard to go through, but we do not have choice......... good luck

54 days is not too bad I have already sent to them ref almost 2 month ,hope i will get the answer soon
