  1. Hi Vj members

    I have CR1 and my child has a CR2 is 19 yrs old, and outside US with REP....what happens to his status when I file for VAWA?

    and does his age "freeze" to the age I apply to vawa or to the age he is when approved? (hopefully approved that is....)in case the processing time takes long and he will be 21 by the time vawa approved?

    any recommendations to good vawa lawyer or pro-bono firm?

    I've read here on several posts that sometimes after interview there is more processing that can take several months

    However I understand that the I864 (and medical and pcc?) are valid for a year and have to be valid while entering the US

    and, that IV visas are issued for 6 months once stamped in passport.

    so all this does not quite add up....if the I 864 was signed and sent to NVC several months prior to interview, and if after interview there are more delays, that could also take several months, and then a visa is stamped for 6 months, than the I864 will not be a year old while entering Us, but older.

    how is this settled? is a new I864 required during the delays?

    is the visa stamped to a lesser time than 6 months? has that ever happened?

    or is the rule for one year validity is only from the time the visa is stamped and not from the time the I864 is signed?

  3. I forgot none of my close family members have been ilegally in the States.

    We have a cosponsor since my husband's last year income was not enough, but this year he's got a better job and makes enough, anyways we had a cosponsor just in case he was not approved.. and the cosponsor makes way beyond the poverty level.

    We are having our interview next month and God I'm stressing out already...

    Right now I'm collecting as much evidence of a bonafide marriage as I can...

    We have a lot of pictures

    We have notarized affidavits from my parents and my husband's parents about our bonafide marriage

    money receipts from the time we've been apart (he's in the States I'm in Mexico)

    phone logs (this is our primary way of communication)

    e-mails

    chat logs

    cards from him and his parents and the ones addressed to the kids

    and as we met as volunteers I have newsletters and ID's from the time we were doing missionary work

    Is there anything else we could get to make our case stronger?

    Please I need your input :)

    I'm kind of freaking out!

    you said you have children together, bring their birth certificates, this is good evidence for bonafide marriage

  4. it happened to us too, sometimes it takes them longer to put it in the system . The 20 days period is 20 business days, not including weekends and holidays, and only after it is in their system, so it's actually more than 20 days.

    If all that has passed and they still don't have it you can ask to speak to a supervisor. if they send to a supervisor review it is 10-15 business days. another option is to contact congressman for an inquiry

  5. Format of original A# given to me: A### - ### - ### (9 digits, not including the A)

    New A# on visa: A######## (8 digits, not including the A)

    Just a thought, perhaps these are not both Alien numbers since one has 8 digits and the other has 9 digits?

    maybe the new one is number for the visa , which is something completely different?

    i had my CR-1 visa interview on 14 may 2010, got finger printed and the counslar officer returned my original birth certificate and original marriage certificate. She asked me to sign DS 230-part 2 in front of her. Then she asked where in US my wife lives. Then she asked when i planned to move to US, to which I answered as soon they give me visa, i shall make my travel plan. Then she asked me what I am gonna do in US? to which I told I would be seeking role in mechanical engineering industry. She asked whether I had my CV, I told her I didnot have it with me right now. (They never told me to bring a CV to visa interview!) Then the counslar officer gave me a blue letter saying i am put in Administrative processing and Asked me to FAX my CV to a number she wrote on back of this blue letter. But she kept my passport.

    HUH...... so guys any Idea what the hell should I take from this?? I am so sad now as I knew people are put in AP but being in AP myself feels so bad.

    what should I do now or how long should i wait and what could happen next and when?? anyone with any ideas please help..

    I believe the AP has to do with TAL check,Technology Alert List this is for electronic engineers, they ask for a CV from Engineers, and run AP for it, nothing to worry about, it is standard process for engineers

  7. we also got the same answer, wait 20 days (business days), but looking back I wish I did contact congressman, sometimes it helps a lot to move things, in our case they lost some documents and we had to send them again, it took them 2 weeks just to update they received them, and then another 20 business days to review them.(at that point, they did not review even that 20 business days have past, so the operator said she will send it to a supervisor, but that also takes 15 business days....lol, finally after 8 days at the supervisor they completed!!) Maybe if at any point we asked the help of the congressman maybe it would have gone faster and we wouldn't have to wait..

  8. Our case is at NVC right now and is complete.

    At the time when we filled our G325 for the petitioner- my husband- we consulted with our attorney (that later on has made several mistakes and caused us delays and RFE's) on how to fill out the forms and told her he has 2 current addresses since he is establishing businesses at two states and going back and forth. The paralegal working with us told him to write just one address because it would only confuse them if there were two addresses and they would not know where to send correspondence to. So that is what we did. Later on we submitted the tax returns to NVC but these have the other address...

    The g325 has x address and the tax returns havs y address which was not mentioned on the form

    Now, after seeing that she made several mistakes along the road, I am questioning her poor advise and I am concerned that this would be an issue at the interview.

    Ofcourse I can explain this to them, but the fact still remains that the form is not filled correctly regardless if it was due to bad legal advise...

    Is this going to cause problems?

    Is there any way to fix this?

    should I bring a new form to the interview?

    your suggestions would be appreciated
