  1. Dipu and I had his interview Wednesday morning. Dipu was asked to take the oath, sign the DS-156K form and was asked these questions:

    1) Who am I (addressed to Dipu about me)? Answer: I am the petitioner.

    2) How did we meet? Answer: Met at work when his company was taking over work from mine for outsourcing.

    3) Have you ever met her parents? Answer: No, but I met them over Skype a few times. I have met her grandparents in person last June, Father's Day weekend.

    4) How many times have you been to America? Answer: Twice

    The CO then said that the case is in adminstative processing. Then he asked if either of us had ever been married and we both said no.

    Then the CO said go to the next window and the lady would explain AP to us. He kept Dipu's passport and returned all documents including evidence and original certificates. The CO kept the medical report but the X-rays. The CO also kept the passport clearance certificate.

    When we went to the next counter, the woman gave us a letter that had already been printed prior to our arrival at the CO's window that stated:

    Please bear with us while your case undergoes mandatory administrative processing.

    We have retained your passport to more quickly process your visa when the processing has been completed. When the processing is complete, we will send your passport and visa to you via VFS.

    The woman did not give us any details as to why we are in AP or how long we could expect it to take.

    Dipu said when we arrived at the CO window, he say the Mandatory AP letter and the 221g form already filled out. When the CO saw me and spoke to me, he discarded the 221g form. We were most likely placed in mandatory AP because Dipu is Muslim and is from Assam which has a lot of militant activity.

    Other people were hammered with questions and we saw a denial, a few 221g's and one aprovoal. Hope this helps!

    Also, intimidating..hmmm. Let me check of I can be with my fiance at time of interview, which is more unlikely here. We both are from same region in India and our families and we both have met couple of times already so should not be a trouble but nothing is gurranteed when talking about visa.

  2. Ask your friend what makes you so special that they would allow you to interview earlier for the sake of your convenience. Not going to happen...not that you can't try. They would only move up the interview in the case of some extraordinary emergency.

    Ditto on the reply above. Change your trip to accompany her. I was with my fiance on Wednesday. A 221g slip and a mandatory AP letter were pre-printed and ready to be issued. The CO saw me and threw away the 221g. The mandatory AP was still issued (probably for religious background check) but the CO gave us back all original documents except passport, passport clearance and medical reports. Very few questions asked. Your presence at the interview, while expensive, may very well speed up the process and make the questioning significantly easier.

    Also, if your fiance doesn't have awesome English and is likely to get confused by questioning, especially when nervous, your presence will help with that.

    Lots of stories lately from India with unhappy outcomes.

  3. Thanks TBone & Beck! I asked my friend the same question.."What makes me so important?"...for that their reply was "you can atleast try" and for which I was not sold and thought to have opinion on forums.

    Regarding my visit, It's official and I don't have any vacation days left to take to be with my fiance at time of interview. I'll be on business visit for a week, packed with lods of meetings but also will be meeting my fiance in same time.

  4. My fiance is scheduled for K1 visa interview in September and I'm visiting her in later this month. One of my friend told me to go to consulate and request them to pre-pone interview so that she can accompany me back here. Should I follow their suggestion?

    Is this some valid option?

    I'm confused here, I don't want to mess at this crucial stage of processing esp. when I waited for an year for this....

    Looking forward for real good advise.

  5. DONT WAIT, I never received my packet 3, If you are applying in New Delhi then just download the forms then US embassy's New Delhi's website (DS 230 and Applicants statement form) fill them and email them along with the photo....please dont wait its a complete waste of time.... do this ASAP.

  6. We got a RFE too. The hardcopy arrived today, and it's something simple. My fiancé forgot to answer the question 2, part C (Page 3) of the from I-29F.

    Part C. Other Information

    2. Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes:

    * Domestic violence, sexual assault, child abuse and neglect, dating violence, elder abuse or stalking. (please refer to page 3 of the instructions for the full definition of the term "domestic violence.)

    * Homicide, murder, manslaughter, rape, abusive sexual contact, sexual exploitation, incest, torture, trafficking, peonage, holdng hostage, involuntary servitude, slave trade, kidnapping, abduction crimminal restarint, false imprisonmet, or an attempt to commit any of there crimes, or

    * Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

    Anyway, the answer is NO, simple as that. He is sending the response for the question on Monday, Apr 25th. They say they can take 60 days to approve, but we gope to get approve earlier than that. :)

    Apparently, We got RFE for same. Our case was initially approved by USCIS and sent to NVC. It was NVC that returned case and gave us hiccups as what could be the reason for recall.

    Day before yesterday I received RFE in mail with reason and mailed them back with answer, ofcourse, "NO", yesterday. Hope all goes smooth and fast now!

  7. Latest update: Senator checked for me with USCIS and got back with information: "Petitioner missed some information. RFE to be sent in few days". Atleast some information now! As far I remember I followed all steps and procedures mentioned on uscis.gov and visajourney.com/guides to fill my application. Lets see what information is missing when I get RFE from USCIS.

    How long it usually take after I send them requested information to complete and forward case?

  8. Hired an attorney and day after attorney submitted letter on my behalf got this in email:

    Post Decision Activity

    We reopened this I129F PETITION FOR FIANCE(E) on May 10, 2011, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

  9. I guess this is new thing that USCIS found to harass. This is exactly happened with us but only difference was we got our approval with much longer wait of 6.5 months. I hired an attorney to look into and check with USCIS. I found this after consultation with Attorney that USCIS better responds with attorney than individuals, so they won't give you any credible information or you are allowed to open service request till 120 days are over. Really frustrating.

    I would advise you too to check with attorney if he/she can help you. Better not wait and start taking actions on your part now only.

    On April 27, 2011, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    What is this?

    What should be my course of action now?

  11. I have been through this twice.. two times NVC sent my case back to USCIS for review. On second time we got senetor's help, and it helped a lot.

    Usually it is some mistake or not enough information passed by USCIS to NVC so they send it back. Sometimes it is a red flag that NVC noticed and they want USCIS to review it.

    So basically your case is back in NOA1 stage. You will have to wait for few months to get your case reaffirmed or revoked. You can get senetor or congressman's help to get the info.

    And dont worry about your Petition expiration date. They will extend it once they reaffirm your case.

    Hello yajakass...what kind of help did you got from senator? Had you scheduled an appointment with senator and then walked senator thru? Please provide me details, as my case also sent back to USCIS. I haven't received amended NOA2 yet but can expect sometime soon. I did contacted my state's senator on this and his staff asked me to check with her on Friday. Will this be sufficient? You can sense lot more nervousness and frustration in my writing. Also, if possible let me know how long did it took you to get approval after review and what other actions you took along. Looking forward for your reply. Thanks in advance

  12. Don't know what is happening as none of the agencies are sharing any information. Both are pointing me to other. Called state senator and his staff told me to check back on Friday.

    Could this recall revoke my approval and get me denial?

    I'll wait for week or two after Friday and might go to India and eventually get married and change application. WOW, I'm back to zero now, really frustrated and will have to wait for another 8 months now.

    Any other suggestions? Does checking with attorney before actually marrying is a good idea?

    Thanks @hobokenworkingman for suggestion for scheduling a visit to local USCIS office. I's also considering same and will do after Friday now. Thanks again.

  13. Today, I called NVC to check status for case and got this shocking update: "Immigration recalled case" and it's on its way back to USCIS.

    I was so happy that after much longer wait (6.5 months) our application finally got approved but this shattered all my excitement.

    Called USCIS regarding same and Customer Rep told me to wait for 120 days after USCIS receives case back. What the heck is this? Totally frustrated and tensed now.

    I don't know how to react to this. Could please some one tell me what are my options now?

    Can I ask my Fiance to apply for Tourist visa?
