  1. Hello,

       My sister is currently on a F-1 visa and pursuing a PhD. I would like to file an I-130 for her. She is from Bangladesh. However, I am confused about the following:

    • Will this prevent her getting a H1-B visa, if she were to apply for and get a job once she has completed her education?
    • If she gets married after I file the application, will that void the original application?
    • My parents are green card holders. If they apply for her, does that put her in a higher family category? Will she be eligible for a immigrant visa faster? Will getting married affect her application in this instance as well?

  2. Hello! I am new to this forum and would really appreciate your help. I am a US Citizen and got married recently (December 2010). My wife is a F-1 student (with a SSN). I am am filing my taxes using Turbo Tax and would like to file as Married Filing Jointly(MFJ). My wife has had no income in 2010 and hence does not have a W-2.

    From my understanding after reading IRS publication, I understand that my wife will be treated as a resident alien for tax purposes if I file as MFJ. Since she does not have any income, I do not anticipate big problems with this. However, in turbo tax where it asks for state residency of my wife, should I indicate "foriegn" or the state we currently live in (MA)?

    Also, does she still need to file taxes seperately? Prior to this year, she used a software called Cintax for tax filing purposes. Does she still need to do this?

    Do we need to send additional documentation to the IRS regarding any of this?

    Will this affect her visa status in any way?

    I apologize for the large number of questions, but I would really appreciate your help in this matter.
