  1. She can try to get the visa. The consul will ask her for the purpose of the trip, who is paying, if she is married and has kids. By experience, the consul could deny her the visa due lack of strong ties (in my case they told me a year ago that I was young and without family and for that he denied me the visa). But she could be the lucky one and get the visa too. The only thing I can advise is that she must answer the question with the truth, and if she has been working in the same company for a long time, maybe she will have the chance to get the tourist visa.   2. Watch me get in trouble again.. But I'm alittle Confused. You said a "Pending" Application for a K-1 ? Does not that have to Canceled/Terminated ?

    Your Timeline indicates No NOA1 but yet you stated: You Filed and have not Canceled as of yet.

    I might be wrong . I'm not sure if the Beneficiary can Cancel the Petition as well.

    Advice from other Members would help. Something just don't sound Correct if you have a Pending Petition and made no mention of Canceling it and wish to get a Work Visa instead.

    I cannot cancel the K1 petition because I'm the beneficiary, no the petitioner. My NOA1 is from October 26 but as I dont have any way to communicate with my exfiance, I dont know if it was approved or not and the only way I know I can send any communication refusing the K1 is when the case is in the consulate here in my country.

    I have a K1 petition on my behalf pending with USCIS. However, for several factors, the relationship didnt work, so I give up with my fiance and the whole process. Today a friend of mine called me and told me about a job offer to work in USA under H2B visa. My concern is, should I accept it?? I mean, I dont sure if with a pending case I will success with this new application. Thanks in advance for your responses.

    Ps. I dont know anything about my fiance and I dont know what happen with the process. I dont have any communication at all with him :(

    Question for my sister.

    What does it mean when the I-94 form for her J-1 visa says "Class J-1 (May 25, 2010) Until D/S"?

    When is her real expiration date if it says D/S?

    She just received a rejection letter from INS on her H-1B dated April 26, 2011 and we are planning on filing a motion.

    When will the clock start for her "out of status" status?

    Need help! Thank you so much for your response and advice.

    I've had that visa before and so far I know D/S means until the date the DS-2019 says (form cover period), and the expiration date is the one that says on her visa. For some countries you can stay 30 days more in status, but after that you must leave. As I read here, she applied for a H1B visa and it was rejected, so I think she just have to leave the country. By the way, when did she apply for the H1B visa? Did she request an extension of her visa? I think she is out of status already...

  5. Why was he denied the tourist visa the first time?

    He told me the consul didnt review any of his documents, that she said he was too young and without family (he is single, 25 years old)and that's it. He also said that he suspect he would get denied because the first thing the consul ask was if he was going to renew the J1 visa, and by that time the consulate denied all J1 visa to returning students that didnt have visitor visa. The consul also asked the purpose of the trip and nothing else.

  6. Hi, a friend of mine will like to know what are the chances he has to get a visitor visa. He's been in USA twice under J1 visa, but he got denied the visitor one last year. Now, his best friend has cancer and he would like to visit him. He is going to Europe next fall due he got a full scholarship to do a master program. Do you think this scholarship is a strong tie as proof he is going just as a tourist??? Thanks in advance for your replies.

Sometimes I feel the same, and start to have second thoughs about my decision of marrying my SO and left everything behind... but when I analize how lonely I have felt without him and how much I love him and how much I miss him and my style of life there, I just blow out those thoughs. I'm sure I wont regret this decision. If is it scary?? Yes it is, but I see it like a new adventure in my life. It will take time to adjust to a new country, new culture, new life. But I think the scariest is marriage!! lol Who knows what will happen in the near future, but one thing I'm sure is we are going to do our best in order to have a happy life together.

We did do medical and police report never had interview ......because i did do police report 2008 and did medical in 2010 we thought we could pick it up from there but they sent us a letter saying the K1 visa was timed out and we had to start partition all over again and it has been denied twice since.

    We have no idea where to go from here does anyone know what we should do now?

    Also reason being why i didnt go ahead back them is because my daughter had a baby and needed me at the time

    It seems to me that you K1 petition is expired already, because if the petition was approved on 2008, but you try to attend to interview on 2010, the case is timed out already...
