File for N400 under GC with VAWA status -- Annulment

My relative is in limbo. 

He obtained his GC under VAWA in 2007 and he has just filled for an annulment with the ex...he has suffered years and years of deep depression to the point where he keeps everything to himself... sad to see this.

He is now married to a new lady who is naturalized, should he be worried to file his N400 under his VAWA green card?

he has had a greencard for ten years he should file on his own and not through marriage to a usc. the requirment is to have the greencard for 5 years if not filing as a spouse of a usc so he has more than met the requirement.
