Hey everyone,


I am getting really confused on this visa stuff. I'll give you a little backstory and see if anyone can help.


I married an Aussie girl in Nov 2014. I moved to Aus in Feb 2015. We started the visa process mid 2015. The I-130 was accepted while I was still in Aus. When we started the NVC process, my income for the previous year was very low. I realized I needed a joint sponsor. I had my dad do the joint sponsor. Out of ignorance, I had him do a I-864A. We sent in our part and my dad sent in his. Feb 2016 I had to come back home to the U.S. A month ago, I received a letter saying that my dad never did a I-864. He did do the I-864A but that obviously was wrong. It also told him that he did not include his tax transcripts. This is what the email looked like. I Went ahead and had him fill out a I-864. He also got his last three years of tax transcripts.My dad is married and added her income on his household members income. I had it all ready to fill out and called the NVC to verify. They said that if he is using her info, then she needs to fill out a household member form (I-864A). That is where I am at now.


A few Questions. I am the sponsor, my dad is the joint-sponsor (but sponsor when filling out the form I-864) and my stepmom is the household member, correct?



Part 2, section 1C on the I-864A, it says "I am not the intending immigrant. I am the sponsor's household member. I am related to the sponsor as his/her:" Do I put "Spouse" because she is my dads spouse. Or do I put "Other-stepmom" because I am the actual sponsor? She is household member to my dad. I am lost.



Part 4, Section 1 o the I-864A: They filled together last year so is it ok to just put the 1 tax return, plus my dads last 3 year tax transcripts.



Part 5 on I-864A: It is saying sponsors promise. Is this me, the actual sponsor? Or is it my dad, the co-sponsor? She is filing a household member for HIS I-864, so would he be the sponsor?


On the same part, where it says this,what is the Indicate Number? Is that my wives name?



Any help would be appreciated so much :) Thank you!!

She is acting as your dad's household member, not your household member. She selects Spouse. Your dad and you are both sponsors (you are the main sponsor and your dad is a joint sponsor); each sponsor has their own household and each sponsor can have household members. She is specifically your dad's household member.

Part 4, Section 1 o the I-864A: They filled together last year so is it ok to just put the 1 tax return, plus my dads last 3 year tax transcripts.

She would put the "total income" numbers from her tax returns from those 3 years, no matter if she filed jointly with someone (e.g. your dad) or separately. For those years that she filed jointly with your dad, the number will obviously be the same number as the one on your dad's I-864.

Part 5 on I-864A: It is saying sponsors promise. Is this me, the actual sponsor? Or is it my dad, the co-sponsor? She is filing a household member for HIS I-864, so would he be the sponsor?

The sponsor she is being the household member of is your dad. It's his name and he signs.

On the same part, where it says this,what is the Indicate Number? Is that my wives name?

The number of immigrants would be 1 (it should be the same number as on Part 3 #28 of your dad's I-864), and the first (only) intending immigrant would be your wife.
