Cover Letter 1 (I-130)

To whom it may concern,

Enclosed please find completed form I-130, Petition for Alien Relative for my wife #####. Also please find enclosed the following as proof of my U.S. Citizenship:

  • Copy of Unexpired US Passport

Also please find enclosed the following supporting evidence to prove a family relationship:

  • Copy of our Texas marriage License
  • Copy of our apartment lease showing joint tenancy of a common residence
  • Copy of our Wells Fargo Bank Statement showing co-mingling of financial resources
  • Copy of our T-Mobile bill showing co-mingling of expenses and ongoing marital union
  • Copy of our Harris County Toll Road Authority transactions showing both our vehicles sharing an account.
  • Copy of our vehicle car insurance and
  • Photographs of our Wedding Ceremony and Reception

And also please find enclosed:

  • G-325A filled out by LLcoolmg (US citizen)
  • G-325A filled out by ###### (beneficiary)
  • Photograph of LLcoolmg
  • Photograph of ######
  • Personal Check in the amount of $420 for filing fees.

Cover Letter 2 (I-485)

To whom it may concern,

Enclosed please find my completed form I-485, petitioning to adjust my current visa status from J-1 to U.S. permanent resident. I am filing based on an immigrant visa number being immediately available. Please note that originally my J-1 visa was subject to the 2 year foreign residency requirement, however USCIS has granted me a waiver of the 2 year foreign residency requirement; the approval notice is enclosed. Also please find enclosed:

  • Copy of my Birth Certificate
  • Copy of my passport front page and pages with nonimmigrant visas
  • Two identical color photographs
  • Form I-693 Medical Examination Report
  • Form G-325A
  • Form I-864 Affidavit of Support
    • Copy of 2014 US Tax Return from my sponsor
    • Copy of US Passport of my sponsor
  • Copy of Form I-130 which demonstrates that a visa number is immediately available.
  • Form I-765 Application for Employment Authorization
  • Personal Check in the amount of $1,070 for filing fees.

Do you have documentation for the waiver?

Adjustment of Status from H-1B, Family-Based
07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.
Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

Cover letters are not required nor are necessary.

Do you have documentation for the waiver?

Waiver documentation yes. It's actually mentioned in my cover letter. That's why I think they're helpful.

I practice civil litigation. I can't think of an instance when we did not use a cover letter for correspondence with enclosures, which is what this is...

I missed the part where you said the approval was included.

You can do what you want. I'm just saying that they're not required nor necessary, especially since most people applying aren't lawyers.

Looks good otherwise.
