My USC wife who is sponsoring AOS green card had stable income around 70K from last 4 years. Recently at end of 2015 she left job to study because now we live together and I can support her on my income. In 2016 she still goes to work but now only 4 to 6 days in a month, 8 hours per day. She may start working full time or more hours by July but I don't think I can use that judgment to count her income. If I go by her current working days 4 per month it goes below poverty line and if I count it by 6 days per month it goes above poverty line. I have more than enough income to support I-864 but it's her income that I am worried about which significantly decreased from last year.


Questions:

1. I am confused how should I calculate her current income?

2. On I-864 it states that you do not need to fill assets portion if your total income is above poverty line which it is in our case if my income is counted.

Will it be helpful if we both send our current bank balance statements which amounts to total of more than 60K combined in cash without filling assets part on I-864? This is just in case USCIS decides to ignore my income and issue RFE based on my USC spouse income.

If both spouses' incomes are eligible to be used in the calculation, then 1 income CANNOT be disregarded to force the couple's joint income to be under the poverty level. No worries! :)

05/22/06 - Biometrics scheduled (online update) and appt letter was mailed on 05/20/16 - Day 12
