Hey guys,

I have a question or two on behalf of another with respect to filing the I-129F. He and his American fiancée are currently living in Ireland.

#1 Does the US citizen have to be living in the US when they file the I-129F? Does there address have to be an American one? I would think yes.

#2 It should not matter if the I-129F is mailed from a country other than the US, right? (i.e. before the US citizen moves back from the foreign country).

#3 After the US citizen files the I-129F, can the alien visit the US on the VWP? I was advised to not visit. However, if you genuinely are not intending to stay more than 90 days on that visit, then I would think it is probably not a big deal.

1. No, what is important is that petitioner is US citizen, no matter where he lives, he can fill out the petition from any country. And his address doesn't have to be American one.

2.No, it is not matter.He can fill out from Ireland.
