Hey guys,

I have a question or two on behalf of another with respect to filing the I-129F. He and his American fiancée are currently living in Ireland.

#1 Does the US citizen have to be living in the US when they file the I-129F? Does there address have to be an American one? I would think yes.

#2 It should not matter if the I-129F is mailed from a country other than the US, right? (i.e. before the US citizen moves back from the foreign country).

#3 After the US citizen files the I-129F, can the alien visit the US on the VWP? I was advised to not visit. However, if you genuinely are not intending to stay more than 90 days on that visit, then I would think it is probably not a big deal.
