Fiance in rock band - does that count as a job on G-325a?

Hi there!

I'm helping my fiance complete his G-325a, and we have differing opinions on whether his band would count as a job.

My suggestion was to complete the form with the jobs on his resume from the past 5 years. However, his band has toured on various continents which leaves major gaps in his employment history. I understand where he's coming from, but the band isn't registered as a legal entity and I don't think it should be included.

Any suggestions?

As someone who is also in touring bands and knows how that kind of entity usually works financially, I would judge that by whether or not he actually gets paid by the band and whether or not he reports that income on his taxes. If the band itself is not registered as a business (or if none of the band members has taken it on to report the band's income as their own as a small-business) I would think you'd have to explain the situation with an additional letter.

I am the lead entity/person in my band, and I report earnings on my taxes, so I include this under the umbrella of being self-employed. I file my taxes as a self-employed artist, so it's legit in that regard.

Someone else would know more about the employment gap issue, but I believe I read somewhere that if there are gaps you should explain it? Either way he might have to somehow state that he's in a touring band?
