Hello All,

I filed a petition for my wife and her son (I-130) on December 16th, 2013, received the NOA on 12/21/13. Since then, I have been contacting USCIS about the status and nothing has changed. On various instances, I was able to speak to a customer representative and I was told they couldn't tell me anything until the FIVE months of my applications were up; well, I called them on May 16th, 2014, exactly FIVE months, I was then told that the service center was processing applications starting Nov. 5, 2013. Then, exactly, yesterday (june 3) I decided to call again; I was again, told that they were still processing application from NOV 5th. I asked the representative for more info and she stated she could not provide more information; I then, asked to be transferred to a tier 2 rep, the person insisted none was available. Can someone tell me how to proceed? I don't want to ruin my chances of getting my applications approved if I contact my congress representative.

If they won't provide you with further information and you have received no RFEs, and you've submitted an inquiry through e-mail also, I'd suggest contacting your congressman. I've never read of a case in which this has had a detrimental impact upon on an I-130 petition. I would also suggest mentioning to your Congressman that the USCIS for Nebraska's processing times as of May 6th, 2014 stated that they were processing I-130s within the timescale of 5 months. If there are no complications with your case, then clearly this isn't true.
