We are currently waiting for I-130 petition to be approved, in the meantime my parents have organised a family holiday in Orlando for their wedding anniversary, flying out tomorrow. I will be travelling on VWP and my wife is flying down from Philly to meet us. I've been confident about getting in with no problems but now the day is upon us im so sick with worry that they might turn me away. I have a letter from my work but not much else.

Please regale me with your tales of getting in just fine on VWP whilst you have a petition pending and calm my nerves a bit!!!!!!

I think you should be just fine, especially since the purpose of your visit is a family holiday. Will you be traveling with your family, there and back? If that's the case, and if you have a return ticket, I don't think it will be a problem at all though.

A letter from your work is good, but here are a couple more things you can bring: any notices that you've received from USCIS (i.e. a copy of your NOA1 – you don't need to mention it if it doesn't come up, but in case it does come up that you are married to a US citizen, they may ask about your plans to apply for a visa, and you can tell them where you are in the process), your travel/hotel itineraries or receipts, and proof that you can support yourself financially during your stay.

My husband visited on the VWP just after our I-130 was approved (although we had planned the trip before it was approved because it was taking forever and there was no end in sight) but before we had our case number at NVC. You can check out the thread that I started when I was worried about this same issue, although my situation was considerably riskier. Lots of people posted about their visits, as did we:

Personally, in your situation, I think you should be just fine, but it's good to be prepared!

02.26.2011: Got NVC case number from AVR (entered on 02.24.2011)
02.28.2011: Called operator to give email addresses and get IIN; emailed beneficiary's change of address and DS-3032; received instruction emails from NVC; AOS fee bill invoiced and paid
03.01.2011: AOS fee shown as "paid"
03.03.2011: DS-3032 accepted; beneficiary's address updated by NVC; IV fee bill invoiced and paid
03.07.2011: IV fee shown as "paid"; AOS and IV packets sent out together via USPS Priority Mail (delivered on 03.09.2011)
03.22.2011: AVR and operator tells us we will receive an RFE
03.26.2011: Received RFE checklist via email (asking for PCCs from China and Taiwan)
03.28.2011: Sent checklist response via USPS Priority Mail (explaining/demonstrating that PCC should not be required)
04.10.2011: AVR message says that checklist response was received on 04.08.2011; sign in failed
04.11.2011: Case completed at NVC!
04.13.2011: Interview date assigned, received Packet 4 via email

Thanks for the reply. Ive been so confident about it upto now and the nerves really set in today.

I am travelling with all my family, and I have a return flight booked for 2 weeks. I have a letter from work and ive also got my car insurance certificate and my mobile phone bill, all in a seperate 'just in case' pile with the NOA1. I've made sure not to take anything other than holiday clothes in my suitcase in case they open that to look, and as my parents have booked a villa we have all the info on that. I've got my car rental voucher for the 2 weeks im there, ending the day we fly back. I really think ive got all bases covered but you just can't stop those nerves creeping in can you?

At least having read the thread you linked i feel a bit better...thanks a lot!!

You're welcome! It does seem like you have everything you need, especially since you are traveling with your family and have your entire trip laid out like that with accommodations, car rental info, and everything else. When you're traveling with a group and it's clearly a planned holiday, they don't really have any reason to suspect you. It's when you show up alone with two giant suitcases and no money and you say you're going to visit your wife that they start asking questions!

I know we can't help worrying a bit... but you'll definitely be fine. Good luck and enjoy your visit!
