Hello,

I'm currently applying for green card based on marriage (wife is US citizen). I'm on OPT right now.

My wife is currently a student and only works part-time, i.e. her income alone is not enough. I have a job and mine is more than sufficient to meet the poverty guidelines.

(a) is it frowned upon to use the intending immigrants salary to meet the guideline? or does it not make a difference?

further, in #25, "federal income tax return" section, whose income do we need to use (her's or mine) for the total income section? Her's is quite low because she's a student. Will it look bad?

Because she has been a student, she has not been very dilligent in filing her taxes as much as she should have for the past couple of years. She'll be filing this year's taxes, of course.

(B) Given this scenario, can the application be rejected because she has not been filing taxes? (i have, in fact, paid all my taxes)

© if my income is the primary income being used, do i need to also submit W-2s for the past three years/one year?
