Yes there's a lot at stake. More than our opinions as to what is legal and what is not, which we are not qualified to offer in the first place.

The OP needs a consult with a competent and qualified immigration attorney. There is more at play here than intent at the border. The manner of last entry and the length of time they have been here now is also important.

And for the record, the border officers already blessed the entry of the OP despite the fact they were already married. It isn't a crime for married foreign-born individuals to enter the US - not all have intent to remain here when they cross over.
