F-1 student married to no-income USC. Help writing I-864 form plz.

We are a student couple, USC sponsor's only income is student loans, spouse(beneficiary) is a phd student with legal income. Can that count as total household income?



Caveat is that his income is based on his F1 student visa status and is being paid by his school during the duration of his PhD program by doing research assistant. He pays tax and has SSN.


I, the sponsor, is in grad school, and my loan covers my living expense. But since I don't get payroll, I didn't have to file tax return for the past 4 years.


My husband's income is over 125% of poverty guideline. But somebody says that F1 salary is not eligible to I-864. Is it correct?



My plan is..


I may list my school name as employer, but my income is zero in line 5.


Write my husband's name/salary in line 6.


Write total income = husband's income in line 10.



Will it work???

Hi,

I don't think there is a clear-cut YES or NO to your question. The instructions say that the income "must be continuing from the same source" in the future, but it does not say how far in the future. I was in a similar situation and I decided to NOT use the research assistant income, and instead find a joint sponsor. But that was with easy availability of a joint sponsor, I don't know what I would have done if it was harder to find one.

Try to use the advanced search function to check if someone did this successfully, or maybe someone shows up in this thread.
